Terrorism Law Now Applies to AZ Schools After AZCPM Dean Threatened
A legal loophole has been closed in Arizona and it may keep students and teachers safer while holding potential school shooters accountable. Prosecutors and higher education leaders noticed the legal blind spot after the August 2021 arrest of Tony Tran. Tran, a podiatry school student, was arrested after he sent a video to his sibling, telling her he was going to shoot up Midwestern University at a meeting with Jeffrey Jensen, DPM, the Dean of Midwestern University's College of Podiatric Medicine (AZCPM), the next morning.

"Tony had intent to kill, he had a plan. And if given the opportunity, he would have carried it out. I wouldn't be here before you today," said Dr. Jensen at Tran's sentencing in late November. The Midwestern community though is still reeling from the incident. "In the aftermath of his arrest, our staff and faculty went into counseling. Students have been stressed and always questioning his current status as they are fearful of him," said Dean Jensen at sentencing. "I've lost a staff member who quit after these events. Multiple faculty have experienced PTSD symptoms."

RESIDENCY NEWS |
BIDMC Residency Turns 50
On July 1st, 1972, Robert Levine, DPM became the first resident of the newly created podiatric surgical program at the New England Deaconess Hospital. While the name has changed several times over the past 50 years, the program, now called the Beth Israel Deaconess Medical Center, is now celebrating 50 years of continuous education and training of podiatric physicians and surgeons. Originally, a 2-year program, in 1986 it transitioned to a 3-year surgical program.

It has trained over 80 physicians and surgeons, many of whom have gone on to leadership positions including state society presidents, residency directors, and 3 ACFAS presidents. Many giants in medicine and surgery were also affiliated with the program, such as Drs. Elliot Joslin, Frank Wheelock, Gary Gibbons, Robert Moellelring, and A.W. Karchmer. Today, the BIDMC residency program continues to be one of the most sought after residency programs in the country.

Query: Routine Foot Care and Heel Pain
I saw an established patient who returned to the office for routine foot care. The patient also had a new complaint of heel pain. I obtained x-rays of the foot and gave a steroid injection in the heel. Can I bill for the routine foot care and those treatments as well?

Response: Absolutely. Routine foot care does not prevent you from rendering other services that are medically necessary and reasonable. For the E/M service, make sure you appended it with a -25 modifier and check the CCI edits to make sure you do not have to add a -59 modifier to separate out the services you rendered. Bill for what you did and make sure you document those services completely.

Putting aside the very sad issue of a podiatry practice that billed Medicare Advantage Plans fraudulently, and their CEO is now sentenced to prison, there is a vast difference between fraudulent actions administered by various corporate actors when compared to individuals, group practices, and smaller entities.
Prosecutors are not interested in jailing CEOs of large corporations (especially insurance companies) for even proven fraudulent activities. Instead, their efforts are placed into fines and attempts to recoup funds. Even those are usually negotiated out by corporate attorneys and are relatively minor. Only rarely are the insurance companies shut down. My wife and I had a long-term care policy with a...

While in practice, I rarely performed bilateral foot surgery. This was long before the 50% reduction in payment. I can’t blame my colleagues for not wanting to perform more procedures at 50%, when 100% is already far from fair compensation. However, my philosophy of performing surgery on one foot at a time was done because I wanted patients to have the ability to place weight on the opposite extremity and avoid balancing and other cardiovascular loads that I knew patients, especially elderly patients could not handle if performed bilaterally.
Unilateral surgery would be a challenge enough for most. Why on earth would one wish to place a patient into a greater risk category? Patients often do not know what is best for them and...
