The next physician lecture at Lexington Medical Center will focus on feet. Dr. Mark R. Kutyla of Lexington Podiatry, a Lexington Medical Center physician practice, will give the lecture. During the lecture, titled "Healing the Heel", Kutyla will talk about the latest treatments for chronic heel pain. Attendees also will have the opportunity to ask the doctor questions.

MEETING NEWS
AAFAS Holds Its Semi-Annual Scientific Seminar
 
The Academy of Ambulatory Foot and Ankle Surgery held its semi-annual Scientific Seminar January 6-8, 2016 at the LSU Medical School in New Orleans. 68 podiatric and orthopedic surgeons from the United States, Canada, Australia, and the Middle East participated in a cadaver lab and attended lectures on minimally invasive surgery of the forefoot, rear foot,  and ankle. Subjects included treatment of bone spurs, hammertoes, metatarsal problems, bunions, tendon imbalances, and the use of the HyProCure implant for rearfoot pathology.

Best selling author, Richard Jacoby DPM, demonstrated nerve decompression techniques for the treatment of lower extremity neuropathy and  discussed the role sugar and nutrition plays in disease. Monroe Laborde M.D. demonstrated rear foot tendon balancing techniques for the treatment of and prevention of pedal ulcers. The use of office-based CAT scans, diagnostic ultrasound, and the avoidance and treatment of complications were also discussed. The next meeting will be held June 16-18, 2016 at the LSU medical school in New Orleans.

HIPAA UPDATE
HIPAA and Encryption: ‘Addressable’ Does Not Mean ‘Optional’
 
You don’t have to travel far down the list of breaches on the HHS OCR Wall of Shame before you realize that many healthcare organizations still are not encrypting protected health information like they should. HIPAA experts and HHS officials have noted that many covered entities (CEs) and business associates (BAs) confuse the rule’s “addressable” provisions as “optional”, and now at least one compliance professional’s “gut feeling” says total encryption will be required in the near future.
 
The HIPAA Security Rule requires “unique user identification” in accessing electronic protected health information (ePHI), but leaves encryption as an “addressable” standard both in access controls and data transmission. The term “addressable” is often misinterpreted as an optional standard, consultants say.

Query: Fracture of Great Toe
 
A patient came in and had a fracture of the left great toe. We billed for the x-ray and fracture care. Five days later, he came in because he had dropped something on the fractured toe and was in more pain. We x-rayed the foot again, and he now has 2 fractures on the same toe. How can we bill for the x-ray and fracture without it looking like a duplicate claim? An "A" added to the fracture diagnosis codes will look like we are billing everything twice for the same incident. Any suggestions?

Response: Having an x-ray taken for a new injury is appropriate and reasonable. There should be no issue about billing the second x-ray. Make sure your records document the two separate injuries at different times and indicate that a second fracture of the same toe occurred. 
 
As for the treatment, I don't think you should bill for fracture care again unless the actual treatment changes (i.e., open reduction, fixation, etc.). If the treatment continues to be closed treatment with immobilization, I would not consider billing fracture care again.

I am 100% fully invested in my equity portfolio. The last two weeks have been an overreaction to China, decreasing commodity prices, Saudi-Iran tensions, raising interest rates, and fears of an ending six-year bull run. This market is oversold due to extreme panic. The U.S. economy is still faring well and corporate profits should rise 8-10% bringing the stock market back. I anticipate the market much higher by years end with the S&P fair value above 2,000. There are herds and nerds that are running away from this market in fear.
 
My barometers are showing extreme fear. In fact, the investor sentiment of professionals is at 29%. When the sentiment level of pessimism drops to 25%, there is going to be buying back in the market with strong uptick. I am buying and not running.

My esteemed colleague Dr Markinson and I have differing opinions regarding portions of this article. More and more patients are calling my protocol of including laboratory testing of toenails and livers “too expensive an investment”. They either leave untreated or opt to proceed with my multimodal dystrophic toenail program without testing. In reaction, I now offer patients the ability to be responsible for lab testing for the presence of fungus, or wait until the next visit if the program is not effective after I explain the potential complications. This has worked well, especially if patients have high deductibles that have not been met.
 
I no longer write for terbinafine on the initial visit. When I do, I tell patients that they should not fill my pulse dosed prescriptions for 20 tablets until they question their MDs and together decide if liver testing is indicated. The referenced article defends the rational of my updated program. Onychodystrophy (ugly toenails) is 40% or more uninvolved with infection (-biopsy). Positive cultures can reflect the existence of a symbiotic fungal microbiome within nails that is not virulent or causing infection. My call for action that is cost-effective for patients is to bust the myth that killing fungus on toenails is the panacea for onychodystrophy.
