PODIATRISTS AND THE LAW
NC Podiatrist Faces Wire Fraud Charges

A podiatrist and his son are facing federal charges in connection with an unemployment insurance benefits scheme, R. Andrew Murray, U.S. attorney for the Western District of North Carolina, said Friday. A criminal bill of information was filed in U.S. District Court in Asheville Friday, charging Dr. Jerry Gross, 72, and his son, Jason Lee Gross, 51, both of Rutherfordton, with wire fraud. Filed documents show that from September 2009 to March 2013, Jerry and Jason Gross carried out a scheme to defraud the state by placing employees of the Foot & Ankle Center on unemployment insurance benefits while those employees continued to work at the business in excess of what was permitted by the program eligibility requirements.

PRACTICE MANAGEMENT TIP OF THE DAY

Common Mistakes of Physician Group Mergers - Part 4

One simple but effective way to ensure a successful acquisition is to study why others have failed and do something different. Here are nine common root causes of failed acquisitions.

1. Strategy: Poor strategic logic or fit. No strategy used to determine goals of integration.
2. Synergy: Overestimation of potential synergies, or under-estimation of synergy complexities or timetable to delivery.
3. Culture: Fundamental incompatibilities (including buyer’s lack of self-awareness), ineffective integration, or squelching positive attributes of target’s culture in name of uniformity.
4. Leadership: Weak leadership, delays in appointing new leadership team, loss of key talent, insufficient participation in the transaction and integration process, ego clashes, or failure to deliver on pledges.
5. Transaction parameters: Overpaying, inappropriate deal structure, or endless negotiations which bleed both practices dry.

RESPONSES/COMMENTS (PM NEWS QUICK POLLS))
From: Alison Silhanek, DPM

Professional versus “casual” dress. I just don’t understand this argument. I have been in practice 20 years, so perhaps I can now be considered old and out of touch. I have seen the general trend in U.S. dress towards very casual. Adults wearing pajamas when buying groceries. But I was surprised at the percentage of PM News respondents who listed that they dress casually for work. The highest percentage was those respondents who wear scrubs to work.

As a surgeon, I suppose I understand that, though I wear professional clothes in the office. As a woman, I feel that no woman, regardless of body type, looks good in scrubs, but maybe that’s just me. Regardless, I see my primary care physician and cardiologist and they wear professional attire. Why should we as podiatrists dress less professionally?. And for those who voted that they dress “casual”? What the heck is that? Are you now working as a teller at Walmart? For all your schooling and residency, you dress casually? Shame on you. Have some dignity and pride in being a doctor. Period.

RESPONSES/COMMENTS (NEWS STORIES)
From: Janet McCormick

Though I am not a podiatrist, I fully agree with Dr. Lauren Perico's description of necessary foot care and that it is important to prevent foot problems from getting serious. However, many persons cannot perform some of these self-care tasks for various reasons, such as poor eyesight, arthritis, and other deficiencies, even cognitive ones. These persons have two options: having a caregiver perform the care or going to their podiatrist for monthly care.

Two problems are obvious with these options. First, podiatrists would be (and many are already) totally overwhelmed with RFC in their practices; and second, these visits would be self-pay/not be covered by Medicare or insurance. An additional problem would be that the podiatrist could not take more treatment-oriented care.

A resolution of these problems was found many years ago by physicians through the hiring of licensed extended care professionals. For example, many derms and plastics hire estheticians to perform the routine care that is important for their patients and to perform non-medical care. These services are also not covered by Medicare or insurance.

Many podiatrists are reducing their overload of RFC by hiring trained nail techs to perform this care. These technicians are state licensed in performing the skills within RFC and have completed a medical nail tech program of 20 modules online, followed by an internship to prepare them to work appropriately in a podiatry office.

YOU CAN'T MAKE THESE THINGS UP

RE: Outrageous Shoe of the Day

Bibbidy Bobbidy Shoe?

"Whereas little boys grow up on shooter video games and transformers, little girls (still) grow up on fairy tales and keep waiting for their prince to come (but, of course, he never does). Not having turned into a princess, they stay a Cinderella forever. This transparent plexiglas shoe represents just such a desire for unrealized dreams." - Diana Sokolic
