NYCPM Confers Degrees to 89 Graduates
The 104th Commencement of the New York College of Podiatric Medicine (NYCPM) was held on May 27, 2015 at Alice Tully Hall at Lincoln Center in front of an audience of proud families and friends of the graduates. NYCPM faculty, led by President and CEO Louis L. Levine, presented the diplomas and hooded the graduates. The Hippocratic Oath was administered by Michael J. Trepal, DPM, VP of Academic Affairs and Dean, and President Levine conferred the degree of doctor of podiatric medicine on the 89 members of the Class of 2015. Fifteen of the graduates were hooded by family members who are doctors themselves; one graduate was hooded by her father, mother, and sister.

The keynote speaker was Todd J. Albert, MD, Surgeon-in-Chief and Medical Director at Hospital for Special Surgery as well as Chairman and a Professor of Orthopaedic Surgery at Weill Cornell Medical College, who also received the Honorary Doctor of Science degree from President Levine. In addition, Dr. Albert was presented with a portrait of his father, Earl A. Albert, DPM, member of the Class of 1941 at NYCPM; the photo was taken from his yearbook, of which the elder Dr. Albert was editor.

During the Saturday break at this year’s New York State Podiatric Medical Association (NYSPMA) House of Delegates, Dr. Arthur Gudeon ran his annual round robin tennis tournament. First place prizes were won by Dr. John Brummer (men) and Dr. Robin Ross (women). Men’s and women's tennis prizes for the winners (and non-winners) were donated by SuEllen Dercher of Gordon Labs. The tournament raised $300 for the New York Political Action Committee (NYPAC).

$2.15M Lawsuit: Hampton VA Did Surgery on Wrong Bone in Foot
Last summer, Mickey Murray went to the Hampton VA Medical Center with a broken right foot. A doctor recommended - and performed - surgery to his third metatarsal, court documents said. If only that had been the broken bone. Murray, a Navy veteran and now a former Norfolk sheriff's deputy, filed a $2.15 million lawsuit last week against the federal government claiming medical malpractice. Among other things, the lawsuit said Rodney Harris installed a plate and three screws on the wrong bone in his right foot.
According to the complaint, Murray went to the VA on July 25 complaining of foot pain. An x-ray revealed a stress fracture. About two weeks later - on Aug. 8 - Murray returned to the medical center and met with Harris, a podiatrist. Harris recommended immediate surgery, the lawsuit said. Harris performed an "open reduction internal fixation" on Murray's third metatarsal, placing a plate and three screws on the bone, the lawsuit said. Murray sought a second opinion from a private doctor Sept. 12, who determined his surgically repaired third metatarsal had no fracture, but his fourth and fifth metatarsals were broken and in need of care. The lawsuit said that doctor also noted Murray had developed a post-op infection.

Query: Insurance Denial for G0283 and OV
I received a denial from an insurance carrier here in Michigan (HealthPlus). The services billed were CPT 99213 and G0283 (electrical stimulation, unattended). The diagnosis code used was 728.71 (plantar fasciitis) on both claim lines. No modifier was appended to CPT 99213. I amended G0283 with a "-GP" modifier. HealthPlus denied the 99213 office visit code, stating "Denied- Procedure not indicated for separate reimbursement" G0283 paid. I do not think there is a CCI edit. Any ideas on what this carrier is looking for?

Response: Check your contract. This may not be a coding edit but a coverage edit. That is, their LCD or contract with you may restrict payment to only the physical therapy code and not permit both a physical therapy and office visit (E&M) code on the same day (when provided by the same provider). As is true for many carriers, they unilaterally decide to cover only one procedure for a given diagnosis on any given day. If it's in their coverage policy or your contract, then they have every right to do exactly what they are doing.

With all due respect, in this particular case, I agree with the 34 year old podiatrist's choice who is probably wiser than her years. Isn't life about BALANCE (between social and professional worlds)? From my perspective, my short priority list in order is FAMILY, practice, friends, and faith. Having said that, in the past, I've rescheduled patients to be present for funerals, etc. for friends in their time of need.
What works for one individual may not work for another. In this case, assuming the surgery was elective, your patient's failure to comply with pre-op NPO guidelines caused the postponement. So, the win-win scenario here would have been to re-schedule the case on a day that did not conflict with a family function or do the case as scheduled, but under straight local anesthesia. You chose to accommodate a non-compliant patient by performing the surgery on a day and time that conflicted with a pre-scheduled family function. That's a win-lose created by your patient's poor choice which forced that choice. I'm not saying we need to punish non-compliance, but in elective scenarios, what was the rush to perform it and thereby deprive your grandchild of your presence?

All doctors are workaholics to some degree, but nobody stands outside the OR at 11:00 pm on Friday night and tells you how noble you were for doing that surgery. We all care for our patients, but was it necessary to do the case on a Friday night at the expense of your family? Your patients love and appreciate you, but your family has your back. No one has ever laid on their death bed and said, "I wish I would have worked more."
