MI Podiatrist Discusses Plantar Plate Tears
According to Conway McLean, DPM, “A permutation of a hammertoe deformity is the dreaded plantar plate tear. When nothing is done for the conditions stressing the plantar plate, this can progress to a tear of the plate, worsening over time, as the second toe slowly drifts upward, bending at the ball of the foot. The plate itself will usually become increasingly traumatized and torn, allowing continued dislocation of the joint.”

“For plantar plate injuries which are less severe, various toe braces and strapping techniques can make a real difference in symptoms. Various surgical procedures are utilized for plantar plate instability, from correction of the bony alignment to repair of the tear in the plantar plate. Although many surgeons have their favorite procedures, the choice should primarily depend on the specifics of the deformity and the biomechanical function leading to the condition,” says Dr. McLean.

Query: Denial of CPT 11730
I wonder if any other podiatry practices are having issues getting paid for CPT 11730 from Aetna Medicare? The denial of the claims focus on “LCD guidelines.” We are sending numerous appeals along with medical documentation and the actual article from Medicare (L34887).

Response: Your question did not provide any specifics regarding the nail avulsion (CPT 11730) you performed other than to list the LCD you were provided by the insurance company. The LCD you referenced comes from Novitas Solutions. So you reside either in JH or JL and must abide by the Novitas rules for a Medicare Advantage plan.
There was a recent change in the LCD on January 30, 2022, which became effective on that date. In part, it stated under limitations, “Repeat nail avulsion on the same toe or finger following a complete nail avulsion performed more frequently than every 8 months (32 weeks) for toenails” is not medically necessary or reasonable.
I don’t know if this is your problem, but it just might be. The Medicare contractors have become aware of excessive use of the avulsion code (CPT 11730) with regard to frequency of billing and other abusive and fraudulent practices. The contractor’s response is to clamp down the only way they can by changing the limitations and provisions found in their LCD/LCA.

RE: Avoidance of Alcohol and Cannabinoids by Health Professionals

An article by psychiatrist Steve Adelman "Avoid 'Shots in the Dark' to Maintain Pristine Professional Boundaries" in Psychiatric Times (September 20, 2022) espouses how drinking alcohol in public may lead well-meaning licensed health professionals “onto the slippery slope of boundary violations and costly career jeopardy”. The effects of alcohol are often in the mix when health professionals are accused of behaving unprofessionally. For this reason, Dr. Adelman advises colleagues and clients to drink sparingly, especially in public situations involving peers, staff, or patients. He believes that health professionals might be safer abstaining altogether.
Psychoactive substances like cannabinoids with a different profile than alcohol, are also intoxicants that may jeopardize the...

RE: The Commercialization of Medicine

Does one think that we are the only profession fighting the commercialization of their products? When I was a kid and needed glasses, one entered the sanctum sanctorum of the optician. Today go on line or to Costco, and on and on. Braces are delivered to your door by some dental lab. There is an IV infusion store near me that gives you vitamins and other life improvement products. Of course they have a physician to sign off. It’s all about the dollar, the lack of respect for the medical profession, and the rise of social media. Read the book, The Tipping Point.
