OK Podiatrist Weighs in on NBA Basketball Player's Injury
 
Oklahoma City podiatrist  Dr. Jim Ditmars said the Jones fracture in Kevin Durant's right foot could mean a couple of different kinds of breaks, but said that type of injury typically can keep someone laid up even longer than the standard 6 to 8 weeks that is listed for that kind of break. Ditmars doesn't know the details of Durant's injury but said a Jones fracture could mean Durant is off his foot for 6 to 8 weeks but not back to full speed for 3 to 4 months. Ditmars conceded that Durant's healing process will be quicker than most. “They're going to do things to his foot I wouldn't do for my patients,” Ditmars said. “Physical therapy instead of just let 'em heal. They'll be doing all sorts of things, trying to improve and quicken the healing of the bone. It's still, though, two months. Kevin Durant could probably come out and play good right away, but not like midseason form.”

Ditmars said the typical Jones fracture occurs in the fifth metatarsal, the bone behind the little toe, at the base (opposite the end of the toe). Surgery often is required, with hardware placed in the bone to keep it connected. “If there's compression, that's a bad area of the bone, in terms of circulation getting to it to heal it well,” Ditmars said.

A New Venture: The Temple Charcot Center at TUSPM
 
In February of 2014, a new collaboration bringing Temple doctors of varying disciplines together began coming to fruition. Spearheaded by Gabriela Yurkanin, DPM, Associate Professor of podiatric surgery at Temple School of Podiatric Medicine, the Temple Charcot Center was created in order to offer patients excellence in care utilizing a multidisciplinary approach.

With this collaboration of Temple colleagues, Temple Charcot Center has an array of services that range from podiatry, vascular, limb salvage, endocrinology, nutrition, and psychiatry. The Center offers a fully functional clinic specializing in wound care, total contact casting, treatment of complicated soft tissue and bone infections, and finally surgical reconstruction for the recalcitrant and unstable lower extremity.

Arthur Gudeon, DPM, captained his team of 5K walkers, Sue’s Crewsers, at the Lustgarten Foundation Pancreatic Cancer Research Walk this Sunday at Jones Beach, LI, in memory of his wife, Susan, who passed from that dread disease in December, 2012 after a valiant and brave 29-month battle. He, daughter Andrea, and his team raised over $4,500, ALL of which goes towards PC research, because CableVision covers all administrative costs! Dr. Gudeon plans to continue supporting the Lustgarten Foundation until better treatment regimens and a cure are discovered.

Supreme Court Ruling Extends HIPAA Provisions to All Married Couples 
 
Since the U.S. Supreme Court ruled in June 2013 that the portion of the federal law defining “marriage” as a legal union between a man and a woman was unconstitutional, federal agencies have been reviewing their regulations to see which may need to be altered to grant certain rights to married gay couples. Last month, the HHS Office for Civil Rights (OCR) issued guidance clarifying that, as a result of Windsor v. United States, the definition of “marriage,” “family” and “dependent” in the privacy rule was expanded to include same-sex couples who are legally married.
 
Given the ruling on the Defense of Marriage Act, these terms “apply to all individuals who are legally married, whether or not they live or receive services in a jurisdiction that recognizes their marriage,” according to the OCR guidance, which was published on Sept. 17. This expansion is particularly relevant as it means that even states that do not recognize gay marriage must ensure that they honor all HIPAA protections associated with these terms.

Query: Not Meeting Criteria for Diabetic Inserts 
 
We have a pair of orthotics that qualify for diabetic inserts - Medicare allows approximately $56 per pair if the patient qualifies. If the patient is Medicare but does NOT qualify for coverage and wants to pay out-of-pocket, is there any regulation as to what we can charge the patient? I thought that I had seen (many years ago) that if the item is sometimes covered by Medicare, but in this case it is not - you must charge the patient at least the amount that Medicare would allow. In other words, you cannot give the patient a lower price than you would bill to Medicare. I have tried searching Noridian Medicare and CMS.Gov sites and I cannot find information on this anywhere. Does anyone know if this is still true?

Response: If the patient does not statutorily qualify for coverage, then there is no fee schedule limit you are obligated to follow. No advance beneficiary notice is required. You can bill your fees directly to the patient. If, however, the reason the patient does not qualify is not because they medically are not eligible (that's a double negative), but because of medical necessity (e.g., wants a 4th pair of diabetic inserts within a single calendar year), then you would need to have an ABN signed, bill the codes using a "GA" modifier, and bill no more than the fee schedule allowance. I am not aware of any Medicare provision that forbids you from billing less than the Medicare maximum allowance.

I would like to comment on Dr. Clarke's posting and thank him for sharing. It is incredulous to me how the medical profession in general gets "dumped on". When I was a kid, "the doctor" had to be one of, if not the most respected of professionals. I don't find that to be the case anymore.
 
I guess the lesson to be learned from this posting is to get your fees/co-pays and deductibles before the patient walks into the room. It would be nice if the state associations would provide to their members the legal knowledge of how to properly do this. For example, holding a credit card on file is a good way to do this. But, I am not sure if the card can just be billed or if you first have to notify the patient you will be doing it. It would be great to know the correct way to do this. A colleague recently shared a "collections letter" which stated he would file a claim in small claims court if he didn't receive payment in ten days. Needless to say, the letter didn't work.
