FL Podiatrist Discusses Heart Rate Training in Zone 2
In Tuesday’s episode of Run for Fun, Leigh Spann and Coach Maria talked with Brian Fullem, DPM, a sports podiatrist and running coach. He trains many of his clients to stay in “Zone 2” heart rate range. If you’re sitting relatively still, your heart rate will be in Zone 1, and during all-out, high-intensity exercise, it may reach Zone 6. By staying in Zone 2, your body can use fat for energy during exercise. Doing this low-intensity type exercise or a slower run helps build endurance or aerobic capacity, and you are less likely to have injuries due to overuse.

By building up your endurance with these slower runs, you will eventually be able to spend more time in those higher zones. Meaning if you spend more time in Zone 2, on days you want to go fast, like in a race, you’ll be able to hold that higher speed and higher intensity longer. Coach Maria and Dr. Fullem explained why it’s important to only spend 20% of your runs in higher heart rate zones if you want to keep running and exercise as part of your healthy lifestyle for years to come.

Diabetes One of the Leading Causes of Death: Bahamian Podiatrist
In The Bahamas, there are approximately 46,400 or 11.6 percent of the population living with diabetes and an additional 27,200 or 6.8 percent with pre-diabetes, according to podiatrist Monique Mitchell, DPM, MPH. The doctor said diabetes remains one of the top leading causes of death and disability in The Bahamas.

“The 2019 STEPS survey also tells us that most, or 55.3 percent of persons diagnosed with diabetes do not take their medication regularly. This is of grave concern, because we know uncontrolled diabetes often results in devastating complications such as blindness, kidney failure, amputations, and early death, says Dr. Mitchell.”

Barefoot Shoes are Not for Everyone: FL Podiatrist
Barefoot shoes are not for everyone's foot type. In a July 2023 interview with Green Matters, Jodi R. Schoenhaus, DPM of Florida's Foot, Ankle & Leg Vein Center explained, "In a normal or a rectus foot type, walking barefoot allows the small muscles of the foot to become stronger and our feet can 'breathe.'” However, Dr. Schoenhaus then explained that the majority of people do have a normal foot type, meaning that barefoot shoes could cause problems.

“People who have flat feet or high arch feet can develop problems as they age. Walking barefoot leads to more strain and impact on the muscles and joints, causing tendinitis, arthritis, and deformity,” Dr. Schoenhaus told Green Matters. Given this, despite the possible benefits of barefoot shoes, it’s not a bad idea to make a visit to the podiatrist before you buy a pair of barefoot shoes, to make sure they won’t do more harm than good.

Healthcare Fraud and Abuse Control Program Annual Report Released
In Fiscal Year (FY) 2022, the Department of Justice (DOJ) opened more than 809 new criminal healthcare fraud investigations. Federal prosecutors filed criminal charges in over 419 cases involving at least 680 defendants. More than 477 defendants were convicted of healthcare fraud related crimes during the year. Also, in FY 2022, DOJ opened more than 774 new civil healthcarefraud investigations and had over 1,288 civil healthcare fraud matters pending at the end of the fiscal year.
Federal Bureau of Investigation (FBI) investigative efforts resulted in over 499 operational disruptions of criminal fraud organizations and the dismantlement of the criminal hierarchy of more than 132 healthcare fraud criminal enterprises. In FY 2022, investigations conducted by HHS’s Office of Inspector General (HHS-OIG) resulted in 661 criminal actions against individuals or entities that engaged in crimes related to Medicare and Medicaid, and 726 civil actions, which include false claims, unjust-enrichment lawsuits filed in Federal district court, and civil monetary penalty (CMP) settlements. HHS-OIG excluded 2,332 individuals and entities from participation in Medicare, Medicaid, and other Federal healthcare programs.

5 Ways to Retain Great Physicians
Healthcare organizations invest significant time, energy, and money into hiring physicians. But according to Douglas Farrago, MD, the author of The Hospital Guide to Physician Retention, very few invest adequate resources into keeping physicians. Here are some steps to take.
5. Create a sense of community
Douglas Farrago notes that studies show that physician retention is improved when doctors feel that they are part of a community, which has become increasingly difficult as doctors are siloed and isolated from each other in daily practice. Organizations can create a sense of community by creating physician-only spaces, like the traditional doctors’ lounge, which Farrago believes should be exclusively for physicians. “Non-physicians can have their own space, but doctors need a place where they can talk to each other.” In addition, organizations can help create community by providing meeting opportunities offsite and by encouraging physician membership in local county medical societies, including funding membership dues.

Query: CMS Overpayment Request
I just received a request from CMS for an overpayment that occurred in 2019. Apparently the overpayment occurred for nursing home patients, using CPT 11721. The claims in question were paid at a level of in-office, not nursing home. No records were requested. Do I simply pay the overpayment back or request my malpractice carrier provide legal counsel? Also the claims are 4 years old. What is my recourse?

Response: There are several issues here with this investigation and recoupment. If you were billing place of service (POS) 11 (office) instead of POS 31/32, then you did in fact bill incorrectly and depending on how the authorities view this, your billing was abusive or fraudulent. In this case, you will likely need to refund the entire amount and good luck trying to correct the POS and collect anything. This is especially true if the date of service (DOS) is more than 12 months ago.
As for billing POS 31 instead of POS 32, that is a whole other matter. It appears that many doctors billed the POS 31 because the Common Work File (CWF) told them the patient was in a Part A stay (POS=31 instead of a Nursing Home Long Term Care 32). The beds in these facilities are often interchangeable and more dependent on the patient’s stay. The costs of providing the care are equivalent, so why does CMS make a distinction to begin with?
Going back more than 6 years, it appears that the CWF was corrupt and mistaken, providing incorrect information. Should the providers be forced to refund the entire amount because the CWF was corrupt and they committed no abusive or billing action and then have to be paid the correct lower amount? The rational person would say no and simply refund the difference. However, CMS often is illogical and has no common sense. CMS and Social Security are the ones which committed the fraud here and their officials should be held accountable. This does not only affect DPMs, it affects every different type of healthcare provider, and the amounts attempting to be recouped by CMS are staggering. The amount for many physicians with SNF/Nursing Home based practices can be hundreds of thousands of dollars.
