CO Podiatrist Discusses Climbing Shoes

“The biggest foot problems that climbers have are associated with compression and friction,” says Dr. Thomas Shonka, attending podiatrist at the Boulder Center for Sports Medicine. Spot-stretching can help climbers with these and other issues (such as swollen nerves caused by repetitive movement) made worse by restrictive shoes. Any shoe-repair or ski-boot shop should be able to make the modifications.

Dr. Thomas Shonka

Dr. Shonka also recommends silicone pads to alleviate pain caused by hot spots.“You want to be sure to put more pressure around a pressure point than over it,” he says. In other words, encircle problem spots in little doughnuts of relief.

CA DPM is "Official Podiatrist" for Avon Breast Cancer Walk

When the Avon Foundation Walk For Breast Cancer kicks off this weekend in Santa Barbara, Dr. Stanley J. Zusman, with a 40-year Beverly Hills practice on Bedford Drive, will be there to serve the walkers. As the “official podiatrist,” Zusman will tend to sprains, ankle problems, sore feet, and whatever injuries participants endure in the two-day, 39-mile walk from Santa Barbara’s Chase Palm Park to Carpenteria State Beach, Sept. 22-23.

Dr. Stanley J. Zusman

He will be available all through the race, and even camp out with walkers in the “Wellness Village” Saturday night. Zusman and his daughter Lisa decided to get involved in the cause—for their first walk—when Zusman’s wife Marsha was diagnosed with breast cancer last January and needed an immediate lumpectomy. Every three minutes, someone in the U.S. is diagnosed with breast cancer, Zusman reports. “I cannot ignore this shocking statistic and the effect it had on my family; we have made it our commitment to work toward changing it,” said Zusman.

PODIATRISTS AND THE LAW - PART 1

NY Podiatrist to be Sentenced for Healthcare Fraud and Tax Evasion

Federal prosecutors contend a judge should do more than just step on the toes of a podiatrist from Dongan Hills at his sentencing Friday on healthcare fraud and tax evasion convictions. They're recommending that Dr. Simon Levich be sentenced to 30 to 37 months in prison, according to court papers.

Dr. Levich, 56, has already agreed to forfeit $100,000, court documents show. Dr. Levich admitted to billing for services he rendered to patients under another podiatrist's identification number and to filing a false income tax return for 2004. Court papers said he stated his taxable income was $644,921 and he owed $200,365 in taxes when he knew the actual figures were "substantially greater."

MO Podiatrist Admits to False Billing

A local podiatrist, Dr. John M. Dailey, pleaded guilty to federal charges Friday and admitted falsely billing Medicare for services he didn't provide. Dailey, 55, billed for services in 2008 and 2009 when he was actually outside the state, including on vacations to Las Vegas and Hawaii, prosecutors said. Dailey pleaded guilty to three felony counts of making false statements to Medicare, and is scheduled to be sentenced Jan. 7.

Physician's Stolen Laptop Leads to $1.5 Million Settlement

Stolen or lost laptops accounted for roughly 1 in 5 incidents of footloose patient data reported to the federal government in 2011, according to a recent study by the accounting firm Kaufman Rossin. If that statistic is not enough to convince out-and-about physicians to lock their laptops in their car trunks, the federal government will get their attention with a regulatory hammer. Just ask a group practice affiliated with the Massachusetts Eye and Ear Infirmary (MEEI), a specialty hospital in Boston.

In February 2010, a member of that group practice, now retired, had his unencrypted laptop stolen while he was lecturing in South Korea. The laptop contained demographic and health information on roughly 3,600 patients. When it announced the theft 2 months later, MEEI stated that there was no evidence to suggest that anyone had accessed or misused the data in the computer. In addition to apologizing for the data breach, MEEI said it was encrypting laptops connected to its network and educating its staff about limiting the amount of patient information stored on the devices. Those changes were not enough for the Department of Health and Human Services (HHS). On September 17, HHS announced that MEEI and an affiliated medical group, Massachusetts Eye and Ear Associates, had agreed to pay the government $1.5 million to settle "potential violations" of HIPAA. The Massachusetts providers also agreed to a corrective action plan to stay out of HIPAA trouble in the future.

