Kathryn LaViolette, DPM has become The American Academy of Podiatric Sports Medicine's first Podiatric Sports Medicine Fellow of The Running Institute in Chicago, IL. Dr. LaViolette was part of the AAPSM Fellow In-Training program under the direction of AAPSM Fellow Michael Chin, DPM.

Dr. LaViolette  graduated from the Dr. William M. Scholl College of Podiatric Medicine, and had a unique residency training experience, being part of the first graduating class out of Advocate Christ Medical Center in Oak Lawn, IL. She has been published in the Journal of the American Podiatric Medical Association and served as Assistant Scientific Chair for the 2020 Midwest Podiatry Conference.

Pandemic Problematic for Feet: DC Podiatrist 
 
The coronavirus crisis is beginning to impact people’s feet, according to a DC-area podiatrist with advice for what might help. “We’re actually seeing a huge array of foot issues that have come from people who are now homebound because of the pandemic,” said Howard Osterman, DPM of Foot and Ankle Specialists of the Mid-Atlantic.

Dr. Osterman is the team podiatrist for the Washington Wizards and Washington Mystics and consults with Georgetown University sports teams. “We’re seeing a lot of heel pain; we’re seeing a lot of arch pain,” he said of patients visiting his Silver Spring, Maryland, and DC offices.

Query: Tenotomies and Timing
 
Sometimes, I stage tenotomies or a patient will develop a new ulcer on a different toe that requires a tenotomy. What would be the appropriate modifier(s) for CPT 28010 in the global period, when CPT 28010 has been performed previously?

Response: I'm not sure what you mean by staging tenotomies. That would imply that you are planning on doing multiple surgeries from the outset but plan on doing them at different times. You need to document why you are doing them individually versus all at the same time. If you do multiple procedures then there is a fee reduction for doing multiple surgeries on the same day. If you do them individually, then this would not apply… but that could imply that you are doing so to avoid the multiple procedure reduction. That could be considered abusive billing. So make sure you document what you are doing and why clearly in your chart.
 
If the surgeries are on different toes, then use the -79 modifier. If this is a true staged procedure (but in my opinion that would imply on the same digit), then it would be the -58 modifier.

QUERIES (MEDICAL-LEGAL)
Query: Off-Label Prescriptions for Non-FDA-Approved Drugs
 
A patient of mine has erythromelalgia and came in with a paper showing anecdotal evidence that a new med used to treat migraines helps. I was willing to give her an off-label prescription but to my chagrin found that it is only available in Europe and Canada and is not FDA-Approved. Here is the legal question: Could I give her a prescription and have her fill it in Canada? Is this opening up a can of worms since it is not approved yet in the USA?

If you prescribe any FDA-approved medicine off-label, you must inform the patient. It’s a good idea to have patients receiving off-label medicines acknowledge in writing that they are aware that the drug has not been approved for the treatment you are prescribing it for.

The short clip in a recent PM News is a gross oversimplification of the policy change and will not have an immediate impact on the provision of products and services by podiatrists. The proposed CMS policy is to be adopted for services provided after April 2021, is well over 200 pages, and is far from an easy read. It will take some time to digest what, if any, implications this will have on diabetic patients with respect to DMEPOS, shoes, continuous glucose monitors, and other DMEPOS.
 
Certainly, this will have a direct impact on manufacturers who have had a rather rough go at bringing new technology to market. A quick review of the HCPCS coding structure, not really modernized in over fifty years, is but one example of the many stumbling blocks manufacturers have at bringing new technology to market.
