IN THE COURTS

FL Podiatrist Fights Government Over Student Loan

A Davie podiatrist who went back to school at Nova Southeastern University in 1998 to get a degree in osteopathic medicine tried to argue that he shouldn’t have to pay his student loan because the school changed the graduation requirements and he never got his degree. Courts have struck down Dr. Massood Jallali’s claims. He now faces a bill for $477,000 that is growing each day.

“I have no problem paying every penny to the (U.S.) Department of Education and sending them a thank you note for giving me and my family a better life,” said Jallali, who now spends his time filing lawsuits instead of practicing medicine. But, he said, he won’t pay until he gets his degree.

RE: PM News Classified Ads
From: J. Ressler, DPM

Within the last several weeks, I have used the PM News classified website twice. Once to find equipment I needed, and the other time to sell equipment. Both times were very successful. The equipment I purchased saved me thousands of dollars. I was also able to sell a chair. The amazing part to this is I had posted ads on other "free" podiatry classified websites and never received any calls.

Podiatrists should not be discouraged about selling power chairs due to the logistics of shipping. I am using a moving company named Plycon. They ship throughout the U.S. and are very dependable with very reasonable rates. As we all know, PM News is a powerful source of information within our podiatric community. You should think about using this resource for your equipment needs.

RE: Checking Medicare Eligibility (Laura R. Lefkowitz, DPM)
From: Richard Rettig, DPM, Dan Klein, DPM

We stopped using CheckMedicare.com when we discovered that NaviMedix -(part of the Navinet juggernaut) has the same  information in an easy-to-use format for a flat $7.00 per month unlimited usages. It gives you the deductible amount used, the dates of eligibility, and any other insurance that may be primary to Medicare. Navinet also gives us eligibility and benefits information for many of our private insurances and Blue Shields for free, as well as authorizations.

Richard Rettig, DPM, Philadelphia, PA, rettigdpm@gmail.com

Nowadays, more seniors are signing up for advantage plans. Often they don't know to tell you, or they carry old cards, or they require referrals from their primary gatekeeper. Then there are the co-pays that you learn are due at the time of visit from their EOB after you file their claim. I'm afraid things will get worse with Medicare if forced reductions in fees to doctors take effect and fewer doctors accepting Medicare. I tell my patients when making appointments to check their benefits before arriving for their appointment, and that they are responsible for all co-pays and deductibles at time of visit.

RE: The Passing of Irvin O. Kanat, DPM

My story about Irv is quite similar to that of many other leaders of the APMA. Irv would challenge us to be prepared by asking the toughest questions we would get while “touring” the house of delegates each year. I first approached Irv when running for the Board of Trustees in 2000. He sat with me and grilled me on my thoughts for the future as a leader in HIS profession. After the grilling, he mentored me on how I should approach being a leader for ALL in the podiatric profession and for those outside. He then agreed to give my nominating speech, and it was stellar. In future elections, not unlike Dr. Taubman’s example, time did not allow for the delivery of the speech, but he would come up to me and show me the speech that he carried in his pocket at every House of Delegates.

We all lost a great friend this past weekend. My heart has been heavy ever since. This was the consummate statesman and scholar. His oratory was among the best I have ever heard. RIP my good friend and mentor. We will not be the same without you.

RE: The Passing of Irvin O. Kanat, DPM

Irv was a respected colleague and a very close personal friend. Attending APMA meetings was always like a family gathering. Irv had kids near the same age as mine, and those kids spent a lot of time together. I served on the APMA BOTs with him for more than 10 years. We always laughed about him being 4 years behind me. I graduated from the Scholl College in May of 1952 and he enrolled the following September, so we did not know each other in school but he was 4 years behind. Then, I served the APMA as president in 1970-71, and 4 years later, there was Irv. We have kept in touch over the years with emails, phone calls, and ordinary mail.

More than anything else, I will miss his emails. I had a couple from him during the past week, but it was not as many as usual. This was a guy who was always on the cutting edge of advancement in podiatric medicine, and I hate to think about what the profession would be today without him. Certainly, it would not be as far advanced as we now are. It seems unnatural to think that he is gone, and that leaves a void in my life.

Lawrence G. Lefler, DPM, APMA Past President

RE: The Passing of Irvin O. Kanat, DPM

Integrity. Uncompromised ethics. Foresight to help build this profession in a proper manner. Educator. Standing always on principle. Winning with all of the above. A man truly above reproach.

That is the Irv Kanat I remember.

Allen Jacobs, DPM, St. Louis, MO

I had the pleasure of not only knowing Irv Kanat professonally but also on the personal level. I remember one story that has always stayed with me. Mort Fielding, another podiatric elder, was visiting in Detroit. I was at a Providence Hospital resident graduation dinner with Dr. Kanat, and told him that Mort was in town. The two of them got together, and I just sat and listened to their stories. At one point, Mort looked at Irv and asked him what he used to charge for an office visit.  Irv did not hesitate and said $2.00. Mort looked up at him and said that because he was from the East coast area, he could get $3.00.

