OH Congressional Fundraiser Hosted  BBQ, Hot Apple Cider, and a Bonfire

Dr. Bruce Blank, Dr. Jobeth Rollandini, and Belmont County GOP Chairman Kent Moore hosted a Congressional cookout fundraiser for Representative Bill Johnson (R-OH 6th District) at the office of Achilles Foot and Ankle Surgery, PC, on historic National Road in St. Clairsville, Ohio. The cookout served BBQ ribs, chicken, and hot apple cider under a tented dining-area. Following dinner, Congressman Johnson addressed the crowd of about 50 attendees beside a glowing bonfire in the brisk autumn evening air.

(L-R) : Drs. Kevin Schroeder, Barb Hagey, Alan Block, Congressman Bill Johnson, Drs. Bruce Blank, and Jobeth Rollandini. Also attending was Dr. Jimelle Rumberg, OHFAMA executive director.

Congressman Bill Johnson, who sits on the Committee on Energy and Commerce and the Committee on Science, Space, and Technology in the United States House of Representatives, represents Ohio’s 6th Congressional District. He is a co-sponsor of the HELLPP Act (HR1761/S 1318).

PODIATRISTS IN THE COMMUNITY
TX Podiatrist Funds Foot-Themed Art Bench

This past Thursday, The Woodlands Waterway Arts Council revealed eight works of art that aren't just for looks, but pieces that visitors can enjoy and even sit a spell. The first bench to be revealed was “Foot Rest,” created by artist and The Woodlands resident Rod Flower. Just outside P.F. Chang’s, the bench was funded by Dr. Robert Neville of Neville Foot and Ankle Centers.

“I wanted a place where people could sit and take a load off their feet,” the podiatrist said. Neville and his wife were happy with Flower’s creation, a bright yellow bench covered with colorful feet. The project, advertised on the WWAC website, invited artists to send in ideas for benches that would go best in the eight chosen locations. They were given free artistic range, as long as the bench was functional. Two benches were already given a theme: The Pavilion would feature music, and Dr. Neville’s bench would involve feet.

PODIATRISTS AND THE LAW
FL Podiatrist Likely to be Found Mentally Fit to Face Charges

Dr. Adam Frasch is expected to be deemed mentally fit at a court hearing Friday, allowing him to proceed in his defense against charges he violated child custody orders earlier this year when he took his daughters from the Golden Eagle home of his wife hours before she was found dead in the backyard pool. Frasch, a Thomasville podiatrist, was found in August to be mentally incompetent, halting his child-custody case. The question of his mental state also postponed prosecutors from asking a grand jury to consider a first-degree murder indictment against Frasch for the killing of his wife, Samira. If found competent, Chief Assistant State Attorney Georgia Cappleman said she hopes the Frasch case will be presented to the grand jury early next month.

INTERNATIONAL PODIATRISTS AND PROFESSIONAL DISCIPLINE
Aussie Podiatrist Defends Claims After Unsatisfactory Conduct Finding

Podiatric surgeon Paul Bours has “vigorously defended” the claims and said the case brought against him by the Health Complaints Commission was a “witch hunt” because they preferred traditional orthopedic surgeons over the more groundbreaking surgical methods of podiatric surgeons using minimally invasive surgery. The Civil And Administrative Tribunal has this week found Dr. Bours guilty of unsatisfactory professional conduct, finding that he had failed to warn patients of potential risks and complications of foot surgery and failed to obtain informed consent. Bours has been working under conditions imposed by the Podiatry Council. The CAAT will meet on October 23 to decide on future orders.

QUERIES (MEDICAL-LEGAL)
Query: Disclosure About HIV+ Status to Health Department

I operated on a patient admitted to the hospital. During the post-operative course, he developed a fever of unknown origin. We discovered he was HIV+. There were no breaks in surgery and all techs were notified, so that was not an issue. He was re-admitted to the hospital 6 weeks after the procedure for IV antibiotics for an infection and complications of the procedure. We never discussed his status openly, but the infectious disease specialist mentioned his status to the patient's wife, which he had NEVER disclosed to her or any hospital personnel. It turns out that the patient has known this for at least two years. Morality issues aside, are we required to notify the health department of this?

Name Withheld

Editor's Comment: PM News does not provide legal advice. Some states have laws that require clinic staff to notify a “third party” if they know that person has a significant risk for exposure to HIV from a patient the staff member knows is infected with HIV. This is called duty to warn. The Ryan White HIV/AIDS Program requires that health departments receiving money from the Ryan White program show “good faith” efforts to notify the marriage partners of a patient with HIV/AIDS.

RESPONSES/COMMENTS (OBITUARIES)
RE: The Passing of Jeffrey Bowman, DPM, MS
From: Martin Sloan, DPM, David J. Dragoo, Jr., DPM

It is so sad to hear of Dr. Bowman's passing. I had the privilege of working side by side with him on the state and national level. He demonstrated a level of professionalism and dedication to our profession at all times that is seldom seen. He was one of those among us who set the bar higher and he will be sorely missed. RIP, my friend.

Martin Sloan, DPM, Rockwall, TX

I am saddened to hear of the loss of my classmate Dr. Jeffrey Bowman; it is hard to believe that 31 years have passed since we graduated. My heartfelt sympathies to those he left behind.

RESPONSES/COMMENTS (JURY VERDICT REPORTER)
From: Steven J. Kaniadakis, DPM

A necrotic flap can be a bad result of this adjacent procedure. A properly placed single incision can gain access to both spaces. Sometimes the condition clinically appears in the adjacent space in a flat foot.

It seems likely from my reading of the responses that this case was another example of frivolous law suits. A "bad result" is not med-mal from my recollection of risk management. It was my practice and routine to cross-reference the written formal informed consent in progress notes as well, adding for the record that the patient had no other unanswered further questions or concerns.

The federal government states that “A single device that accurately monitors body weight, posture allocation, physical activity (i.e. movement), and energy expenditure would be an extremely useful tool for weight management.” Eating less food will accomplish the same thing, and cost less than 2 million dollars.
