NY DPM Provides Advice on Summer Footwear

There is nothing worse than uncomfortable shoes and the havoc they can wreak on your feet -- especially in summer!  "Look for flip- flops and sandals that are comfortable and stylish," says OLIVER ZONG, DPM, a podiatrist with offices in New York City and Scarsdale, New York. "If you need arch support or have flat feet, go for something that's not pancake flat or you will end up with heel or arch pain," he says.  "Look for a wedge where the back of the heel is raised, as this is more supportive than the pancake-flat variety," he adds.

"Some times, flip-flop thongs can irritate the big toe and second toe, so if you have irritation issues, look for a sandal toe or a thongless flip-flop," Zong says. What's more, flip-flops and many sandals are backless, so you can develop heel calluses and fissures," he says. To avoid this, keep your feet lubricated with moisturizer.

According to American Podiatric Medical Association, your summer flip-flips should be made of natural materials such as leather. Make sure straps aren't too tight -- that can impede circulation in your feet.

Annual NYCPM Faculty Retreat Features  Holt,  Lazar

Recently, the faculty of the New York College of Podiatric Medicine gathered off-campus for the annual NYCPM Faculty Retreat, where Stephen Holt, M.D. and Eliot J. Lazar, M.D. gave presentations on complimentary medicine in medical education and on how to handle difficult students and residents.

Stephen Holt, M.D., is Professor of medicine at Capital University of Integrative Medicine, Washington, D.C. and an adjunct Professor of Bioengineering at the New Jersey Institute of Technology and also serves as the President and CEO of three corporations: Natures Benefit, Inc.; Holt M.D. Consulting, Inc.; and Wellness Publishing, Inc.  As an author of several hundred articles in peer review scientific literature, Dr. Holt has developed an evidence-based approach to natural scientific medicine that has found acceptance in conventional medical practice.  At the Faculty Retreat, he spoke about medical pluralism, his approach to complimentary medicine in medical education, and the revolution in medicine that has gathered momentum in recent years.

A second guest speaker at the Faculty Retreat was Eliot J. Lazar, M.D., Vice President and Chief Medical Officer for the New York- Presbyterian Healthcare System, and a practicing cardiologist at Weill Cornell Medical Center.  Dr. Lazar offered a number of case presentations from his own experience illustrating successful – and unsuccessful – ways for faculty members to handle problems with difficult students and residents.

CMS to Host Open Door Forum

The Centers for Medicare & Medicaid Services (CMS) will be hosting a
Special Open Door Forum (ODF) on May 23, 2006 to discuss the CMS
proposed rule to improve Medicare's payment for certain durable
medical equipment, prosthetics, orthotics, and supplies (DMEPOS)
through a new competitive acquisition program.

There are two ways to participate, by phone or "in-person".
1. To participate by phone:

QUERIES
Query: Short-Term Educational Opportunities

I work in a large multi-specialty clinic. After 7 years, we are allowed a two month sabbatical. I will be taking mine in 2007, in one month blocks. Two weeks of each month have to be educational. I was wondering if there are any short-term educational opportunities available anywhere (observing others office practice, surgery, etc for maybe a week). I remember a podiatry trip to China being offered a few years ago, but can't seem to find info on it now. Also, there don't seem to be any mini-residencies any longer. Any help would be appreciated.

Query: Intermet Neuroma Decompression

What is the code for an intermetatarsal neuroma decompression? Does
it matter if it is an endoscopic, percutaneous, or open technique?

Response: Actually, the coding for an intermetatarsal neuroma
decompression is dependent on what is actually performed.

A decompression of intermetatarsal nerve is part of a neuroplasty
procedure which involves "the decompression or freeing of intact
[digital plantar] nerve from scar tissue, including external
neurolysis and/or transposition." If that procedure is performed,
either open or endoscopically (there is no specific technique
requirement listed in CPT - just that all of the requirements of
neuroplasty (above) are met), then CPT 64702 (neuroplasty; digital,
one or both, same digit) or CPT 64704 (neuroplasty; nerve of foot) -
depending on the level of neuroplasty - would be the code of choice.

If the "decompression" is performed percutaneously by incising the
intermetatarsal ligament, it is not a neuroplasty. It is an incision
of the intermetatarsal ligament. This should be coded as CPT 28899
(unlisted foot/toe procedure) since there is no CPT code for a
procedure that only involves the incision of the intermetatarsal
ligament. Be sure to include the op report and a letter of
explanation along with the claim submission.

RE: CMS to Host Open Door Forum

This program would essentially restrict reimbursement for certain non custom made DME, prosthetics, orthotics and supplies to the winner of a competitive bid. Only the vendor with the winning bid would be able to provide those items in a given geographic area. The larger DME dealers would have a significant economic advantage over the solo provider, in placing these bids. This would effectively eliminate the ability of others to provide acute care DME items i.e. dressings, CAM walkers, ankle braces, etc. and other stock items to their own patients. At this time therapeutic shoes for diabetics and custom items are not part of this program.

Organizations such as APMA, AOPA, PFA and other individuals have either met and/or made written responses to CMS regarding this program. It is however essential that CMS hears from individual practitioners and patients during this open door forum. A clear message needs to be sent to CMS that this program will:

1) Interfere with the doctor patient relationship. 2) Reduce the ability for physicians to provide quality care to patients particularly during an acute crisis. 3) Significantly reduce the patient's ability to obtain needed equipment especially in rural areas. 4) Provide a significant hardship for acutely injured patients.

RE: Leaving Office Because of Unethical Practices (Name Withheld) From: Steven N. Solomon, DPM, JD

It should be noted that if you are aware of illegal or unethical practices in a podiatry office you may be under an obligation to report this to the proper state agency. Failure to do so could result in disciplinary charges against you down the road.

For those of you in New York, you may remember a few years ago about a doctor who "cut" his initials into a patient he was performing surgery on. This was witnessed by the nurses and anesthesiologist that were in the OR, yet none of them reported the doctor. It was the patient who eventually reported the doctor.

In response to this incident, New York enacted what is commonly called the "Zorro provision."  This provision makes failure to report an ethical or illegal act of another a violation of the disciplinary rules.

To protect yourself, make sure that if you become aware of unethical practices that you consult an attorney who is well versed in healthcare and disciplinary matters.
