A smartphone can be a distraction to staff members and also a potential HIPAA violation waiting to happen. Here are tips to avoid that at your practice.
6. How will you enforce your policy?
Not all violations are created equal: An unauthorized patient photo is not in the same league with a quick text to check on mom’s surgery. Allow yourself the firmness to terminate immediately when needed, but the flexibility to coach when warranted. Some situations may generate additional questions or responsibilities. What if an OSHA violation is photographed, even if cameras usage isn’t allowed in clinical areas? In this type of grey area, balance your desire to protect your practice's reputation (say, by deleting the photo) with a very careful understanding of the employee's rights and your obligations to correct the problem. Consult an expert whenever things get tricky.

Query: Medicare Denials in Michigan
We are in Michigan and just starting getting rejections from Medicare for routine foot care. They are bundling nail care and callus care on qualified patients when the callus is not on the toes, but on the foot. They are rejecting the nail care with the callus. They are also rejecting G0127 when billed with CPT 11720.
Another issue we are seeing is the rejection of injections when billed with an Unna boot. We are using all the correct modifiers. As I recall, this happened last year and then an edit was corrected and things got paid as normal. This year's edit code is 871 from the National Correct Coding Initiative. We just started statusing the claims and sending in office notes, but this is a lot of work. In the past, they have always paid on the appeal but these clean claims should go through the first time. Is anyone working on this? I think this is all wrong and imagine it is going on at least in our region, if not nationally. Any information on what is being done to tackle this problem again would be helpful.

Response: We have been battling these rejections for foot care for quite a while, not with traditional Medicare but with Medicare Advantage plans. The only way to handle this is to appeal with notes. If your notes are good, you should have no trouble getting paid. I keep hoping that with consistent appeals and overturns, the companies will give up and pay without the appeals, but so far that hasn’t happened. It’s a lot of work appealing them all, but it does work.
We have seen that we wouldn’t be paid for an Unna boot and an injection on the same date of service for a long time. Frankly, we just don’t see many claims for Unna boots anymore. I’m not sure what would happen if you appeal this one, but it’s worth a shot.

Dr. Herman mentioned two obvious measures of diabetic foot exams and fall prevention. In my opinion, one of our most obvious should be onychomycosis as it is rather ubiquitous. My suggestion is to work with our podiatry-friendly laboratories (Bako, McClain, etc.) to collect data such as not only organisms (dermatophytes, saprophytes, molds, yeasts, Pseudomonas aeruginosa, etc.) that are in the nail plates, but also gross and microscopic clinical findings, such as abscesses, hematomas, chronic or acute trauma, etc.
It would be nice to see some kind of grading system that gives podiatrist an idea of what treatment modality will work best. For instance, superficial white onychomycosis is different from distal-subungual which is different from total nail and matrix involvement; so, how is each best treated in relationship to the organisms identified? Now with the advancement of PCR studies, we can get much more accurate information quickly. What do we do with it once we have it?

I too, have a very low recurrence rate from P&A procedures because I saw the problem early on in my career. A side nail matrix to me brings up the following image: sticking an index finger into a cup of pudding, then quickly retracting it. What do you have? A hole with the matrix extending in all directions up from the floor of the indentation. With the thinned out cotton tipped applicator soaked in phenol, I apply firm pressure in a centripetal fashion to soak all sides, including the invisible dorsal side of the matrix.
Twenty seconds from the finish, I do this again. With this, I get minimal 'residual nail spurs' 6 months post-procedure. In addition, what is very important is to explore the evacuated space with a curette after using the anvil nail splitter. Many times, I have pulled out a small piece of matrix that would be left without this inspection.
