Negotiating and reviewing contracts are among the more unnerving tasks physicians face. That’s good! Your subconscious is sending you “danger” signals. You simply need to channel this emotion into action to protect yourself.
 
5. Beware of lockout provisions. When you sign a contract for billing and EHR systems, in a very real sense, the vendor controls your access to the life blood of your practice. Many software service (SaaS) agreements often allow for a “lockout” if you don’t pay, for any reason. You must make sure that you have a right to your data in a usable form no matter why the contract is terminated.

I would like to address the “malpractice issues” brought up by Dr. Forman regarding requests to trim fingernails. Most malpractice insurance policies cover the procedures that are specified in the Podiatrist Practice Act of any particular state. This of course would be subject to the terms and conditions of the insurance policy including any exclusions for certain procedures that a policy may contain.
 
If a podiatrist is performing a procedure that is outside the scope of practice for their license, it is likely they have no coverage for that under their malpractice insurance policy and could be subject to disciplinary problems as well. Disciplinary defense coverage may also be declined if the issue arises out of a procedure outside the scope of practice for a podiatrist.
 
I suggest to all podiatrists that they should be familiar with the practice act in the states where they practice. They should consult their board and/or attorney if they are considering any procedures that may be outside the scope of their license. I am not an attorney. I am an insurance professional who has worked in the professional liability marketplace for podiatrists for over 18 years and in the general medical malpractice marketplace for over 30 years.

The question posed on PM News is whether or not podiatrists should be allowed to cut fingernails. Most have chimed in that they should be allowed; some admit to doing this already. Those that say you can’t, due to the law, appear to agree that we should be able to. It would seem logical that a profession so deeply rooted in nails be able to treat the nails irrespective of the hand or foot. 
 
Leadership in the profession should duly take note of what and how their constituents feel about these topics. On previous occasions, flu shots and acupuncture have also been brought up. Podiatry as a profession should always look to do what we are trained to do. The fact a manicurist can cut fingernails with no education whatsoever and we can’t is illogical.

Dr. Stuart Bass was part of my Kern Hospital experience that I will never forget. He helped to run the program and the CHRAA annual meeting. He had another job as a security officer at a water park (I am sure, just for fun.). He would invite the residents to the park after it was closed and we had the run of the place. I also remember meals (meetings) at his home. I am grateful and fortunate to have had him as part of my residency experience.

Diabetic Limb Salvage Fellowship

Two positions for a 12-month Diabetic Limb Salvage fellowship beginning July 1, 2019. Candidates must complete a podiatry residency by June 30, 2019 and be eligible for a Texas Podiatric Medical License. Training involves all aspect of diabetic foot management. The UCSF Limb Preservation Fellowship educates the podiatric physician as a clinically skilled podiatrist in a multidisciplinary approach to the diabetic and vascular complications of lower extremities, as well as generating new knowledge in the treatment, management, and prevention of lower extremity amputations.
