Third NYCPM Faculty Member Granted Advanced Ankle Privileges in NY State
 
Samuel Adegboyega, DPM, Professor and Chair of the Department of Medicine at NYCPM, announced that he had been granted Advanced Ankle Privilege in New York State, from The University of the State of New York Education Department’s Office of the Professions. He becomes one of only 34 podiatrists in the state with that privilege; three of those 34 are faculty at NYCPM – Drs. Johanna Godoy, Thomas Vitale, and now Dr. Adegboyega.

Obtaining this privilege allows Dr. Adegboyega to perform these procedures in New York State: ankle fractures, ankle fusion, ankle arthroscopy (including drilling and cutting into the tibia and fibula), application of external fixation, Achilles tendon rupture repair, soft tissue reconstruction of the foot and ankle, and complex tendon transfer for foot and ankle deformities. In addition to his position at NYCPM, Dr. Adegboyega is section chief of podiatry at Harlem Hospital and performs surgery at both Harlem and Lincoln Hospitals in New York City.

As you head to the store, consider these tips and insights from the American College of Foot and Ankle Surgeons (ACFAS). Find the right fit: “Your child’s feet can grow up to two sizes in six months, so you need to account for rapid growth when buying shoes,” says Michael Coyer, DPM, a foot and ankle surgeon and Fellow  of the American College of Foot and Ankle Surgeons.

Replace worn-out shoes: Because shoes lose shock absorption over time, wearing worn-out shoes can elevate the risk for heel pain, Achilles tendonitis, and even ankle sprains and stress fractures. “Inspect old shoes and replace any that lack sufficient cushioning and arch support, or have excessive wear to the bottom or around the edges of the sole,” says Dr. Coyer. “When shopping, don’t assume a new pair will offer proper support. Check to see that the toe box is wide enough and the shoe doesn’t bend in the middle of the sole.”

Billing Agreements: Take These Steps to Avoid Painful, Expensive Mistakes
 
Many physician groups use an outside billing service to assist in collecting fees for professional services. However, it is not unusual for physicians to become unhappy with their billing company for a variety of reasons. Physician practices should make sure to seek legal help when negotiating a billing agreement in order to be sure the terms are as fair as possible. Some possible issues to consider are the following:
 
5. A particular issue of contention in billing agreement are the fees to be charged. The agreement should spell out precisely what is included in the fee and when the practice will be charged extra. How long is the fee in place before it can be changed and how can it be changed? How much can the fee be increased annually or upon contract renewal? There should be a clear understanding and negotiation of fee rates before a contract is executed. Also, some states regulate how a billing company can be paid for its services. Any compensation terms in the agreement must comply with relevant law.

Query: DME and a RVU-Based Contract
 
I am interested in getting any examples of already existing compensation models for the dispensing of DME. The specific scenario I am working with is an employed podiatrist in a large multispecialty group or hospital medical group setting. Our podiatry section has been certified by CMS and functioning for several years, providing both custom and non-custom DME to our patients directly but receive no additional credit for that production. Our compensation model is RVU-based and DME has no current RVU for HCPCS codes. The management team has been trying to explore options but is interested in analyzing any existing models in a similar scenario. We have made several proposals so any comments must be based on already existing programs with mainly RVU-based contracting.

Response: The author of the question is correct. DME cannot be signed RVU. Safe harbors are required to protect both the provider of the service (the parent company) and the referring entity (the individual DPM) from becoming sucked into violations of anti-kickback (Stark laws) for Medicare patients and anti-incentive (all patients, even self-pay). Thus, the complex nature requires the expertise of two other parties:
 
1)  A DME specialist who can assess the practice in order to determine the types of services that are both likely to be provided through the practice and those which will be referred out. The DME specialist would have to have a thorough understanding of the potential revenue stream which may be generated and review the practice’s past as well as making an economic forecast of the impact of DME revenue, doctor by doctor (regardless of whether a specific doctor prescribes or provides DME) as well as for the entirety of the practice.
 
2)  A healthcare attorney: The practice will require the skills and services of a team of healthcare attorneys well versed in DME AND Stark and Anti-Incentive issues. Working together this team can assist the practice and help them navigate the murky waters which, if not done properly, could result in significant issues for everyone involved. Once that is done, a fair legally binding contract with the appropriate “safety nets” can be incorporated.
 
Since each situation is unique there is no one uniform solution for all.

Query: Choice of Steroid for Ultrasound-Guided Injections
 
I thank everyone who submitted feedback on the ultrasound-guided steroid article. I was curious what readership thought of the choice of steroid...methylpredniolone acetate 40mg. What do most of my colleagues inject when giving injections? I, personally, rarely give an acetate (I’m not claiming it’s wrong) and most of the time find dexamethasone phosphate has worked for my patients.

RE: Medicare Advantage Plans and TV Ads are Deceiving

Advertisements on selected television stations with programming geared towards seniors run continuously tempting Medicare patients to call 800 numbers to check to make sure they are getting "free healthcare plans" and "all the benefits they deserve," and  also that additional money will be added back to their "monthly social security checks."
 
Paid spokespersons consisting exclusively of older celebrities, including William Shatner, George Forman, Joe Namath, and Jimmie "J.J." Walker read similar, if not exact, scripts in an attempt to induce the elderly to phone and check their "zip code" to see if they are eligible. I can't figure out what the zip code has to do with anything, but maybe someone can help me to understand this fish hook?
 
As of November 2021, 42% of all Medicare eligible patients are enrolled in Medicare Advantage plans. Does the viewing public not wonder why there is never any mention at all during these commercials that changing to a Medicare Advantage plan means switching their traditional Medicare over to an HMO, and that most likely they will lose their network of doctors and possibly hospitals as well?  Why don't they just tell the truth?

RE: AMA and Podiatry’s Scope of Practice (Allen Jacobs, DPM)

The definition of podiatry should allow a podiatrist to prescribe medications that may affect systemic organs, but for which the purpose is to treat a foot condition. With such a definition, podiatrists should be allowed to Rx insulin for a foot with a diabetic neuropathy. A license is not a right to Rx without training and experience. But a license opens a path for training from an internist, endocrinologist, etc.
 
I remember years ago when I asked if a podiatrist could treat PVD in the foot with Trental even if other parts of the body are affected. The response was yes, so long as a foot condition is being treated. Once podiatrists become trained to prescribe medications to treat foot conditions that affect other body parts, state legislatures should allow podiatrists increased scope of practice.
