April is foot care awareness month. "If your feet hurt, everything hurts, so it's dificult to walk or go to work or go to the gym. So, if we can take care of our feet by doing small, simple things, we can ensure our long-term health," says Jared Kohlbacher, DPM.

"Exercise is great, but winters are long and cold here so it's easy to put on a couple of extra pounds. Extra pounds can work on our lower back, our hips, our knees, our ankles, and even our subtalar joints and toes. Getting that extra weight off can help," says Dr. Kohlbacher.

Chronic Wearing of High Heels May Shorten the Achilles Tendon: WV Podiatrist 
 
Warmer weather provides a great opportunity for dressing up, and for many women that includes slipping on a pair of high heels to complete the look. It also means millions of teenage girls are sliding into stilettos for prom. According to Clarksburg podiatrist Dr. Keith Newman, his two concerns for those who wear heels 2 inches or higher would be the effects from the increased load on the forefoot and the potential for adaptation of the Achilles tendon.

The Achilles tendon may shorten in individuals who wear heels as it adapts to the shortened position from the higher heeled shoe, he said. “Some people will adapt over years or decades of use, and then they may not be able to wear flat shoes effectively anymore without pain,” Newman said.

KY Podiatry Clinic Says DOJ Demands Must End
 
The U.S. Department of Justice (DOJ) has improperly continued to demand medical records and testimony from a podiatry clinic chain despite declining to join a False Claims Act (FCA) case that accuses the chain of fraudulent billing, according to a petition filed Monday in Kentucky federal court. The petition filed by Lexington Foot & Ankle Center PSC seeks to set aside a trio of civil investigative demands that the DOJ issued this month. The demands, which followed another demand last year, were improper because they were issued after the DOJ in February elected not to join an underlying FCA case brought by former clinic employees, according to Monday’s petition.
 
The petition relies on a section of federal law that authorizes the DOJ to issue civil investigative demands. The section says that the DOJ can issue demands “before commencing a civil proceeding under [the FCA] or making an election under [the FCA].” Because the DOJ in February elected not to intervene in the FCA case, its demands in April were no longer authorized, according to the petition.

I’m glad this office is encouraged to fit more patients with diabetes at risk for foot ulceration with shoes covered by Medicare. There has been a several year trend of fewer shoes paid for by Medicare while the number of patients who qualify has continued to increase. The good news is that pre-payment audits for diabetic shoes that had been so common are no longer a Medicare priority. 
 
While bonus payments to employees performing shoe fitting under the supervision of the DPM may seem like a logical way to increase the number of patients provided care, please be aware that “per patient” compensation might attract enforcement scrutiny by regulatory authorities as Medicare anti-kickback rules, while allowing carve-outs for employees, prohibit...
