At the live, in-person 2022 Commencement ceremony to be held on May 26 at Alice Tully Hall, the keynote address will be delivered by U.S. Representative Brad Wenstrup, DPM, who will receive the degree of Doctor of Science, Honoris Causa. Elected in 2012, in Congress Dr. Wenstrup serves on the House Committee on Ways and Means and the House Permanent Select Committee on Intelligence. He is also a co-chair of the GOP Doctors Caucus.

Let’s say a patient came in with acute plantar fasciitis and low risk treatment options were performed. Is it needed or advised to include sentences like these in the plan while documenting?
“The patient had an acute, uncomplicated illness or injury addressed today.”
“There is low risk involved with this pathology, testing, and its treatment considerations.”

Response: Documenting an E/M that is low risk in your example of acute plantar fasciitis is as follows. My plan that I would say: “Medical management: The etiology of the problem today is an acute plantar fasciitis, this is considered an acute injury. The plan of care involves a low risk of morbidity as the patient treatment recommended includes: stretching (which was demonstrated), ice or heat, elevation, and rest.”
To me, this fits your low risk CPT 99203/99213 patient scenario.

Osteomyelitis of the forefoot may be treated with antibiotics alone. This has been studied and published. Needless to say, some limited surgical bone reception or at a minimum confirmation of the pathologic bacteria is generally necessary. Nevertheless, to suggest an amputation is the “standard of care” implies that a failure to amputate a toe osteomyelitis is malpractice. I would caution members of our profession who throw out the term “standard of care“ in a cavalier manner. This is a legal term that can have very significant consequences.
I do not believe Dr. Chaskin is in position to determine the standard of care. This weekend, I participated in a seminar in which another podiatric physician stated that the standard of care in treating ulceration was utilization of acellular matrix grafting. I had participated in another seminar in which a different speaker suggested that the failure to utilize an orthobiologic in performing osteotomy or arthrodesis procedures was “malpractice”.
In short, be aware of the potential consequences of using the term “standard of care”. Remember, corporations do not set the standard of care. People who lecture or consult for various companies manufacturing products that might be used in treatment of patients do not determine the standard of care. Unfortunately, this is one of the consequences of corporate-dominated and corporate-influenced post-graduate education which dominates podiatry CME.

I would like to recommend two options when local anesthesia fails due to an infection. First, I think we should never cause intentional pain to our patients. All you need to do if a toe block fails is do a PT block and a deep peroneal block. Second, I use nitrous oxide with anxious patients or those that have a low pain threshold; it knocks down the anxiety and pain by at least 80%.

RE: Indicators for Durability of Bunion Corrections

Current SOTA bunion surgery aims for triplanar correction of the 1st metatarsal segment. The missing link for many years was lack of frontal plane correction because there were few procedures (old school DRATO; new school CoLink Vallux) that allowed a surgeon to address this obvious compensatory deformity with a distal osteotomy. The modern Lapidus procedure gets the job done but I often question the use of this somewhat complex procedure in mild-moderate deformities.
When I trained residents years ago, I always taught that reduction of the sesamoid position was the key indicator for surgical durability. I still believe this to be true even with uni- or bi-planar corrections (as in the many variations of the Austin procedure). I did not know about the "round sign" back then. Although Lapidus loyalists argue that this can't be true, I am here 40 years later to tell you that I have seen happy patients 10, 20, and 30 years following their Austin bunionectomies (with no frontal plane correction) with no recurrences.
I am in favor of advancing our surgical procedures. I am asking what today's foot surgeons are using as their primary indicators for durability of bunionectomies - IM angle reduction, sesamoid position, the round sign? And, how do you explain excellent durability without addressing the frontal plane?

I don't even recollect where we got the idea, but for 44 years, we used a 1% phenol solution quite effectively to softens nails and calluses. You can't buy it like that, but it is easy to calculate a 1% solution of "88%" phenol (0.88% actual solution). Just carefully add 1 cc of phenol to 99 cc of distilled water, place some in a squirter bottle, and apply liberally with 4x4" gauze pads draped on the corns and nails. No one complained of any burning or ill effects from that weak of a solution, even though it has a mild numbing effect to the periungual areas. The keratotic softening effect is evidenced by a thin whitish haze where it’s applied.

I agree with Dr. Kravitz, as I did not attribute fault solely on manufacturers; they are only part of the issue. Doctors are in the end responsible for their billing practices. As mentioned, these injections are not approved by the FDA nor by Medicare and insurance carriers currently as they are under trials as investigational new drugs (INDs). If Medicare states this, then most other carriers will follow. It's best to call or email Medicare directly as they will confirm my original message as per Dr. Peter Marks. My message is to help my fellow DPM colleagues. Please do your due diligence.
