NYCPM Medilaw Club and Touro Law Club Discuss Malpractice Case
 
The New York College of Podiatric Medicine's (NYCPM)' Medilaw Club chaired by NYCPM student Michael Nissanoff and the Touro Law Club chaired by Touro law student Carla Slattery organized a joint virtual club meeting on February 27th to discuss a medical malpractice case on bunion surgery. In a 90-minute discussion, they  tackled malpractice law and risk management strategies as a part of the case study discussion. One key takeaway was the biggest legal risks in medicine often stem from miscommunication rather than medical errors. Clear documentation and patient education are essential.

The Clubs plan to continue the discussion on this case and cross-collaborative learning between law and medicine at next month's meeting. Al Mercado, partner with Feldman Kieffer, facilitated and led the discussion and provided the malpractice case.

Los Angeles County Podiatric Medical Association (LACPMA) hosted its annual PRESENT Treasure Hunt conference on February 22-23 in Downtown L.A, bringing together leading podiatric professionals from throughout the Western U.S. for an engaging event focused on the latest advancements in both the science and business of podiatry.

Here’s how to create a comprehensive, protective document, following Associated Press style guidelines.
 
1. State your purpose and disclaimers clearly.
 
Begin with an introduction outlining the handbook’s purpose, emphasizing that it is meant to inform employees of your practice’s policies, mission, and culture. To protect your organization, include a disclaimer noting that:
  • The handbook does not form an employment contract.
  • Employment is at-will unless state law dictates otherwise or you have an explicit contract in place.
  • Policies can be revised or discontinued at management’s discretion.

OBITUARY
RE: The Passing of Myron "Mike" Charles Boxer, DPM
 
Myron "Mike" C. Boxer, DPM, 87, passed away on March 1, 2025. He was a 1961 graduate of the New York College of Podiatric Medicine (NYCPM). Dr. Boxer was the longtime chairman of the Department of Podiatric Medicine at NYCPM.

Dr. Grife suggests that with limited malpractice liability insurance, a plaintiff attorney is less inclined to file a malpractice action. This may or may not be true in a particular case. The ability of a plaintiff to seek payment from a podiatrist when the judgement or settlement is in excess of malpractice policy limits varies from state to state. Asset protection is important to consider for any healthcare provider.
 
In some states under some circumstances, the plaintiff can, for example, place a lien or levies on your personal assets such as bank accounts, homes, etc. You may be required to satisfy a judgment by taking out a loan against your hard earned assets. Sometimes the jury awards are later adjusted. You should consult with an appropriate healthcare attorney regarding asset protection rules and regulations and applicable strategies relevant...

Dr. Jacobs mentions the importance of patient selection. This reminded me of a quote from Dr. David Jacobson (not a relative) while I was his preceptor in 1983, “the best surgeons know when not to cut.

In Dr. Jacobs' response he stated,  "No surgery is routine.” I love the phrase that "minor surgery is something that you do to somebody else. If it is on you, it is not minor." When I was a resident, our medical director addressed both the podiatric and medical residents and said the following, which I also love... "There is no such thing as minor surgery, only minor surgeons."
