NHEMA Gathers at NYCPM
 
The annual community and Board of Directors meeting of the New Harlem East Merchants Association (NHEMA) was held in the Bruce Frankel Conference Center at NYCPM. NHEMA is an organization where property owners, developers, merchants, and community members are working together to make East Harlem a robust, thriving community and a great place to live, shop, and play; Desander Más, NYCPM's VP of Development and Operations (at right in photo) is now a member of the Board.

Among the projects discussed at the meeting are holiday street lighting, improvements to 125th Street under and adjacent to the MetroNorth viaduct, and the updating of the NHEMA website. Eunice Ramsey-Parker, DPM ('85), MPH, Clinic Administrator, made a brief presentation about the Foot Center of New York to make sure all attendees were acquainted with its services.

PODIATRISTS AND THE LAW
PA Podiatrist Charged with Healthcare Fraud, Identity Theft
 
Aileen Gong, DPM, 55, of King of Prussia, was charged Friday by indictment with healthcare fraud, wire fraud, and aggravated identity theft, announced United States Attorney Zane David Memeger. The indictment charges that Dr. Gong, a podiatrist, submitted at least $480,000 in fraudulent claims to Medicare from 2009 through early February 2014 by submitting claims for patient visits that never occurred — including visits that she claimed took place while she was outside of the United States — and submitting claims for procedures that she did not perform on patients who did visit her office in Philadelphia. If convicted, Gong faces a maximum possible sentence of 184 years in prison and a fine of $3.5 million.

CMS to Reopen Submission Period for Hardship Exception Applications
 
CMS is announcing its intent to reopen the submission period for hardship exception applications for eligible professionals and eligible hospitals to avoid the 2015 Medicare payment adjustments for not demonstrating meaningful use of Certified Electronic Health Record Technology (CEHRT). The new deadline will be November 30, 2014. Previously, the hardship exception application deadline was April 1, 2014 for eligible hospitals and July 1, 2014 for eligible professionals.
 
As part of the American Recovery and Reinvestment Act of 2009 (Recovery Act), Congress mandated payment adjustments under Medicare for eligible hospitals, critical access hospitals, and eligible professionals that are not meaningful users of CEHRT. The Recovery Act allows the Secretary to consider, on a case-by-case basis, hardship exceptions for eligible hospitals, critical access hospitals, and eligible professionals to avoid the payment adjustments.

Query: Codes Not Covered by Medicaid
 
Our practice bills Medicaid as a secondary insurance to Medicare and Medicare Advantage Plans. Medicaid would usually pick up the 20% balance after Medicare and/or pick up the co-pays for the Medicare Advantage Plans for procedure codes, CPT 11719, CPT 11055, CPT 11056, and CPT 11057. According to the April 2014 Medicaid Update, however, as of June 1, 2014 if these procedure codes are not on the Medicaid fee schedule, then Medicaid will not pick up the balance or co-pays. Does anyone know of any codes that will cross over to Medicaid for these non-covered codes by Medicaid? Or do we have to write off the balance after Medicare? Can we opt out of Medicaid?

Response: Yes, you can opt out of Medicaid. Beware, however, if you do that, then you may not also be able to participate in many (not all) Medicaid managed care plans which pay close to Medicare rates. You might want to call New York State Medicaid for advice. In the past, they informed me to crossover the codes to something which closely resembles the codes that are not being paid. Not exactly a definitive answer, leaving much to interpret. They, however, would be the 'go-to' source.

Sacrificing critical intermetatarsal ligaments that maintain the transverse plane integrity of the foot that creates a 3-4 diastasis when gravity and ground reactive forces (GRF) remain crippling constants is not a good use of physics, and should be taken into consideration pre-op. Questions to be answered: What is the biomedical engineering of this patient's feet? What is his/her foot type? Is a long/short limb in place? Are tight toe-boxed shoes being worn?
 
Why: Repetitive 3rd interspace tissue stress caused by GRF, foot type pathology, collapsed vaults, the inclined posture, and shoe toe-box pathology - coupled with a 3rd metatarsal that is relatively mobile to the 4th - is at least partially etiological and could be addressed prior to elective foot surgery. Consider a referral to a podiatric lower extremity movement and biomedical engineering specialist.

As the medical advisor to the Pedorthic Footcare Association, I have watched with interest the letter war between the APMA and some members who feel the upcoming inclusion of the PFA at the National meeting in Orlando is a sellout and dangerous to the profession. I am always dismayed when podiatric physicians behave like the orthopods of yesteryear and lash out at anyone who threatens their perception of exclusivity in the area of foot care services.
