David George, DPM recently celebrated his 25th anniversary as Podiatry Management’s Director of Continuing Medical Education (CME). Dr. George has been very active in continuing medical education from his days at the New York College of Podiatric Medicine (NYCPM) as former Dean of Graduate Medical Education.

  • "Bad communication is a common reason for a lawsuit," Tom Benvenuto, a senior trial attorney said. "Or if you're very critical when a patient has done their own research. You have to answer questions. You can't be in a hurry."
  • Peter Kolbert, senior VP for claims and litigation feels that the communication problem can be solved simply by modeling a phenomenon he sees take place when people order food, which is also known as closed loop communication. "When you order Chinese food, you place your order and the person says, 'Okay, you've ordered General Tso's chicken and fried rice' to ensure that they heard what you said, so there's not a dispute. How often does the clinician, when speaking with a patient, ask, 'Can you tell me what the next steps are, so that I can be sure you heard me?'"

Query: Negotiated Settlement Agreement
 
I am out-of-network with Aetna. I recently performed surgery on a patient with Aetna. They responded back with a “negotiated settlement agreement.” They want to reduce my payment.
 
Does anyone know what would happen if I don’t sign this agreement?

Response: This is not a legal opinion, just one of management. It is not uncommon for them to come back with a reduced amount: of course, they want to pay less! I would either stand my ground and have the patient advocate for you or you could offer a middle ground offer back to them. You have all the cards in your hand but I wouldn’t bet they’ll let you in their network in the future assuming you ever want to, unless they have a dire need for providers in your demographic area.

Query: Amphotericin B for Non-dematophyte Infections?  
 
Now that we have sophisticated methods to identify causative organisms in onychomycosis, many treatment options have opened up, especially for non-dermatophyte pathogens. Years ago, treating the causative organism in onychomycosis was just a guess, but now we have a much improved strategy for organism specific treatment. Toward that end: Is there anyone using topical amphotericin B  (amphotericin B solution, 2.0 mg/mL in a 1:1 mixture of DMSO and isopropyl alcohol) for non-dermatophyte infections?

Podiatry is a multi-faceted profession. As an old timer (since 1980), I always felt podiatric surgeons should perform surgery and podiatric generalists should not. As dentistry is not a specialty within medicine, so is podiatry. Therefore, a podiatric surgeon must be differentiated from a podiatric generalist. Both specialties can have sub-specialty certifications such as in wound management, biomechanics, dermatology, geriatrics, etc. A combined board will be divisive and professionally destructive, especially if a graduate is unable to get the appropriate training or pass the surgical board.