It is because of peole like Irv that we have in our profession what we have now. I always remember where our profession started.

RE: The Passing of Irvin O. Kanat, DPM

I can add nothing to the beautiful, meaningful remarks made by others, except to add about my first real contact with Irv. In 1974, I was general chairman for the APMA meeting in Atlanta. I came in 2 days early and sat in on the Board of directors meeting. I asked Irv, “Who is running for the board?” When he told me, I expressed my thoughts. “I don’t like my choices” he said, “Why don’t you run?” I said, “I can’t win.” Irv made sure that I was elected. I had the honor to spend 8 years on the APMA BOT. Thus began a 38 years exposure to Irv’s wisdom and love of podiatric medicine. Eternal peace my friend.

Mort Wittenberg, DPM, Evans, GA

I was fortunate to be one of Dr. Irv Kanat's residents at Kern Hospital in 1981. I have had many teachers, but Dr. Kanat was much more. He was a mentor and a role model. Kern could be tough and demanding. Dr. Kanat took over the residency mid-year and turned my life around. Over the years, I would see him at conferences and occasionally exchange an e-mail. He was consistently one of the most positive and inspiring people I have ever known. He helped make me the podiatrist I am today. A tragic loss for all of us.

RE: The Passing of Irvin O. Kanat, DPM

If a reality show about podiatric medicine was aired on TV, Irv would certainly have been selected for one of the leading roles. His diplomatic and leadership skills guided his devotion to the profession over many decades. His accomplishments are numerous, but his influence and dedication to thousands of podiatrists and millions of individuals obtaining foot care across the country will remain forever as his legacy.

I am honored to have been his friend. My deepest sympathy to his family.

Howard Rosenbaum, DPM, Kern Hospital Resident '77, Past President of NJPMS

I was shocked to seeing the recent passing of Dr. Irv Kanat. I may have not known him personally, but I knew him from the APMA HOD...who didn't? He was a pillar of our profession and will be greatly missed. Nothing more can be said about a man who dedicated his life to podiatry. It was in his blood to make sure we were on the right path, and he made sure that his voice was a beacon that led us there. My heartfelt sympathy goes out to his family.

RE: The Passing of Irvin O. Kanat, DPM

I would like to add my name to the countless number of individuals who had the privilege of meeting Dr. Kanat. As a former Kern Hospital resident (read student) of this great educator, I became a better surgeon and human being. He continuously challenged us to excel at whatever we did and thus become ambassadors for our profession. I will never forget the firm but gentle tone in his voice. My condolences to the Kanat family. Podiatric medicine has lost a true champion.

James L. Rose, DPM Anderson, SC

“Kernel" Nation will never be the same! He was so much more than our residency program director, for I truly feel like I lost a father! Dr. Kanat, may you rest in peace. My heartfelt condolences go out to the entire Kanat family.

RE: The Passing of Irvin O. Kanat, DPM

The sages urge us to "Find for yourself a great teacher." I was one of the fortunate podiatrists who knew Dr. Kanat as a great teacher. But because Irv was so much more than a teacher of podiatry, he became for me and, I suspect for so many generations of his students, a great role model and icon. Despite his warmth and congeniality, one was always in awe of his presence. Irv will be sorely missed by all who knew him.

Alan Feldman, DPM, New Haven, CT

I was saddened by the news of the loss of Dr Kanat, our residency director at Kern Hospital from 1984-1986. As a father figure, teacher, surgeon, friend, and proud founder and historian of so much of the early greatness of podiatric surgical training that proceeded us, we were truly blessed to be in his residency. His kindness and professional integrity will always be with me. I mourn his loss and celebrate Dr. Kanat's life. God's blessings and my personal condolences to his family. With much love and respect.

RE: The Passing of Irvin O. Kanat, DPM

My heartfelt condolences go out to Dr. Kanat's family. Personally, I think, there was no finer man to have ever walked the earth. I had the pleasure and honor of knowing him since I was a resident at Kern in 1997. He personally helped me many times in the past 35 years. His personal and professional insights were delivered in a fatherly manner. My career was greatly advanced by his sterling advice. The profession of podiatric medicine was shaped and advanced by his tireless efforts. He will be missed, but his guiding hand will still be felt for years to come.

Brent Nixon, DPM,  MBA, Atlanta, GA

The accolades will be endless about Irv Kanat. Who else will ever provide the eloquence, command, and common sense that filled the halls of the House of Delegates in so many leadership positions? Did I mention that unique booming voice? Too many things to mention and not enough time when describing this unique individual. In my house, he was referred to as “Uncle Irv” by my wife, whose father Werner Strupp was a long-time APMA legal counsel.

My favorite times would be just listening while Irv, my father-in-law, and Art Helfand traded podiatry war stories from their past. I am not sure that the youngsters of our profession will ever truly appreciate how men such as this lifted our profession to the status it enjoys today.
