WY Podiatrist Files to Run for Supreme Court Seat 
 
Dr. W. David Herbert, a Billings attorney who also is a licensed podiatrist in Wyoming, has filed to run for justice of the Montana Supreme Court. Herbert, 70, filed this week for the seat now held by Justice Jim Rice, who is seeking re-election. “I’m very concerned about the future of our constitutional republic,” Herbert said. He is a believer in jury nullification, or as he calls it, jury independence. Under that theory, a jury can acquit a criminal defendant if the jurors disagree with the law or believe it shouldn’t be applied in that particular case.
 
Herbert  was commissioned in the U.S. Air Force but retired as a lieutenant colonel from the U.S. Army medical department, putting in 28 years in active duty and reserves. He flew F-4 Phantom jets for the U.S. Air Force in Vietnam. He received a juris doctor degree from the University of Pacific, McGeorge School of Law, and a doctor of podiatric medicine from Kent State University.

QUERIES (CLINICAL)
Query: Hallux Tumor
 
A 37 year old  male with a history of testicular cancer in 2006 presented to my office with a chief complaint of a dermatological issue. As an aside, he also mentioned that he had recurrent hallux ingrown nail. He said that when he was in the service about 20 years ago, he was told that he needed a biopsy of the hallux after he was treated for an ingrown nail. Clinically, the hallux nail has a "humped” shape and the lateral border of the nail was slightly ingrown.

The hallux is about one third larger in size than the contralateral hallux. Radiographs were taken which showed an expansile type lesion at the distal phalanx of the hallux. My plan is to take a bone punch biopsy of the lesion. Is there any need to do a more aggressive resection of the growth at this time if the toe is relatively asymptomatic?

Query: Performing Dressing Changes in the Office
 
How often can you have a patient come to the office for treatment of foot ulcers and dressing changes if the patient can't change the dressing himself at home? What would be the correct billing codes (can you bill an E/M service code for each visit?) for the visits if you are having the patient come to the office two times per week?

Response: A patient who is unable to perform dressing changes (or doesn't have any family members or friends to help) needs to consider whether the home is the appropriate place to recover. If the patient is scheduled multiple times per week to come to your office for dressing changes, it is doubtful he would meeting the criteria for billing an E/M service. It is not the standard of care for the doctor's office to perform this service. And if it were, the supplies used in the office to clean and dress the would not be. 
 
I recommend contacting a home health agency which in turn can contact the patient regarding providing the service and its costs (and whether it is reimbursable by the patient's insurance plan). Most insurances have home health care benefits. Lastly, a local wound care center may have more options available to help you and the patient.

The photo shown shows two lesions that appear "sporotrichoid," meaning that they line up along the lymphatic drainage. Nevertheless, sporotrichosis, caused by a soil fungus, should be considered, especially with bilateral edema in a 14 year old. Tissue cultures (fungal) are also essential, as well as sampling for histology with special stains for fungus. Infection from scratches from vegetation, thorns, as well as transmission from infected cats, or dogs (case mentions patient has outdoor dog and cat) is possible. I would also get a TB screen and an ID consult.
 
The biopsies will also help rule out atypical mycobacterial infection, as well as non-infectious causes. Since in immunosupression, both atypical mycobacterial infection and sporotrichosis can progress to pulmonary infections, the patient should also have an immune screen. Both ID consult and immune screen should coincide with the biopsy results. Palpation for lymph nodes and a general full physical would also be prudent. I would not fly solo on this case.

I think a punch biopsy would be a good starting point. My initial thoughts are leaning toward vasculitis. I also recommend bloodwork and running a series of auto-immune tests like ANCA, ELISA, etc. plus CBC, ESR, CRP, and so on, and go from there with possible need for viral serology workup and imaging. Please update us.

Here are my suggestions: 
1) Take a tissue culture and special stains for mycobacterium (M. Avium), as this has been found in nail salons, and for deep fungal infections such as cryptococcus neoformans (found in immunosupresion).
2) Biopsy to R/O necrobiosis lipoidica diabeticorum and Sweet's syndrome (neutrophilic dermatosis).
