AT THE COLLEGES
Donation Aids NYCPM’s Work in Biomechanics

For the tenth year in a row – a decade! – a grateful celebrity patient of Joseph C. D’Amico, DPM, who was relieved by the doctor of his chronic heel pain, has made a significant donation to support NYCPM’s work in biomechanics. Dr. D’Amico is a professor of and past chair of the department of orthopedics and biomechanics at NYCPM.

(L-R) Drs. Joseph D'Amico and Michael Trepal

Specifically, the gift will support the school’s efforts to further the science and teaching of biomechanics through the College’s state-of-the-art gait lab and via its meetings dedicated to biomechanics. Dr. D’Amico chairs an important, annual seminar devoted to biomechanics, which is also supported by this donation. In addition, last year’s gift aided Samantha Landau, DPM, MPH’s specialized training in biomechanics, allowing her to function as a “liaison bridging the gap between surgery and biomechanics,” as NYCPM’s first modern fellow in orthopedics.

PODIATRISTS IN THE NEWS
CA Podiatrist Discusses Ankle Sprains

As fall sports heat up for kids, so do 5Ks, marathons, and golf tournaments for adults, leading to ankle sprains for athletes of all ages. “Both serious athletes and weekend warriors often underestimate how serious a sprain can be, and they rush back into action without taking time to rehabilitate the injury properly,” says Michael J. Cornelison, DPM,  foot and ankle surgeon and president of the American College of Foot and Ankle Surgeons. “While no one enjoys being sidelined from the physical activities they love, quickly diagnosing and treating an ankle injury expedites the healing process. It also reduces the chances of long-term, chronic ankle pain.”

Dr. Michael Cornelison

Most ankle injuries require no surgical intervention, according to Dr. Cornelison, who stresses that foot and ankle surgeons will always choose the most conservative treatment for the best long-term outcomes. In addition to rest, ice, compression, and elevation, (also known as RICE) doctors may also recommend physical therapy to promote healing and range of motion, as well as NSAIDs to reduce pain and inflammation. In more severe cases, or in cases where the injury was initially neglected, surgery may be required to repair the damaged ligaments. The foot and ankle surgeon will select the procedure best suited to the type and severity of the injury.

IN THE COURTS
AMA, 2 State Medical Societies Join Class-Action Suit Against Cigna

The American Medical Association (AMA) has joined a class-action lawsuit against Cigna, alleging the insurer underpaid for claims filed by providers in the contracted MultiPlan network. MultiPlan is the country's largest third-party network, and Cigna contracts with it to access providers. According to the lawsuit, which was initially filed in June, Cigna reimbursed for claims from providers in MultiPlan's network at its non-participating providers rate rather than at the rate expected for a MultiPlan contract.

As such, the insurer "significantly underpaid claims, and put patients at risk of balance billing," the plaintiffs claim. "It also breached its fiduciary duties, including its duty to honor written plan terms and its duty of loyalty, because its conduct serves Cigna’s own economic self-interest and elevates Cigna’s interests above the interests of plan member patients," according to the lawsuit.

PRACTICE MANAGEMENT TIP OF THE DAY
What to Consider Before Starting a Concierge Practice

A concierge practice can be a lucrative way for a provider to achieve work-life balance by reducing the number of patients, increasing time with patients and making great profits. But before you transition, speak with an experienced attorney who can help the transition.

Here are some possible pitfalls:

3. Kickbacks

Review the ways you are marketing and convincing patients to use your concierge services.

An issue that arises is that of illegal kickbacks and fee-splitting legal rules. When concierge practices offer free services, this raises concerns under the federal antikickback statute, if Medicare is involved, or state antikickback laws. Enforcement authorities can view the free service as an illegal inducement for clinical services.

RESPONSES/COMMENTS (MEDICAL EDUCATION)
From: Brian Kiel, DPM

Dr. Rosenblatt was making a well thought out (but erroneous in my opinion) opinion about covid until he stated that virologists were cowed into silence by "powerful media" and "those who want to replace a conservative government above all else". Sir, if you want to make a scientific or even personal statement about covid, I respect your right whether or not I agree. However, when you start the nonsense implying that there is a great liberal force trying to stop the misinformation from coming from "certain sectors", you lose credibility. We all have opinions and we are free to state those that have validity, not necessarily true, but thought out. Trying to validate those opinions with conspiracy actions is offensive and divisive no matter where they come from.

RESPONSES/COMMENTS (PM ARTICLES) - PART 1
From: Lance Malusky, DPM

That was an excellent article on including "I'm sorry!" into a conversations with a patient with an untoward result. I don't believe that PICA actually recommended that phrase, but they did recommend numerous actions to protect you from a lawsuit, and to mitigate damage to one's medical reputation.  As soon as I saw an issue, such as a regrowing phenol nail, or bunion, I  "followed" Dr. Baum's 4 R's. These actions were instilled by PICA's monographs and seminars over the years. As a practitioner's primary duty is the patient's welfare, recognizing a problem early and advising the patient on a course of action is necessary.

My surgical consults and permits always had a list of potential generic complications, including "death." Luckily, I could always say that never happened, and that defused the remaining scenarios as less intimidating. I always made sure that each patient, and interested family member, had a chance to read the surgical permit, which also had a blank space for specific issues with each surgical case. They would sign both copies, and retain one copy with post-op instructions sheets. (The unalterable photocopy with an original signature was the one I kept in the paper file). Hospital cases always signed at a late consult date, prior to the surgery date.

An unspoken advantage of the "Apology" discussion is the activation of the statute of limitations regarding a malpractice suit (one year in Ohio). This can be implemented in the patient chart in detail. The doctor discusses and documents the poor result, his remorse without admitting some specific "guilt,"and encourages a mutual responsibility to participate in actions for remedy.  As far as monies, I would offer a redo for an occurrence less than one year post-op, but still bill insurance, and agree to write off any balances.

RESPONSES/COMMENTS (PM ARTICLES) - PART 2
From: Ivar Roth, DPM, MPH

I would like to help Jeff Root understand what Dr. Shavelson meant. First, Dr. Root did give us the “language” which is still useful today but more in a historical perspective.

I have spoken to Dr. Shavelson in the past and I understand where he is coming from and I will try to interpret with my own twist his and my understandings. While Dr. Shavelson and I may disagree on what to call his biomechanical theory, I believe he is RIGHT ON. I subscribe to the MASS theory of orthotic lingo as opined by Dr. Ed Glaser. For those of you unfamiliar with Dr. Glaser’s theory, I would highly recommend that you...
