PODIATRISTS AND SPORTS MEDICINE
VT Podiatrist's Early Sports Injury Pointed Him to His Career

Kevin McNamara, DPM wears many hats: husband, dad, friend, athlete, coach, and doctor of podiatric medicine. McNamara's impressive resume can be simplified by saying that he is board certified in podiatric surgery as well as wound care and holds a fellowship in podiatric sports medicine.

Dr. Kevin McNamara

Dr. McNamara grew up camping in northern New England with his family. Active in school sports, he was dismayed when, at the age of 14, he was often advised to "quit sports" because of a chronic sports injury. McNamara later learned that the cause of his problems was biomechanical. Understanding and correction put him back on the playing field and pointed him in the direction of a sports medicine career, helping others resolve similar issues in their own lives.

PODIATRISTS IN THE COMMUNITY
Driver Collides with NY Podiatry Office

A Watertown doctor's office was forced to close Wednesday afternoon after a car slammed into the front of the building. The elderly driver told 7 News his foot slipped off the brake. The front of the building was pushed in about a foot and city codes ordered the office closed. Podiatrist Dr. Andrew Majak said one of his staff members was sitting right inside the point of impact, but fortunately no one was hurt.

"A lot of damage and I don't know the estimated time until that's repaired. So it looks like we're not going to be open until that's fixed," said Dr. Majak. Majak said he's glad no one was hurt and he'll keep his patients updated about the status of the office until the building’s safety can be inspected.

PRACTICE MANAGEMENT TIP OF THE DAY
Negotiating Your Contracts: Hidden Pitfalls and Traps - Part 2

Negotiating and reviewing contracts is probably one of the more unnerving tasks that physicians face. That’s good! Your subconscious is sending you “danger” signals. You simply need to channel this emotion into action to protect yourself.

1. Sales personnel will tell you anything to make a sale. That’s what they do. Watch for it and remember that the contract is what you are bound by. When you receive the contract, read it carefully. Under contract law, a contract is enforceable unless it is illegal or violates public policy. That means, “if you sign it, you are stuck with it, unless your lawyer can get you out.” There are consumer protection laws, but litigating them is very expensive. Retain a lawyer to review a contract before you sign it. After you sign it, all we can do is read it to you, and tell you what you have done to yourself.

CODINGLINE CORNER
Query: Humana HMO Modifier for CPT 11755

I have been getting denials for CPT 11755 with the remark “procedure code inconsistent with the modifier”. I have used RT, LT and have tried the -59 modifier. In this particular instance, this was billed along with an E/M 99213 and a Doppler 93923. Should I be using a particular modifier? We usually don’t put modifiers on CPT 11755, and it gets paid every time. We are billing with diagnosis B35.1.

Richard Jason, DPM, Jacksonville, FL

Response: E/M 99213 should be billed with a -25 modifier. And I’m wondering what the diagnosis code would be for this as it should not be for ICD B35.1

That being said, it’s possible that Humana may be looking quite strongly at this code and not feeling it appropriate to cover under B35.1 This CPT has been way over-utilized and I caution its use.

RESPONSES/COMMENTS (OBITUARIES)
RE: The Passing of Stuart Bass, DPM

Tuesday was a very sad day for podiatric medicine as many of us were stunned to learn of the passing of Dr. Stuart Bass.  Dr. Bass was a respected physician, resident training director, and Director of the Civic-Kern Hospital Resident Alumni Association (CHRAA). He possessed a wit and humor that we will likely never see again.

Dr. Stuart Bass

On behalf of the CHRAA, we extend our heartfelt condolences to the entire Bass family and to his many friends and colleagues within the podiatric community, especially CHRAA members #KERNELS. May you rest in peace, Dr. Bass - you will be fondly remembered and greatly missed.

RESPONSES/COMMENTS (MEDICAL-LEGAL) - PART 1A
From: Lawrence Kobak, DPM, JD, Todd Lamster, DPM

Dr. Morelli has a kind heart. He is a fine example of what a podiatrist and human being should be! Unfortunately, treating a wart on a finger is clearly out of scope in most states. More than one podiatrist has lost his license to practice in more than one state for doing this.

Lawrence Kobak, DPM, JD, Uniondale, NY

I must admit that I am surprised by the number of my colleagues who perform this service. I, too, have elderly patients who ask me to trim their fingernails. I tell all of them that it is against the law because it is out of my scope of practice, and doing something out of my scope could put my license in jeopardy. Just because I am capable of doing something doesn't mean I have the right to do it. Every single patient completely understood and respected the answer.

To my colleagues who trim fingernails: Would you incise and drain an abscess on a hand or finger? Would you perform a biopsy of a suspicious lesion? Would you inject a symptomatic palmar fibromatosis?

Todd Lamster, DPM, Scottsdale, AZ

RESPONSES/COMMENTS (MEDICAL-LEGAL) - PART 1B
From: Paul Busman, DPM, RN

Like Dr. Morelli, I would very occasionally trim a patient's fingernails. These were generally patients that I had treated for a long time, had fingernails that were already pressing into their skin, and had severe disabilities. This made them unable to go to a nail salon. Some had such severe finger contractions that a nail salon would not likely want to treat them. Yeah, I know, scope of practice, liability, blah, blah, blah. I just didn't have it in me to refuse such a simple request which I was eminently qualified to fulfill. I never once had a problem doing this, just very grateful patients. Not that it legally meant anything, but I always told patients that their podiatry treatment was over, but I was cutting their nails as a friend might do. They got the message.

I never did treat warts on a patient's finger or any other area but the foot. However, I did tell them that if the warts on their feet were cured, there was a good chance that the warts would all go away. Know what? In a fair number of cases, that actually happened. Also, if I was treating a patient with some home applied remedy, e.g. Sal acid under occlusion, I'd point out to them that if they went to a dermatologist for their other warts, he/she might well prescribe a similar treatment for their other warts, wink, wink.
