NE Podiatrist's "Right to Try" Bill Becomes Law 
 
A new Nebraska law will give terminally ill patients the opportunity to attempt treatments that have not yet received approval from the federal Food and Drug Administration, but some doubt the change will make much difference.

The bill's sponsor, Sen. Robert Hilkemann, a retired podiatrist from Omaha, said the so-called "right-to-try" legislation eases the process for terminally ill patients to access unapproved treatments and drugs in the clinical trial stages of FDA approval. The law will go into effect in July. Supporters tout the law as a way to bypass bureaucratic FDA reviews that can take up to a decade before drugs arrive on the market. Hilkemann said the FDA can take months to process requests, lessening the chance terminally ill patients could benefit from treatments.

AAWP Holds Scientific Conference

The American Association of Women Podiatrists (AAWP) had their Scientific Conference this weekend at the Wild Dunes Resort, Isle of Palms, South Carolina. Many attendees enjoyed this comprehensive scientific conference. Among the nationally known faculty was Dr. Steve McClain and Ms. Kim Rhatigan of McClain Labs, a diamond sponsor for this event.

Surgeons' Skills Improve With Age
 
Surgeons’ skills may improve with age, and male and female surgeons perform equally well, a recent U.S. study finds. Medicare patients’ risk of dying in the month after an operation steadily fell as their surgeon’s age increased, Dr. Yusuke Tsugawa of the David Geffen School of Medicine at UCLA in Los Angeles and colleagues report in The BMJ.
 
There was little difference between mortality among patients of male or female doctors, with one exception. “Patients treated by female surgeons in their 50s had the lowest mortality across all groups,” Tsugawa told Reuters Health in a telephone interview. Among the roughly 892,200 patients treated by nearly 46,000 surgeons, the overall risk of dying within 30 days of a surgery was 6.4 percent. After adjusting for other factors, mortality rates were 6.6 percent with surgeons under age 40; 6.5 percent with surgeons in their 40s; 6.4 percent with surgeons in their 50s and 6.3 percent for those 60 and older.

Navigating the Waters from Residency to Practice - Part 2

A complete buyout will have two scenarios to consider. Is it an asset and goodwill buyout, or is it a stock purchase buyout? Both have advantages and disadvantages, but you will need to seek legal and financial council to guide you during your purchase. Complete buyouts generally require either upfront cash or financing through an approved banking institution. There are several creative ways to structure the buyouts, but again, you will need legal counsel for guidance.  
 
Understanding the state scope of practice for the area of the country you will want to settle in is of utmost importance.  If you are heavily surgically trained in rear foot but decide to practice in a state that has extreme limitations to the rear foot, it could be disastrous. Common Reasons Your Claims are Bouncing Back - Part 5
 
Billing is a complex and often tedious procedure—especially with ICD-10 codes. However, the reasons for returned and delayed claims often boil down to a few basics. Here are some of the most common billing mistakes practices make, and how to make sure your practice avoids them.
 
5. Keep up with the Changes
 
Even when policies haven’t changed, what is and is not covered on a given plan sometimes does. You can be left holding the bag if a payer changes its policies about what procedures they cover or what labs they use, and you don’t hear about it. “Most payers send out a policy bulletin announcing these changes,” says Cantrell, “but it’s difficult to find time to keep up with this.” Large practices often have administrators who watch for these changes and pass the word on to each billing office. However, in smaller practices that job may fall to the front desk or billing staff. Make sure whoever does this understands the importance of carefully reviewing these bulletins when they are issued.

Query: Modifier Use of -GX and -GY Modifier
 
Can someone tell me definitively whether the following example would get a -GX or a -GY modifier? A patient who is diabetic presenting for “Routine Care” (nails and calluses) with no complaint of pain and who does not meet the ABC criteria. They will not meet those criteria at any time. The debate at the meeting was “Are they statutorily non-covered (-GY) because they never meet the ABC criteria, or would they be otherwise non-covered and get the somewhat misunderstood (-GX ) modifier?
 
And whichever your choice, do they need to sign an ABN for each visit or is one sufficient per year with the proper notation about monthly or bimonthly visits, etc.? The hospital personnel stated that “Routine Foot Care Codes and rules” are the most complex group of codes they have ever had to work with.

Response: Specifically related to RFC, if the patient does not meet medical criteria, then there is no requirement for an ABN to be signed as RFC is statutorily not covered. If the patient requests you to bill as possibly a secondary carrier might cover the service, then a GY modifier would be used. For an ABN, it must be signed every time the service is rendered.
