Podiatry Guild and APMA Gain NY Senator's Support of Podiatric Legislation
 
NYSPMA President Andrew Shapiro, DPM and OPEIU President Richard Lanigan recently led a delegation of the NYSPMA, the Guild, and APMA in a meeting with Senator Charles Schumer to discuss The VA Parity Bill as well as Medicaid (Title XIX).

Podiatrists Included in CT Bill to Expand Entities Employing Doctors 
 
A proposal to limit non-compete clauses in physician contracts and expand the type of entities that could employ doctors – viewed by proponents as a way to protect or increase competition in healthcare delivery – won final passage from legislators Tuesday night. It now goes to Gov. Dannel P. Malloy for signing. The proposal grew out of work by the Senate’s top Democrat and Republican to address the changing healthcare landscape, including the trend toward doctors giving up owning their own practices to work for hospital systems or large group practices. 
 
The bill expands the types of entities that could employ doctors. State law allows structures known as medical foundations to employ doctors without running afoul of anti-kickback requirements. But currently, only hospitals can operate medical foundations. Under the bill, medical foundations could be operated by independent practice associations and other business entities that are at least 60 percent owned by an independent practice association, physician group, or doctor, chiropractor, optometrist, or podiatrist.

Dr. Hagen is a graduate of the California College of Podiatric Medicine. He completed his podiatric surgical residency at Encino-Tarzana Regional Medical Center and also completed a fellowship in podiatric sports medicine and surgery at Virginia Mason Medical Center in Seattle. The Board-certified podiatric surgeon comes to Visalia Medical Clinic from his most recent position at Kings Foot and Ankle in Hanford.

WI Podiatrist Avoids Prison, Ordered to Pay $1 million in Fraud Case
 
For ripping off Medicare, a Cedarburg podiatrist was sentenced Wednesday to five years of probation and agreed to repay $1 million in restitution and to settle claims in a related False Claims Act civil case. Balkansky, 63, pleaded guilty in February to a single count of healthcare fraud. It was part of a 30-count indictment returned last year. It charged that from 2005 to 2012, he billed Medicare for services like foot massages that weren't covered and that weren't performed by licensed physical therapists. It also charged that he helped his staff create records that made it harder for the government to spot the fraud.

QUERIES (CLINICAL)
Query: Painful Blue Spots in Diabetic
 
I have a 51-year-old diabetic lady whose last A1c was 7. She complains of very sensitive painful feet with, redness and some swelling at the end of the right 2nd toe which progressed to the plantar pulp, which is very painful. She also has episodic dark blue spots on the feet which are extremely painful. She has swelling and burning of the feet as well. She states her feet are hypersensitive, especially the right 2nd toe, and the when the blue areas arise. She gets throbbing pain relieved by elevation of her feet. She notes her feet are very sensitive when the shower water hits them and her feet have red blotches all the time.  
 
Painful Blue Spots in Diabetic
 
The patient denies any general muscle-skeletal pains, major systemic illnesses, infections or malaise, rashes, or travel outside the U.S. She smokes about a half pack/day. She states there is no change whether in cold or warm weather. Gabapentin prescribed by her PCP did not help the pain. She denies illicit drug use. She has no ischemic changes. Suggestions?

I am saddened to hear the news of Marv Levin’s passing. I savored and admired his book as a student, both editions of which bear his autograph. I came to know him back in the days I was involved with the Hunter Mt. Sinai GEC conferences on "The Geriatric Foot and Ankle".  If, as a student, someone told me that Marvin and Barbara Levin would be napping in my home one day, I certainly wouldn’t have believed them.  As it turned out, Marv & Barb took afternoon naps at my house twice! He was not just a dynamo of a speaker, a dedicated and knowledgeable physician, but a mench of a man. It was an honor to know him.

RESPONSES/COMMENTS (NON-CLINICAL) - PART 1A

I have read and thought long and hard about Dr. Borreggine's letter regarding the migration away from fee-for-service into these relatively unknown payment models, and how that will affect the smaller practices (like mine). I have tremendous respect for Dr. Borreggine but for me, his points just raise more questions. These larger groups are notorious for ever swelling overhead. I feel like I have more control having a smaller practice (just an opinion, of course).
 
Also, how exactly do these pay for performance models work, and how will the 25-provider group be paid higher than my 2-provider group? Will insurance companies "kick off" smaller practices from the panels? What can we do, big or small practices, to prepare for the changing model? So much advice was given for preparation of ICD-10. I would love to see advice given on how to prepare for this.

I cannot agree with Dr. Borreggine when he states that he honestly believes that no matter what a physician does in private practice to make ends meet, it is still going to be hard to make a decent living in the years to come. It is good for my practice to hear him advising us to find an employment position because as a successful solo practitioner, my marketplace will continue to grow and thrive. But for those interested in an opposing viewpoint, in the words of Rudyard Kipling, “it’s an ill wind that blows no evil.”
 
Every community has BMW drivers, those getting Botox and tummy tucks, those wanting to get sophisticated care, and those wanting to be treated in a more intimate, more personal environment. There are those who seek wellness care and advice, and those needing uncovered services who have enough of a pocketbook to pay for them.
