PODIATRISTS IN SPORTS
CT Podiatrist Becomes First Amercan to Swim Loch Ness

It was a monster challenge for a Connecticut woman who spent almost 12 hours crossing Loch Ness in Scotland last month. Dr. Marcy MacDonald, 51, survived the incredibly cold water and swam her way into the record books, one stroke at a time. MacDonald was in 51 degree water in just a bathing suit for 11 hours, 59 minutes and 11 seconds. That's how long it took her to swim across Loch Ness on Aug. 2.

Dr. Marcy MacDonald

On that day, she became the first American to swim the 23 miles. MacDonald said she was encouraged to do it by a friend and fellow swimmer. MacDonald is a podiatrist in Manchester, where pictures from her high school days on the softball field are on the walls, along with proof of her accomplishments on the water. One of her accomplishments is the record she holds for the 15 times she swam the English Channel.

PODIATRIC TRAGEDIES IN THE NEWS
Criminal Charges May be Files in Crash Which Killed CA Podiatrist

A Visalia woman may face criminal charges stemming from the Aug. 10 crash that left Tulare podiatrist Dr. Joseph Reynolds dead. Reynolds, 76, died at the hospital a week after the crash. California Highway Patrol Officer Scott Harris said his office is recommending Megan Chang, 31, be charged with vehicular manslaughter stemming from the crash.

Dr. Joseph Reynolds

Reynolds served in the United State Marine Corps, completed a church mission in France and Belgium, and graduated from the California College of Podiatric Medicine. He opened podiatric practices in Tulare, Visalia, Hanford, and Salt Lake City. Reynolds was also appointed to the Tulare Planning Commission and served in the city council from 1983 to 1987.

IN THE COURTS
MI Supreme Court to Hear Podiatric Case

Two podiatrists, Dr. Randy Bernstein and Dr. Kenneth Poss, entered into a business relationship. They eventually separated when Bernstein accused Poss, as well as the attorney who authored the corporate entity, of fraud. Bernstein sued the attorney for legal malpractice and breach of fiduciary duty for fraudulently working with Poss to defraud him of his business interests. The issues are whether Bernstein's claim for legal malpractice accrued at the time the defendants discontinued the provision of generalized legal services and whether those services were "the matters out of which the claim for malpractice arose" under MCL 600.5838.

PODIATRISTS AND THE LAW
CA Podiatrist Indicted for Healthcare Fraud

A federal grand jury returned a 20-count indictment today against Dr. Franklyn Collier Jones, 52, of Fresno, charging him with healthcare fraud and making false statements relating to a healthcare matter, United States Attorney Benjamin B. Wagner announced. According to court documents, Jones practiced podiatry in Fresno. Between 2010 and 2015, Jones allegedly billed Medicare for surgical procedures called avulsions and matrixectomies that he did not perform. In fact, Jones allegedly performed only routine foot care on the patients, such as clipping of toe nails. Jones allegedly billed more than $141,000 for these surgical procedures during this time period.

QUERIES (MEDICAL/LEGAL)
Query: Nerve Conduction Studies

Kindly comment on the use of nerve conduction studies (NVC) in podiatric practice. l feel the utilization of NCV studies could be very useful diagnostically and prognostically for patients who experience symptoms associated with symptomatic peripheral nerve disorders (diabetes, numbness, parasthesias, tarsal tunnel, nerve entrapment disorders, etc.). However, I recently read an article from the National Gov't Service (Medicare) that this test is considered a "screening" and should NOT be considered a complete study by any doctor unless this doctor performs an EMG concurrently and possesses "specific credentialing requirements to perform the test."

QUERIES (NON-CLINICAL)
Query: Billing Service Provider

I am in desperate need of a billing service provider. The ones I have checked out are NueSoft, American Health Care Billing Service, Dr. Billing Services, and SMB Medical Billing, to name a few. Please post your thoughts on any of these or others, especially if you have personal experience. I am a sole practitioner who bills about $600K per year, if that's a factor.

CODINGLINE CORNER
Query: Billing CPT 28285

I would like to know if I can bill for a hammertoe correction, CPT 28285 with a capsulotomy/tenotomy, CPT 28270. This is what the doctors report says: "Sharp and blunt dissection was used to create a plane between the subcutaneous and capsule at the level of the proximal interphalangeal joint, after which time a transverse tenotomy capsulotomy was performed." I would also like to know if I can bill the same code, CPT 28285, with CPT 28272. I thought the capsulotomy was already included in CPT 28285.

Della Roes, Lake Havasu City, AZ

Response: The CCI edit will allow CPT 28270 to be billed with CPT 28285 because they are on different joints; interphalangeal and metatarsophalangeal, respectively. However, CPT 28272 cannot be billed with CPT 28285 because they are the same joints - interphalangeal.
