QUERIES (DISABILITY INSURANCE)
Query: OOC Disability Policy 
 
I took out something called an own occupation (OOC) policy. I was told that if I became disabled from performing surgery, I’m able to perform office visits and orthotics, etc. and still be classified as 100% disabled as a podiatric surgeon. Now that I filed a claim, I’m being told something different from my disability company, UNUM. 
 
They are also stating that if a certain percentage of income is lost and I’m unable to perform surgery, but make up the difference in orthotics etc., that I’m not “disabled” anymore. Can anyone please recommend someone I can speak with regarding this issue.

Guardian, for example, says “True Own-Occupation: If you can’t work in your regular occupation but are willing and able to work in some other capacity, this definition means you can get your full benefit payment even while holding another kind of job. For those in a medical specialty, it is crucial to have insurance that accurately reflects the specialized nature of their careers. If the surgeon in the above scenario had disability insurance for physicians with this definition, he or she could take a teaching or consulting job and still receive replacement income for the entire benefit period.”

RESPONSES/COMMENTS (MEDICAL MALPRACTICE)

I took a 27 year old female to surgery and performed a tarsal tunnel release. She was slightly overweight with no co-morbidities. She was not a smoker nor on birth control.  There was no family history of blood disorders. Following surgery, she was ambulating in a CAM walker. About two weeks after surgery, I was contacted on vacation by her mother who was a nurse. She informed me of swelling in the surgical leg. I instructed her to take the patient to the ED, which she did. Her mother and I were both concerned about a possible DVT, and the mother informed the ED of such. She stated it was six hours in the ED before she was finally scanned positive for DVT.
 
Subsequently, she developed a PE and was intubated as non-responsive. I communicated with the mother on a daily basis and visited the patient in the hospital out of respect. About a month later, the decision to pull the intubation was made and she passed away. This was their only child and it hurt me deeply. I’ve always been vigilant about DVT and prophylaxis but don’t think I would change my position with the exact same case. Anticoagulation in a patient with no apparent concerns for DVT has its own risks. I must say, had a lawsuit been made, I would have settled regardless and not put that family through anything further.

For those who are unfamiliar with Landmark Worldwide, it is a spin-off from the previous "The Forum" which was a spin-off from the previous "EST - Ehrhart Seminar Training". I took The Forum back in the ‘70 or ‘80s and visited one "guest session" of Landmark Worldwide some 20 or so years later, invited by a neighbor. Recruitment seemed to be the main purpose of bringing guests. 
 
The seminars themselves, were intense at the time, everyone seated in person in tight rows, in straight back chairs, shoulder to shoulder for extended hours - like early morning to nearly midnight. No notebooks, no phones, no pagers, no tables, just seated in tight quarters, with limited "allowed" breaks for bathrooms. Seating was so tight that it was very difficult to leave and return. Leaving on your own for breaks was severely discouraged and you were required to sit in the same seat, next to the same people, for the duration of all sessions. It provided some good insights, but it could be very intense. 
 
It was also very high pressure, always encouraging current members to bring in new members. Of course, the special “guest sessions" were much shorter. It is only through finding new bodies that seemed necessary for the organization's survival. The new members brought were subject to high pressure tactics to join. It also seemed cultish to me.  I am not familiar with this new online version, probably dictated by Covid concerns. It could be entirely different since it does provide some physical separation and may have changed, but I suggest "guests" be cautious.
