ASFP Presents Dr. Bryan Kagan Scholarship Award
Recently, the American Society of Forensic Podiatry (ASFP) has awarded Temple University School of Podiatric Medicine (TUSPM) student Raisa Roberto the Bryan Kagan, DPM Scholarship Award for her interest and dedication to the field of forensic science. She presented a poster at this year’s International Association for Identification (IAI) conference in National Harbor, Maryland.

This award was established to honor the memory of Dr. Kagan who was instrumental in championing forensic podiatry. He was an adjunct instructor of forensic podiatry at the New York College of Podiatric Medicine and the forensic club advisor. Bryan was a member of the IAI Forensic Podiatry Science and Practice Subcommittee, a member of the Chartered Society of Forensic Sciences, and an associate member of the American Bar Association. He had a private practice in White Plains, NY and was on staff at White Plains Hospital.

8 Tips for Medical Malpractice Defense
Although no physician can manage all the possible risks that lead to malpractice lawsuits, best practices include making sure you have the best insurance policy, working on patient-communication strategies, and following the right steps if a lawsuit is filed. Check out these medical malpractice best practices.
7. Get a lawyer Immediately - The first thing to do is call your insurance carrier and insist on speaking to a lawyer immediately, while everything is still fresh, Tom Benvenuto, a senior trial attornev with Benvenuto & Slattery in Roslyn, New York said. The worst thing a physician can do is to try to ignore it or put it off. The quicker a physician meets with a lawyer, the better, Benvenuto noted.
Benvenuto said that the right lawyer will get back to the physician right away. "If you find an attorney who won't take your call, get another attorney."

Query: Using Fracture Care Codes
I had a patient referred to me from an urgent care for an avulsion fracture of the proximal phalanx of the right hallux. It was minimally displaced and I treated her conservatively. I dispensed a hallux valgus splint to stabilize the fracture.
My billing included the following:
Diagnosis code: S92411D
Treatment codes: CPT 99203, CPT 28510 and L3100
The patient called her insurance company because she was surprised by the size of the bill and the use of a “surgery code.” The insurance representative told the patient that I should not have charged CPT 28510. Obviously, she called me to voice her displeasure with the financial side of this encounter. I have always charged for the management of the fracture with a 90-day global. Am I right or wrong in coding the CPT 28510?

Response: This is often a conundrum for providers as to when and where to use fracture coding versus visit coding. I think you are most accurate, but for the initial visit being added. I am a strong advocate for the use of the initial outpatient visit code, but the fracture care actually includes the initial visit and the treatment, with the exception of such codes as the L code you used. The insurance representative appears to have no real knowledge of coding and was trying to appease the subscriber, in my opinion. Many will bill these visits on a visit by visit basis and some will argue that is right, others not. I think you did bill properly and I would fight for the 28510 and L code; but you may have to fold on the CPT 99203 based on what is considered included in the fracture care.

RE: AMA Comments on Medicare Payment Cuts

Every week I read about another union generating 26% pay increases, Southwest airlines, 25% pay increases, General Motors, etc. Where the heck are the leaders in medicine? Have they all sold out to the Part A Medicare providers? No hospital would be willing to accept these pay cuts year after year. I thought podiatry had a union? I thought we had national leaders?
Why has a consortium among the AMA, the AOA, APMA, etc. not gotten together and lobbied Congress to stop this unsustainable continuation? It seems like we have plenty of money to send to other countries. Maybe we need to start thinking healthcare in the USA is a priority. I’ve been preaching this for 20 years.
