CMS Finalizes Medicare Advantage Prior Authorization Reforms
A new final rule installs new requirements for Medicare Advantage (MA) plans to require prior authorization, such as ensuring a transition period when a beneficiary switches plans. One of the key changes applies to the prior authorization tool insurers use to require providers to get approval before offering a certain service or drug.
The rule includes new continuity of care requirements that says coordinated care plans can only use prior authorization “to confirm the presence of diagnoses or other medical criteria and/or ensure that an item or service is medically necessary,” according to a fact sheet. An MA plan must also make sure to follow any national or local coverage determinations. If there is no determination in place, then an MA plan can create its own coverage criteria but must stand up a committee to annually review such guidelines.

Student Loan Concepts to Know During Tax Season
With tax season approaching, many people are focused on gathering all the tax forms to make sure they don’t miss the April deadline; however, few will pause to inquire how their tax filing could impact their student loan payment. Fortunately, there are many ways that borrowers can get creative with income reporting come tax season that could impact their student loan payments substantially.
7. Forgiveness plans - Part 2
The other forgiveness program is a long-term taxable forgiveness program. Many of the IDR plans offer a forgiveness plan at the end of a 20-25 year timeframe. If you have made payments for that long and still hold a balance on your loans, they allow you to throw in the towel and they will forgive your remaining balance. As you can imagine though, there is no such thing as a free lunch when it comes to this government program and thus, they will add the forgiven amount to your taxable income in that final year. This can create an exceptional tax burden for you down the line but in many instances, this could be a substantially more efficient path than just paying them off aggressively. Given this, you will also want to minimize your payment if you are pursuing a plan like this to maximize the forgiveness allotted to you.

Query: Paring Callus And Nail Debridement
There is callus present on the distal aspect of the patient's left 3rd toe. The toenail on the left 3rd toe is thick with subungal debris. Can paring and debridement (CPT 11055 and CPT 11720) be billed out to Medicare? Systemic disease is present as well as Q qualifications. Is there a new Medicare rule that paring and debridement can not be billed out for the same toe?

Response: It is not a new rule, but much more enforced lately. If there is a lesion distal to the middle phalanx and a nail both being “debrided,” then they will bundle them into one payment or none. Your Q modifier is fine and necessary but it is the location of the lesion that is the problem. Should the lesion be proximal to the middle phalanx or say, on the proximal interphalangeal joint, you can bill for both codes and must document clearly the location. This policy has been ongoing for some time.
I refer you to your local LCD to read up on it. Also, there has been some APMA information sent out regarding this policy. No: no one agrees with it and it is being contested, yet it continues.

Dr. Jay L. Duhl, 79, passed away on February 21, 2023. He was a passionate podiatrist in Long Beach, on Long Island for more than 50 years. He earned a Doctorate of Podiatric Medicine at the New York College of Podiatric Medicine in 1968.

He formed great relationships with his patients, even doing house calls long after other doctors stopped. He retired recently due to Covid closures. He will be greatly missed by his family and his community.

I bought my first fluoroscope (Xiscan) in 1998. I bought it because the radiation, at that time, was significantly lower than a conventional x-ray. I found it to be an incredible adjunct to my practice. There were instant images, they were clear, and I could position the foot in many different views. The images were saved and could be printed out at any time. I bought one for each of my offices. I even built a box for patients to stand on so I could take weight-bearing images.
It was amazing for surgery as well. I had a sterile cover and did intra-operative films on cases that I did in my office. It truly made a difference. When Xiscan went out of business and my mother boards eventually died, I threw them out and didn't replace them. I am not up on the current fluoroscopes, but if they are anything like what I had, I highly recommend them.

The problem is the individuals representing the physicians are too weak to negotiate. It is time that we hire the best individuals who can represent medicine the way it should. We hold an important purpose in the grand scheme, but representation fails to realize this. They feel they take the high road by negotiating. There is no negotiation when it comes to the health of our nation. The day we realize this is the day we are able to command our reimbursement rates. Let’s hold our representatives' hands to the fire.
