Heelys Can Cause Tendinitis and Shin Splints: TN Podiatrist

Melvin Williams, a Murfreesboro podiatrist, said a person using Heelys has to keep the ball of the foot up to roll on the wheel. "People that do that are more prone to medial tibial stress syndrome, which is also known as shin splints, as a result of muscles in the front of the shin getting pulled off the bone," he said. "I have had about five (cases) in the last six months." The other injury he has seen from Heelys is tendinitis of the heel cords — stretching the heel cord from the heel bone.

His children ages, 15, 13 and 10, have never shown an interest in Heelys, even though one of them skateboards. "Even if they did, I wasn't going to buy them because I know what they can do," said Dr. Williams.

Williams is concerned about the use of free-wheeling Heelys in malls. "The big thing is stability issues and balance. If they lose control in the mall and public places, they could actually injure other people," he said. Children and youth wearing Heelys indoors don't seem to be wearing pads and helmets with them, even when the wheels are engaged, Dr. Williams noted.

Physicians Turn the Tables On Insurers, Attorneys

Most doctors named as defendants in medical liability lawsuits prefer not to relive the ordeal and seek to put it behind them immediately, no matter the outcome or how it is reached.

There is usually little recourse against your medical liability insurance provider if you are unhappy with the lawsuit's outcome. Physicians pay premiums in case they are sued, with the insurer usually retaining the attorney and approving, or not approving, settlement amounts and trial strategies. And it's hard to win either a malpractice claim against an attorney or a malicious prosecution claim against a plaintiff.

But in two notable instances in the past several months, physicians who decided to fight back have had some success. In Florida, physicians who were pounded with a $217 million jury verdict for failing to diagnose a stroke sued their attorneys who they believe should have settled the case. The lawsuit against the lawyers, filed in early March, has already been settled.

In another lawsuit filed by a physician who chose to fight back, the Massachusetts Supreme Judicial Court ruled late last year that a Woburn, Mass., neurologist can go forward with a malicious prosecution claim against The Travelers Insurance Co.

FDA Approves New Merck 2-in-1 Diabetes Drug

A 2-in-1 medicine to treat diabetes has won federal approval, Merck & Co. Inc. said Saturday. The tablet, called Janumet, combines a proprietary Merck drug with the older diabetes drug metformin. Some patients with type 2 diabetes already take metformin and the newer drug, called Januvia, separately. Merck hopes the combination version will make it easier for those diabetics to control their blood sugar levels.

The Food and Drug Administration approved Januvia in October. That drug enhances the body's own ability to lower blood sugar levels. Novartis AG continues to seek FDA approval for a competing but similar drug, called Galvus.

Query: Billing Insurance Carrier for “Free Examination”

I work for a podiatric medical group that advertises free exams. When patients come to the office, they are asked if they have insurance. If they do, we then charge their insurance company for the services provided. Is this practice legal?

Editor’s comment: PM News does not provide legal advice. We cannot comment on the legal aspect of this scenario, as the answer varies from state to state. We would like to point out, however, that under the APMA Code of Ethics, this practice would be considered an ethical violation:

BE1.31 The podiatrist, as an inducement to provide additional services for a fee, may advertise and offer free examinations or free podiatric medical services. The podiatrist shall not, however, charge a fee to any patient or any third-party payor for any podiatric medical service provided at the time that such free examination or free podiatric medical services are provided.

Under the interpretive guidelines, the following exception exists: “In the event that an urgent condition presents at the time of a free examination, reasonable charges for the treatment may be allowed upon written consent from the patient for the services and related charges.”
