NE Podiatrist Wins Primary for Legislature
 
District 4: Dr. Robert Hilkemann, a retired podiatrist, will run against Stacy Ryan, a legal researcher and judicial activist, in West Omaha. The two Republicans defeated three other candidates, including GOP activist Matt Butler. If elected, Hilkemann will be the only licensed healthcare professional in the Nebraska legislature.

WI Podiatrist Wins 100K in Hospital Raffle
 
Dr. Alyssa Stephenson of Fond du Lac won the $100,000 grand prize Tuesday in Agnesian HealthCare Foundation’s Samaritan Health Clinic cash raffle. An Agnesian podiatrist, Stephenson purchased eight chances for prizes, including the lucky one pulled from a drum jammed with tickets. She said that she will donate some of the money to Samaritan Clinic, but she and her husband have not decided what they will do with the rest.

“The night of the event we talked about definitely giving back to the Samaritan Clinic,” Stephenson said. “I get to see those patients in the clinic, and the foundation does a wonderful job with patients. We have a child with special needs. He may need something from the Samaritan Clinic some day. We hope to start a (fund) for him as well.”

PODIATRISTS IN THE COMMUNITY
Students Make Teddy Bears for NY Podiatrist's Foundation  
 
Armonk middle school students volunteered their time Tuesday to make teddy bears for sick children in various hospitals. The students from H.C. Crittenden Middle School were working with the Heavenly Productions Foundation, a non-profit that helps children in distress. The organization was started by Dr. Kathy Reilly Fallon in 2003 and provides teddy bears to sick children nationwide, plus in Haiti and Africa.

The bears will be delivered next month to the Blythdale Children's Hospital in Valhalla and the Children's Hospital in Philadelphia.

Discrimination Suit Against NYCPM Dismissed
 
A Hispanic graduate of New York College of Podiatric Medicine who sued his alma mater has presented no direct or indirect evidence of national origin discrimination, a federal judge has ruled. The decision dismissed a Title VI suit seeking $10 million in damages and retroactive enrollment in a residency program. Dr. Hernan Melgarejo failed part II of the American Podiatric Medical Licensing Exam eight times and blamed discrimination for his inability “to secure a residency or obtain a permanent podiatrist position,” according to the court.
 
He “contends that as a result of the discrimination he suffered, he has been unable to secure a residency or obtain a permanent podiatrist position,” U.S. District Judge Katherine Forrest said in her decision. Melgarejo “indisputably had a number of difficulties with regard to his education. He received poor grades, was put on academic probation and allegedly encountered public displays of disapproval,” Forrest said. Even so, she found “no evidence providing the slightest support for an inference that the college discriminated based on his national origin or that he was treated differently from his non-Hispanic peers.” While he alleged that a White student received preferential treatment in an oral exam, she noted he also twice failed the written part of the test. The decision noted that the college gave Melgarejo a “great deal of individualized support and attention.”

Surgery on this spiral fracture at 7 weeks is wrong, unless the fracture is very unstable (assess with a “C” arm). If it is very unstable, percutaneously pin it. If goes to a painful non-union, then remove the fragment—basically do an arthroplasty of the PIPJ. I would try very hard to avoid “doing something” surgical at this point. Sometimes, you just have to let the patient whine a little and let Dr. Time work with you.

I would not consider surgery for this patient. There is minimal displacement, and as you stated, the toe is only "mildly sore." I am sure that with another 4 weeks of strapping the toe to limit PIPJ and MPJ motion along with a post-op shoe, it will be much less painful and show signs of healing on x-ray. It could take many months to appear totally healed on x-ray, but as it becomes much less symptomatic, you can switch the patient to a sneaker, and eventually shoes.  
 
However, I would continue taping for a few months or until asymptomatic, with significant signs of healing on x-ray. You could also add a bone stimulator, but I think it would be overkill. Don't treat the x-ray.

These judges are so out of touch with reality on the ground with physician practices. There is no absolute morality or common sense. A compassionate common sense person, judge, inspector had to know the days in question were holidays.* But all government and judicial persons care about are the letter of the law not the spirit.  I'm not wishing ill, but maybe I am...I truly hope that judge and inspector at some point in time injures their foot and ankle, goes to a physician for a DME device who had their DME license revoked...and gets sent out to Hanger or another supplier where there is a three-week wait for an appointment. The rules for suppliers were written independently from the rules governing physicians who dispense DME.
 
I called Noridian with a concern that according to supplier guidelines, an order must be in the chart from the requesting physician. I told them that I was the requesting physician and that it was silly to write an order to myself and in fact, a physician writing an order to himself may constitute fraud or a Stark violation, etc. They agreed that these two sets of rules were written with no thought for the physician who is also the DME supplier. They did tell me that as long as I put in  my note the reason and need for DME, that would suffice. I had others in my organization call and confirm this as well. There is written proof of this in a Noridian Q&A section on Noridian's website to back me up. It still seems that despite all of these hoops, Medicare can do as it pleases and judges are complicit.

Dr. Peacock has misunderstood what this class action was about. It was not about if barefoot/minimalism or the Vibram Five Fingers was any good or not. It was about Vibram claiming there was “ample” evidence to support the health claims they made. There was no evidence when they made the claims and there still isn’t. Over the last 4 years, there have been five systematic reviews of all the evidence reaching that same conclusion. It was alleged that this misled consumers into buying the product.
 
When Vibram filed a motion to get the case thrown out last year, the judge dismissed the motion and pretty much accused Vibram of not being truthful about the scientific evidence and doing so deliberately. The writing was on the wall that this case probably could not be defended. As for claims made by other running shoe manufacturers, they are not making health claims (go check their advertisements), let alone claiming that scientific evidence supports them. That was Vibram's downfall, as it was with Skechers and Reeboks in having to settle with the FTC for over $100 million each for the claims they made for their toning shoes. Vibram FiveFingers got let off lightly.

What is off-putting to me is Dr. Peacock's tone. It seems to me that Dr. Peacock's dedicated use of Vibram 5 Fingers has biased his judgment. I also detected a little off-putting, in his anti-government comment, "....litigiousness aspects of political causes..." I guess I need to remind him of the lawsuits against New Balance and Skechers. If a shoe company lies in their ads, they should be held accountable. I cannot cut the shoe in half to see if it is what they say it is, so I have to trust their information. I would love to see the government investigate what shoe companies mean by a "neutral" running shoe. 
 
I do believe Dr. Peacock's statements about his use of the shoes, and how successful they have been for his running, but I hope he was not suggesting any large number of runners would be just as successful. In my practice, my experience is that minimalist shoes, all too often, are the root cause of some of my patients' reporting complaints. My theory is backed up by the fact they had no injuries when they were wearing a stability shoe, and that their reporting complaints were healed when I got them back into their stability shoes. 
 
I do not see the "stupidshoes" craze, ending any time soon. Ego seems to have become the major factor in shoe choice, along with color, of course.
