| PRACTICE MANAGEMENT TIP OF THE DAY | |
8 Tips for Avoiding Employee Handbook Crises
Many medical practices have an employee handbook, or employee policy handout, but fail to update them on a regular basis. There have been a large number of changes to employment law over the past couple of years. Here are some items you should be sure to include:
5. Harassment - Do you have a policy that says harassment should be reported to the manager or supervisor? Just keep in mind that the manager/supervisor could be the person harassing the employee. You might want the employee to have the option of reporting to any manager. They need a way to report that does not affect their job in any way, so the reporting might be to a manager of a different department, or a supervisor in a different area.
The handbook should make clear that you will not tolerate harassment, and if any employee experiences or observes harassment, it should be reported immediately. The last thing you need is for a terminated employee to complain about unreported harassment and then enlist another employee to confirm their statement. Since your handbook should require that both employees must report harassment immediately, it would be more difficult for an employee to win a legal case if it was not reported until after the employee was disciplined.

| QUERIES (NON-CLINICAL) | |
Query: BPC 157 Peptides
I am curious if there are any podiatrists or teaching institutions who are using injectable BPC 157 peptides. I am aware that at this point it would be completely experimental. I do know that there are some orthopedic surgeons/sports medicine specialists prescribing the oral form and they are very happy with the results, but I haven't seen any human studies yet.

From: Ken Meisler, DPM
I appreciated Dr. Bass' comments about EHR Recommendations. However, if I am correct, Dr. Bass has been a consultant for TrakNet and I assume Modernizing Medicine who has purchased them. If so, he should have disclosed this.
Like Dr. Bass, I have been with the same software company for many years. I think I started with DR Software in the 1980s and have stayed with them and all of the companies that they have either been purchased by or merged with. I am currently using TrakNet and have been with them for at least 10 years. I have been happy with...

RE: Stop Insulting Other Podiatrists
From: David Mullens, DPM, JD
I am always amazed to see how willing podiatrists are to insult other podiatrists in this publication. For those doing the insulting, here is a little insight for you. A huge percentage of the readers will think you are a jerk for writing what you have written. And the individual you insult…that person will never, ever forget what you have written. If you wouldn’t want to be on the receiving end of your message, don’t send it.

| RESPONSES/COMMENTS (CODINGLINE CORNER) | |
From: Mark Spier, DPM
Now that Dr. Ressler has also misconstrued my comments as taking offense to a cash-based practice, I feel compelled to respond for the final time on this subject as I believe a cash-based practice is great, but the owner of one shouldn't criticize the billing practices of others that deal with insurance on a daily basis.
Dr. Roth has insinuated that I would bill for "every incidental finding during an examination". Dr. Roth has, in the past, referred to insurance participation "as a gift" which he has chosen not to accept. I, on the other hand, view insurance as a contract involving 3 participants, a menage a trois if you will. Dr Hodgson simply asked a question about billing an E&M code whilst performing an unrelated injection. Dr. Roth's esteemed opinion from a distance was that this was "cheating the insurance companies".
Respectfully, Dr. Roth, this is why there are modifiers, coding experts, and various appeal provisions because, unlike a "gift", contracts have specific performance requirements. I feel confident that Dr. Hodgson, whom I have never met, was not "looking at a stop watch" when she evaluated her patient.
Mark Spier, DPM, Reisterstown, MD
