8 Tips for Avoiding Employee Handbook Crises
 
Many medical practices have an employee handbook, or employee policy handout, but fail to update them on a regular basis. There have been a large number of changes to employment law over the past couple of years. Here are some items you should be sure to include:
 
4. Disciplinary action - Do you have a policy about your process and how you will track absences? Review this policy carefully. Less is nearly always better than extensive. Do you have so much detail in the policy, that in practice you never comply with all of the rules? That could cause a problem if an employee wants to fight a termination and takes your handbook to an attorney. You should always have a statement that your disciplinary process, while liberal in nature, could result in immediate termination, depending on the seriousness of the infraction.

RE: Routine Foot Care

I noted a skilled nursing group is recruiting mobile podiatrists for one to two day commitments in an “underserved” patient group. They advertise their own equipment, software, and billing services to DPMs. I am not clear as to the framework of this care. I will reiterate that routine foot care is STILL not a Medicare covered service except under specific, defined, and well documented conditions. It is the obligation of DPMs to very carefully document and PROVE both the qualification for each patient and for medical necessity.
 
Medicare expects about 10-40% of this care to be either privately billed or donated by the DPM. This also means that patients and their families be informed ahead of time that the DPM services are not covered by Medicare. This is a well-known investigation channel for government regulators and auditors to seek and find podiatrists who violate these statutes and obtain convictions for Federal prison sentences. If you are taking part in any of these care positions, it is YOUR responsibility to prove you are following all the regulations clearly.
 
Absent private billing for non-covered services, a target expectation would be for podiatrists to openly donate 30-45% of these services and document them to prove to government auditors that they are following Medicare regulations. If a podiatrist can document donation of a significant percentage of foot care, it will be much more difficult for auditors to convict them of Medicare fraud.

No, you are not missing something. He should be able to assist ANY physician on ANY surgery. In Oregon, a podiatric physician can assist in general surgical procedures, Ortho, Neuro procedures, etc. They are not required to have the privileges to be able to assist. Good luck moving forward.

Many years ago, I would have agreed with your hospital. That is the assistant should be as qualified as the primary surgeon. In the past, the assistant surgeon should have been able to give input to the surgeon and opinion during the procedure. However in today’s world a “certified medical assistant” is allowed to assist in surgery and in many cases also bill an assisting fee. Many times, this is out-of-network which greatly benefits the employing surgeon. This is possibly a good argument for allowing the DPM to assist on procedures with the privileged DPM.  
 
Additionally, having a podiatrist assist whether trained in the particular procedure or not should decrease the OR time as the primary surgeon will be more efficient, and one could expect better outcomes as a result. Efficiency would occur as the assistant is more knowledgeable of the instrumentation and order of the procedure. Setting up power equipment, aligning a fixation wire or other hardware will be easier with a podiatrist, even one who does not do the procedure on a regular basis. The language and skill of the DPM assistant beats the knowledge of a “PRN” medical tech or a permanent OR medical assistant employed by the hospital but typically does general surgery or non-orthopedic procedures.
 
An item which the assisting podiatrist needs to check on is whether one's malpractice will cover them for these more involved procedures. Many times a doctor doing non-boney procedures will have a different medical liability coverage than one doing bone and tendon/ligament work.