RE: Prophylactic Antibiotics Prior to Podiatric Care (Eliott Udell, DPM)
From: Brian Fanno, DPM

With regard to antibiotic prophylaxis, cephalosporins are NOT considered broad spectrum; only a few are 4th generation. Depending on country categorization, they are considered and used as broad spectrum antibiotics. As for surgical prophylaxis, still use "IV Keflex."

RE: A Bullied Teen Patient (Billie Bondar, DPM)
From: Ira Baum, DPM

Thank you very much Billie Bondar, DPM for pointing out this sad and preventable condition. Bullying is a form of abuse and just like other forms of abuse, leaves a lifetime scar and affects the psychological development of the victim.

RESPONSES / COMMENTS - (NON-CLINICAL) - PART 1B

RE: A Bullied Teen Patient (Billie Bondar, DPM)
From: Elliot Udell, DPM

Perhaps some of our legal experts can enlighten us as to how we should handle a case of where a child tells us that he is being physically bullied by other students. Are the laws the same as they are in cases of parental abuse? Are we allowed or even obligated to report the matter to the school without the patient's permission? I could envision a scenario where the kid might not want to tick off his peers who are bullying him and might deny the matter or even sue the doctor for violating confidentiality laws by reporting the matter.

Elliot Udell, DPM, Hicksville, NY, Elliotu@aol.com

Editor's comment: PM News does not provide legal advice. In a growing number of jurisdictions, there is duty to report suspected abuse of patients under 18 or over 60. The proper authority to contact about suspected cases of abuse is generally child protective services, rather than the school. One should contact a local office to ascertain whether it is appropriate to make an official report.

RE: New Documentary on Healthcare (Bret Ribotsky, DPM)
From: Robert Kornfeld, DPM

Thank you, Dr. Ribotsky for presenting this "eye-opener" to our profession. This is precisely why I practice the way I do. I am engaged in a true health promoting paradigm that addresses not only the symptoms of my patients, but the causes as well. For those of you who still believe that all you need is a prescription pad and a scalpel, you are heading for a rude awakening. The time is now to embrace the wisdom and efficacy of integrative medicine. Those of you who hold steadfast to your closed-mindedness will soon find yourself wondering why your patients are leaving your practice.

RESPONSES/COMMENTS (MEDICAL/LEGAL) - PART 1A

RE: Stark Violation? (Joseph G. Smith, DPM)
From: Steven D Epstein, DPM

It amazes me that so many podiatrists still have such a low opinion of themselves. I should say right off that I've been just as guilty, grabbing whatever deal I could get when I needed the money. But there comes a time when we have to think for ourselves - not, will my competition grab the spot, but is this actually good for me?

This has nothing to do with "banding together." It has everything to do with whether you are proud of yourself, your work, what you do, and who you are. Under the best of circumstances, nursing home podiatry sucks. Treating patients seated in wheelchairs, moaning in pain when...

RESPONSES/COMMENTS (MEDICAL/LEGAL) - PART 1B

RE: Stark Violation (Michael M. Rosenblatt, DPM)
From: Dan Klein, DPM

I agree with Dr. Rosenblatt about podiatrist audits for routine care and billing CMS for this service. I have advised nursing home (NH) families and administrators that I refuse to bill insurance for this service and refer them to the Medicare statement about routine foot care. The majority of NH residents do not qualify under CMS guidelines, and I charge for the service. I have even seen and spoken with CEOs of companies that solicit for podiatrists to work for them doing routine service and billing insurance for this service. I refuse to give into coercive efforts by NH administrators to reference so and so podiatrist who bills insurance for all services.

I have told these administrators that my integrity for honest billing practices cannot be changed through coercion. Let those other podiatrists provide this service, bill insurance for routine care, and be subject to fraud investigation. Most families of NH residents understand and agree to have routine foot care provided on a re-occurring basis for a fee. They are glad not to have to transport their family member to the podiatry office for this service. If a service is deemed to be billable, I bill the appropriate insurance. This is done in concert with consults by the primary physician for these services.
