PODIATRISTS IN THE COMMUNITY
Church Playground Named in Memory of IA Podiatrist

St. Kevork Church of Houston, Texas, marked the 40th anniversary of its Armenian School with services and a festive program. Archbishop Khajag Barsamian, Primate of the Diocese of the Armenian Church of America (Eastern), celebrated the Divine Liturgy, with the Rev. Fr. Martiros Hakobyan, parish pastor, assisting.

Dr. Shahan Vartivarian

Following services, parishioners gathered outside for the dedication of a new playground on church grounds. The playground was built in memory of the late Dr. Shahan Vartivarian, a young podiatrist and former St. Kevork Church parishioner who passed away last March.

INTERNATIONAL PODIATRISTS IN THE NEWS
Barefoot Pilgrimages Especially Dangerous for Diabetics: Indian Podiatrist

Of the 62 million diabetics in India, 25 percent develop sores, ulcers, and life-threatening infections on their feet at some point during their lifetime. On any given day, the Fortis CDOC Centre of Excellence for Diabetes, Obesity, Metabolic Diseases & Endocrinology in Delhi, is filled with patients troubled by a single affliction: diabetic feet. Dr. Amar Pal Singh Suri, podiatrist with CDOC, was busy with a 54-year-old patient at the wound management unit. The businessman had gone on a pilgrimage and returned with an ulcer on his right heel after walking up 4,000 stone steps barefoot in the height of summer. High-frequency vibrations on his feet have revealed a complete lack of sensation.

Dr. Amar Pal Singh Suri

Dr. Suri debrided the foot: cleaning it out, pulling out the bad tissues, packing it with antimicrobial gauze, attaching a vacuum to suck the pus out. The angry looking hole will be allowed to heal from inside. Despite the poking, the patient lies with a tranquil expression. "Patients suffer nerve damage due to diabetes and don't feel the pain," says Dr. Suri.

PODIATRISTS AND THE LAW
FL Podiatrist Murder Case Moves Ahead

Five weeks after Dr. Adam Frasch was indicted by a Leon County grand jury in the killing of his French model wife, a case management hearing will be held Tuesday to begin charting the course for his capital murder trial. The procedural hearing will be held before Circuit Judge Frank Sheffield, who has been assigned to preside over the case. Last month, the state filed notice that it intends to seek the death penalty in the case. The Thomasville, GA podiatrist — who also is being investigated by the federal government for Medicare fraud — contends he is innocent.

STATE PODIATRY NEWS
OK Legislature Significantly Expands Peer Review Privilege to Include Podiatrists

Oklahoma’s peer review statute provides that peer review information is private, confidential, and privileged. It encourages healthcare professionals to police themselves by evaluating their peers. It also promotes the continuous assessment and improvement of care provided so that patients and healthcare professionals can benefit. Effective November 1, 2014, the statutory protection was extended to cover peer review information generated during the course of a peer review process conducted by a “health care entity.”

A health care entity includes, in addition to licensed hospitals, ambulatory surgical centers, and clinical practices of accredited state medical schools, any entity directly involved in the delivery of health care services that engages in a credentialing or peer review process. Consequently, physician group practices, medical clinics, podiatrists, and others may take advantage of the peer review protection that was previously limited to hospitals, ambulatory surgery centers, and clinical practices of medical schools.

QUERIES (MEDICAL-LEGAL)
Query: Medical Liability and Arbitration

I recently made an appointment to see an orthopedic surgeon at a prominent medical institution in the Midwest. When I received the new patient paperwork, an arbitration document was included in the packet for me to sign. It basically stated that if I felt dissatisfied in the care I received and I was considering a medical liability claim, I could arbitrate the matter with the institution where the care was provided instead of a seeking legal counsel.

Does anyone know about pre-emptively protecting yourself as a physician from a medical liability situation by having your patient sign an arbitration agreement prior to obtaining medical/surgical care? If this is law by each state, I would like to know. The arbitration agreement of which I speak is here for your perusal.

Joseph Borreggine, DPM, Charleston, IL

Editor's comment: PM News does not provide legal advice. The main problem with arbitration agreements is that most courts do not accept them.

CODINGLINE CORNER
Query:  Correct Billing of Treatment of Nail Trauma

How would I bill repair of a laceration of the nail bed of the right hallux that I closed with 7 sutures? There was damage to the nail.

Craig Sapenoff, DPM, West Palm Beach, FL

Responses: Laceration coding is typically found in the "repair" sections of CPT. However, for a laceration involving the nail bed, if you look in the "integumentary" section of CPT under nail codes, you will find CPT 11760 - repair of nail bed which describes your treatment of nail bed trauma. It would also include the avulsion of the nail if necessary.

Tony Poggio, DPM, Alameda, CA

To add to Dr. Poggio's post, the ICD-9 code, presuming the presenting condition is primarily the laceration, would be ICD-9 893.0 - open wound of toe(s) (includes: toenail); without mention of complication. Of course, there may be additional ICD-9 codes depending on whether there are complications or a contusion, toe (including toenail) (ICD-9 924.3).

RESPONSES/COMMENTS (NON-CLINICAL)
RE: Foot Detoxification and Detox Baths
From: Michael Lawrence, DPM

We seem to be experiencing another assault by the "foot detoxifyers" in our community. Large ads are appearing in the newspaper selling the detox pads, endorsed by some "Dr."  with oh so many credits and letters behind his name. I am happy to say that, as of yet, "DPM" wasn't one of the degrees. Then, there are the "foot detox baths" being promoted by some chiropractors. It seems like reflexology just wasn't enough of a ripoff. My question is: how do others approach these things to inform and educate the public about these unscientific and useless treatments?

RESPONSES/COMMENTS (NON-CLINICAL)
From: Brian Kiel, DPM

Dr. Smith, the point is that the chair was messed up by the doctor who did not know what he was doing, and he then wanted information from other non-trained individuals to give him a way to fix it without any idea of what was really wrong. In your case, you did not "fix" the problem, you bypassed it. By the way, a great number of the public thinks that we are over-priced as well. I am not saying don't try to fix it, but if you screw it up,  it's time to call in a professional.
