WA Podiatrist Keeps Navy and Marine Corps on their Feet
 
When it comes to healing heels, such feats for the feet are the specialty of Naval Hospital Bremerton’s (NHB) foot doctor. Lt. Edee Renier, DPM, staff podiatrist assigned to NHB’s Orthopedic department, is helping Navy and Marine Corps personnel keep operational ready and able to stand on their own two feet. “Foot care is critical,” said Renier, citing that the anatomy of everyone’s feet is as intricate as are the foot issues and injuries which many people experience.

Dr. Renier says, “The military is a high demand workplace. Your feet carry you everywhere your orders demand. When your feet are hurting, it limits your ability to serve to the fullest capacity. If every step hurts you, you can’t take a step forward. If you feel like you can’t trust your ankle to carry you, how can others trust you to carry your team forward?"

Humana Used AI Tool from UnitedHealth to Deny Medicare Advantage Claims: Lawsuit 
 
Humana used an artificial intelligence tool owned by UnitedHealth Group to wrongfully deny Medicare Advantage members' medical claims, according to a class-action complaint filed Dec. 12. The lawsuit was filed in the U.S. District Court for the Western District of Kentucky and is the latest legal action against major insurers such as UnitedHealthcare and Cigna for allegedly using automated data tools to wrongfully deny members' claims.
 
The complaint against Humana, the country's second-largest Medicare Advantage insurer, accuses the company of using an AI tool called nH Predict to determine how long a patient will need to remain in post-acute care and overrides physicians' determinations for the patient. The plaintiffs claim Humana set a goal to keep post-acute facility stay lengths for MA members within 1% of nH Predict's estimations. Employees who deviate from the algorithm's estimates are "disciplined and terminated, regardless of whether a patient requires more care," the lawsuit alleges. When decisions made by the algorithm are appealed, they are allegedly overturned 90% of the time.

CMS Finalizes Updated Fees for No Surprises Act Dispute Resolution 
 
The Biden administration on Monday released amended fees related to independent dispute resolution under the No Surprises Act. The Centers for Medicare & Medicaid Services had established initial fees, but the guidance was vacated by a Texas judge in a win for providers, forcing the agency to pause IDR. The independent dispute resolution approach is meant to resolve disagreements over out-of-network charges that payers and providers are unable to settle themselves.
 
Should a payer and provider be unable to reach an agreement within 30 days, the dispute will be sent to arbitration. CMS said that it needed to increase fees associated with this process from $50 to $350 to cover expenses. In the amended final rule, CMS said it will instead set an administrative fee of $115 for disputes that are subject to the rule. A separate rule, which is up for comment until Jan. 2, adjusts the fees for disputes initiated after Jan. 1, 2025.

Response: The HCPCS Level II code for Depo Medrol 80mg/ml is J1040 which is defined as the following: Injection, methylprednisolone acetate, 80mg.
 
Since 1 cubic centimeter (cc) is synonymous with 1 milliliter (ml), either one will equal 1 unit of Depo Medrol. Taking this one step further, if an amount less than 1 cc/1 ml up to 1 cc/1 ml is injected, it will still be billed as 1 unit.

I sold a part-time podiatric practice about a year ago with a similar scenario with the exception of I still used paper charts. Because I was subletting space from a doctor one day a week, chart storage was a problem. The sales agreement specified that I would safely store the charts and forward any patient information requested by the purchasing podiatrist. The doctor was completely agreeable to this.
 
The valuation was not affected by this agreement. Obviously, all other patient information and demographics were included in the sale. I do question the hesitation of the seller to relinquish their patients’ charts when it is basically an electronic file or document. If I were the purchasing podiatrist, I would consider this a potential red flag.

Steve, as you and the readers of this forum know, nobody’s as hard on the establishment than me. At least monthly, I log onto the APMA E advocacy site and send letters to all my congressional leaders on many of the topics that APMA suggests. I have never seen a result of these form letters, but I guess APMA does (or I hope they would not pay for this service). It would be nice to see a report of how many others do this. 
 
Barry provides this incredible forum where each of us can share our opinions. But over the last few years, I believe there’s only 20 to 30 people who have regularly written on this forum. I often received 30 to 40 emails/text messages after I post something, and when I encourage each of these people to write directly, so that their opinion can be included in the discussion, they all refrain from wanting to get involved.
 
Fortunately, we have a few great leaders. Paul, Elliot, Allen, Steven, Keith, Robert, Bryan, Joel, Jim, Michael, Richard, Ivar, and I’m sure a few more who will join me and write what we’re all thinking. For most of the 1970s, I was either a podiatry student in Ohio or a resident in Philadelphia. There was a television advertisement for a financial company called E.F. Hutton where a broker spoke to a client who was sitting next to him in a filled Yankee Stadium. As the broker talked investments to his client, the stadium suddenly went silent and the narrator simply said, “When E.F. Hutton talks, people listen.” The information the broker was giving his client was so important it could silence Yankee Stadium. The concept was an admitted hyperbole, but clever, nonetheless.
 
I was lucky enough to have had both Allen Jacobs, one of my trainers, and Jim Ganley speak to me, and I listened. Both educators spoke to the “why” of facts being transferred from teacher to students in such a way that the “why” could be answered at least three times. Parents know the frustration of trying to answer a child’s...

I agree with Dr. Gurnick, who I totally respect as a true professional representing our profession, that “properly” made orthotics can be life changing. I prescribe a fair number of orthotics from my office and the interesting thing is that if done properly the patients will be your biggest advocate for your practice.
 
I was recently told by the orthotic lab that I prescribe more second and third pairs than the original number of orthotics I prescribed. That means one thing... if done well, patients love what orthotics do for them to the point that they come back and often request additional pairs. 
 
Orthotics have become an annuity at my office with me just taking orders for additional pairs without doing any extra work. I say thank God for orthotics and what they can do for our practice and our patients. I wholeheartedly recommend that those NOT prescribing learn to make orthotics properly to help their patients and themselves with this annuity.
