| PRACTICE MANAGEMENT TIP OF THE DAY |
Beware of These Malpractice Landmines
EHRs are increasingly leading to malpractice lawsuits. While EHR-related lawsuits still make up only a small number of lawsuits, user error is the cause of 64 percent of EHR-related malpractice claims, according to the Doctors Company. Practices need to focus on eliminating several common problems, mostly tied to user actions, which have led to the majority of EHR-related suits.
1. Copy & Paste
Many doctors are tempted to copy a note from a prior encounter and make changes as appropriate. This leads to a few potential problems. Sometimes physicians forget to update the note with the appropriate changes when copying and pasting, says David Troxel, MD, medical director and secretary of the Doctor’s Company board of governors.

RE: The Passing of Kelly Powers, DPM
Fox News commentator and doctor Kelly Powers has died after a long battle with cancer. She was 45. Dr. Powers was first diagnosed with brain cancer after facing a series of health complications in 2020, and went into remission before the deadly illness returned this year. She was a regular on the Fox News talk show Red Eye, and made appearances on Fox Business where she led segments on health risks facing Americans.

But her career in journalism was ancillary to her true passion in medicine. A successful podiatric surgeon, Powers was educated at the New York College of Podiatric Medicine and did her residency at the Boston University School of Medicine.

| QUERIES (CLINICAL) | |
Query: Treatment of Onychomycotic Onycholysis
Below is a photo of a toenail which is no longer centrally attached to the nail bed. The nail is arched away from the nail bed. Under the arch there is nail fungus growing on the nail bed. I was wondering if any colleagues have any “pearls” in successfully treating this condition in order to bring back a normal toenail.
|
|
Onychomycotic Onycholysis |
I realize removal of the toenail and allowing it to regrow may be an option. My concern there is causing a case of “disappearing toenail syndrome” which some may find more unsightly than the current state this toenail is in.

| RESPONSES/COMMENTS (GUEST EDITORIALS) | |
From: Allen M. Jacobs, DPM
Hereclitus, the late 6th century BCE philosopher, stated "you cannot step into the same river twice". Bob Dylan famously sang "The times they-are-a changing". Indeed, the flowing river of modern society and medicine are rapidly changing. Dr. Tomczak notes in his recent communication in PM News that it is more likely than not that yesterday's solutions and answers may not be serving the podiatric profession and the public that it is intended to serve, well in the future. A change in the board certification process should be seriously considered.
Dr. Tomczak references the results of two PM News weekly polls. He states that the majority of the profession favors a one-board solution to podiatry board certification. He also notes (as did I with apparent equal surprise) that a recent PM News poll suggests that podiatrists view foot care nurses as the greatest potential "threat" to...

| RESPONSES/COMMENTS (EMR) | |
From: Kenneth Meisler, DPM
I agree with Dr. Musella that you should NOT scan your paper records when switching over to an EMR system. I switched from paper charts and traditional x-ray film to an EMR program and digital x-rays about 17 years ago at the same time. At the time, I had already been in practice for more than 30 years and our office had 30-40 thousand patients we had seen and many active patients. We did NOT scan any of our charts or x-rays. We kept all of our existing charts in the office.
If a patient came, in most of the time, we did not have to pull out their old chart or x-rays. In some cases, we did have to go back to old notes or x-rays but it was not often. We kept all of the charts and x-rays for the legal period and eventually destroyed them. Any x-rays that we felt we wanted a copy of, we took a digital photograph of and stored it by the patient's chart number in a file.
Kenneth Meisler, DPM, NY, NY
