CA Doctor Settles FCA Allegations for $23.9 Million
A plastic surgeon in Beverly Hills, along with his son, and medical practices and billing company, have agreed to pay $23.9 million to resolve allegations that they violated the False Claims Act by submitting or causing the submission of false claims to both Medicare and Medicaid.
The civil settlement includes the resolution of claims brought under the qui tam, or whistleblower, provisions of the False Claims Act by parties who worked for the plastic surgeon (Dr. Aronowitz) and his associated medical practices and businesses. Whistleblowers include TDP, a billing company; Dr. Jason Morris, a podiatrist; and Harold Bautista, a billing department employee. Under the qui tam provisions, a private party can file an action on behalf of the government and receive a portion of any recovery.

Four Common Pitfalls Your First Year in Practice
Congratulations for making it through medical school and residency, and perhaps even a fellowship. Now — finally! — you’re ready for your first or second job. You may be clinically prepared, ready to see patients and begin procedures, but are you ready from a practice management perspective? There are four areas that trip up new doctors the most.
2. Fraud and abuse - You go into practice well trained in medicine but often have no clue about what business relationships can get you into trouble or what to avoid. Remember this: If it’s too good to be true, it is. If someone is giving you money for not much work, if something smells funny, if there is an underlying motive, be cautious. As a physician, you are an especially attractive target for kickback schemes because you can be a source of referrals for fellow physicians and other healthcare providers and suppliers. Patients trust you. If you tell them to use a certain lab or drug, they will. Companies want your patients and their business and will incentivize you however they can so that you send business their way. Be careful about relationships with labs, medical director agreements, and revenue-sharing arrangements.

RE: The Passing of William J. Saar, DPM
Dr. William J. Saar, 78, of Bratenahl, OH, passed away peacefully on April 23, 2023 at Promedica Memory Care Community, OH. Dr. Saar received his doctorate of podiatric medicine from the former Ohio College of Podiatric Medicine now Kent State University College of Podiatric Medicine. Following a half century of dedicated service to clinical care and leadership, he retired in 2019.

I need to destroy many old x-rays that are beyond their required retention (7/10 years). They cannot be shredded. I remember having someone pick them up for silver recycling several years ago. I need the name of someone who does this in the Philadelphia area.

My heart aches when I read about these cases. I am glad that the Editor includes these in his blog. I cannot understand how or why some DPMs would believe that they are not being observed, and that their billings are supposedly private. It is important to say this outright: "A computerized search of your billings for the last 5 years can be obtained by almost any examining authority in as short a time as 20 minutes."
Any pattern of abuse can be identified in about the same length of time. If I were surmising which DPMs get involved in these illegal projects, I would suggest that they are probably NOT members of the APMA and do not read this...
