STARK LAW UPDATE
HHS Revamps Stark Law Rules
 
HHS on Wednesday unveiled its long-awaited proposal to change enforcement of anti-kickback laws, suggesting value-based payments and coordinated care should not fall under the Stark law's purview. In two proposed rules from the CMS and HHS' Office of Inspector General, the agencies said the kickback protections "unnecessarily limit" coordinated care, and the changes are meant to root out fraud rather than data-sharing among providers that would facilitate better patient care.
 
Under the proposed rules, specialty physician practices could share patient information with primary-care physicians to manage care or work with hospitals on discharges using data analytics. The safe harbors include allowing hospitals to pay physicians incentives as part of CMS-sponsored care models; care coordination activities to boost quality, outcomes, or efficiency; and value-based care relationships with significant downside risk.

The daily grind of seeing patients can sometimes be, well, grinding. It’s important to take a step back and reconsider how you do things. There’s likely another way to achieve the same, if not better, result, especially when it comes to staffing. Here’s a sample of what 943 practice owners, managers and physicians say has helped them create a better environment.
 
10. Keep in mind that taking away something is bad for morale. If you give a holiday bonus the first year, then you should be prepared to give a holiday bonus forever. If you do that, then give a set amount every year and don't raise the amount — or else employees will expect an increase every year.

Query: BlueCross Bilateral X-Ray Denial
 
We are getting a request for refund regarding incorrect billing for bilateral x-rays. Is there a new rule for billing x-rays other than CPT 73630 -RT and CPT 73630 -LT on two lines?

Query: It sure looks correct to me. There are 3 possibilities.
1. The insurance carrier is in error and the bilateral X-rays were billed appropriately
2. The insurance carrier wanted the bilateral X-rays billed on one line: CPT 73630 – 50
3. I have encountered this same scenario with United HealthCare several times in the past. They wanted the X-rays billed on two lines, but in the following fashion:
CPT 73630 – RT
CPT 73630 – LT, 76 (Repeat procedure or service by the same physician or other qualified healthcare professional)

I chanced upon a Koven Hadeco SmartDop 20, in excellent condition, for minimal investment. I would like to be able to use this at a satellite clinic but do not have the operations manual. Of course, the company no longer supports the device, nor has any manual (or so they say). Does anyone know where I could find one?

It was an interesting response from Dr. Steinberg. The part about "believing in medicine". A few years ago, I spent 3 days researching this topic. Most of the information came directly from the CDC website. I read the bulk of the studies available at the time, their statistics, and conclusions. The fact is that influenza is not a reportable disease, therefore all of the numbers that they publish in regard to those suffering from influenza and the deaths associated with it are made up numbers, extrapolated from very small samples; the website actually states that.
 
The fact is most people do not die from influenza; they die from secondary pneumonia, and those numbers are also extrapolated from a very small population samples. Deaths for the most part are...
