Maasi J. Smith, DPM has been appointed Adjunct Instructor at the Temple University School of Podiatric Medicine. Currently, Dr. Smith serves as the Chief of Podiatry for Urban Health Initiatives. In addition, he is a medical contributor to Fox 29's Good Day Philadelphia show and the Ten O' Clock News

For FL Podiatrist, It's a Generational Thing
 
Dr. Michael Katz gets a kick out of his daughter, Dr. Stephanie Lirio, practicing medicine at Venice Regional Medical Center. He likes to talk about the time he ran into a chatty nurse on the fourth floor. "She says, 'Oh, yeah, you're Dr. Lirio's father,'" Katz says, his voice rising in mock indignation. "I'm like, excuse me — I've been here 35 years, and now I'm Dr. Lirio's father?"

Father and daughter have different practices — Katz, 63, is a podiatrist; Lirio, 40, is a psychiatrist — but both work from the same office building near the hospital. In his Venice office, Dr. Katz keeps an old doctor's bag, a black satchel, that once belonged to his father, who was a Philadelphia physician. There's a bulletin board with photos of his children when they were younger. One shows his daughter Stephanie with a particularly poofy teen hairstyle. Now she's Dr. Lirio with her own office downstairs.

Taking the EHR Penalty: More Doc Offices May Opt Out
 
Despite the federal government giving extra time to healthcare providers to stay at the next stage of electronic health record meaningful use, health information technology leaders worry that the number of physician offices opting to bag the whole program will continue to grow.
 
The concern comes from two fronts: cost and clinical. The penalties for failing to meet Stage 2 of the meaningful-use requirements that were attached to taking federal incentive payments for adopting EHRs are minimal. Moreover, most of the incentive payment money was linked to achieving Stage 1 meaningful use, which, for a majority of providers, is already in the rearview mirror. There's not much financial upside from continuing to participate in the program.

As a very early adopter of electronic health records (beginning my 9th year soon, and beginning my 4th year of data collection for the meaningful use incentive program), I am keenly aware that the government is looking for any way to recoup the money that they have paid out to eligible providers, and one way is not having "buttoned up" Core Criteria #15.

The key to passing an audit for core measure 15 is to make sure your Risk Analysis report details the critical elements that the auditors are looking for. Many practices try to use survey-based audit templates, but they almost always come up short. The other problem with survey type audits is that they are only as accurate as the information you provide them. In the event that you have an on-site audit and what is documented in your Risk Analysis does not match what the auditor finds, you will have a problem.
 
The other thing to watch for is the “me too” IT companies. Now that the audits are flowing, we are seeing “experts” coming out of the woodwork. They will razzle dazzle you with network scanners and all sorts of IT wiz bang tricks, but the bottom line is that most don’t know or understand the HIPAA Security regulations.
 
You want a real expert with many years of both IT and HIPAA experience, someone who has been through dozens of audits and knows how to handle auditors. If your goal is to find the cheapest solution, my advice is return the stimulus you have received and withdraw from the program. If you want a credible compliance effort with a very high degree of success, then select a professional with the credentials to do the work professionally.

Let us not be too hasty in assuming that any field of medicine has totally embraced evidence-based medicine. Two weeks ago, the New York Times did an expose' on the front page of its Sunday issue, along with an editorial in a subsequent issue where it showed that general practitioners along with psychiatrists are being duped into over-prescribing medications for the treatment of attention deficit disorders in both adults and children. The article and editorial implied that even recognized medical journals might be subject to bias in printing papers positive toward prescribing these often dangerous medications because they accept massive amounts of advertising dollars from the same corporations. 
 
Is this true across the board? Hopefully not, but if corporations sponsor research that yields results that are only positive toward their products and they use financial manipulation to ensure that only articles supportive of their products are published, the data that we think is evidence is really tainted and misleading.
