CA Podiatrists Opts for Re-Election to Ed Board Over Run for Supervisor
 
Allen O. Clyde, DPM a Fresno County Office of Education board member who announced earlier that he intended to run for Fresno County Supervisor Debbie Poochigian’s seat in November, said Tuesday that he is dropping out of the race. Instead, Clyde said, he will run for a fifth term on the Fresno County Office of Education on the November ballot. From 1987 to 1991, he served as a trustee for Clovis Unified School District. Clyde has a podiatry practice in Clovis. He also is a rancher near Tollhouse and operates Clyde Pack Outfitters.

“I enjoy medicine and my board of education seat, and I’m not ready to leave either one,” Dr. Clyde said. “Down the road, it may be a different story.” Clyde said he is now setting up his committee for re-election to the county school board.

INTERNATIONAL PODIATRISTS IN THE NEWS
UK Podiatrist Uses 3D Gait Analysis to Prevent Injuries
 
StEPS podiatry, which works with professional footballers and athletes, wanted to provide a service to help prevent injury by using an in-depth study of feet. Working with the University of Strathclyde, StEPS podiatry owner Dr. Vicki Cameron accessed highly specialized equipment including the Vicon Motion Analysis system, a 3D gait analysis machine which, in addition to video, uses micro-cameras to create a highly detailed 3D image of the foot.

A range of information obtained from the scan, such as arch height and the alignment of the Achilles with the leg, provided StEPS with valuable data which could be used in the development of Dr. Cameron’s preventative screening equipment. Dr. Cameron is one of the few independent podiatrists in Scotland trained in the use and interpretation of computerized three dimensional gait analysis.

KSB Hospital Residency Holds 3rd Annual Foot and Ankle Complication Course
 
On Saturday February 27th, the KSB Foot and Ankle Educational Foundation held its third annual Foot and Ankle Complication Course in Rockford, IL. With over 68 participants, the course entailed didactic complication lectures with lively discussion in the morning and hands-on cadaveric activities in the afternoon. All participants received 6 free CMEs in addition to being able to participate in the complication discussions and cadaveric activities.

The KSB Foot and Ankle Educational Foundation was established three years ago in conjunction with its residency to promote foot and ankle care for the greater Northwest Illinois area. "With an increase in attendance this year almost doubling from last year's number, I believe that participants are seeing the value of the diversification and variety of this course. They are receiving an awesome course at a fantastic price," states KSB Residency Director and past Chair of the American Society of Podiatric Surgeons, Dr. David Yeager.

CT Podiatrist Sentenced for False Medicare Claims
 
A Stamford podiatrist has been ordered to pay back three times the amount of money she stole by submitting false claims to Medicare and other health insurance plans. The U.S. Attorney’s Office in Connecticut says 53 year old Amira Mantoura of Greenwich has also been sentenced to three years probation. She also has to perform 200 hours of community service for knowingly submitting false claims for performing nail avulsion’s between 2009 and 2013. Court documents state that as a podiatrist she knew what a nail avulsion was and that she was not doing that surgical procedure to treat an ingrown toenail. The U.S. Attorney’s Office say overall Mantoura will end up paying $618,000 and she is now excluded from the Medicare program and can no longer submit federal healthcare claims.

ACA UPDATE
Obama Administration Backs Off on ACA Rules for 2017 Health Plans
 
In a major win for the industry, health insurers will not be forced to have minimum quantitative standards when designing their networks of hospitals and doctors for 2017, nor will they have to offer standardized options for health plans. The CMS released a sweeping final rule Monday afternoon that solidifies the Affordable Care Act's coverage policies for 2017. The agency proposed tight network adequacy provisions and standardized health plan options in late November, which fueled antipathy from the health insurance industry. 
 
Monday's rule relaxes those aggressive proposals, a move that likely will raise the ire of consumer groups that have pushed for stronger insurance protections for patients. It does, however, include some victories for transparency advocates. The federal government, for example, will now have to publish all changes to premium rates, not just increases that are subject to review.

HIPAA UPDATE
Feds to Begin Auditing Healthcare Providers for HIPAA Violations
 
This year, the federal government plans to begin audits to ensure compliance with privacy and security provisions under the Health Insurance Portability and Accountability Act (HIPAA). The audits signal a shift to proactive enforcement of HIPAA rules, in contrast to the past when the feds typically reacted to complaints of alleged breaches.
 
If you are a healthcare provider, far from the elaborate schemes of hackers, your greatest threat is more likely to be in carelessness or neglect. In recent years, the top two issues in the most serious HIPAA investigations related to: 1) Impermissible uses and disclosures of patient information 2) Inadequate safeguards. Often, violations get down to basic lapses in judgment, such as leaving computers containing patient information in unlocked rooms.

QUERIES (EMR)
Query: EHR and Drug Interactions
 
I am using an EHR that I really like. It shows up drug interactions as mild, moderate, or severe. It also tells what said interactions "could" be. But here is the problem: when I enter meds that the patient is taking into the EHR, and when it shows a possible drug interaction, whom do I call or what do I do next? This now seems to happen every day. The few times I called the pharmacies, they seemed to be appreciative, but I wonder why their software did not find the problem. Worse though, when I call the PCP, neurologist, etc, they are particularly unappreciative, even rude e.g. "thanks for the heads up," and hangup. What do I do going forward:  keep on banging the drum or against my Hippocratic proclivity, be quiet?

RE: DMEPOS Billing Privileges Can be Lost Through Inactivity

I would like to warn everyone of a nuance that will cost you the ability to bill Medicare for your DME. It was a painstaking process to obtain this privilege, and although I stopped providing diabetic footwear, we did not want to lose this privilege. Had I known the following information, 
I would have continued providing shoes for a selected number of patients. 
 
We received a letter from Palmetto GBA stating that they have received information from the National Supplier Clearinghouse (NSC) indicating that we have not billed the Durable Medical Equipment Medicare Administrative Contractor (DME MAC) within the last four consecutive quarters. 
 
As per 42 CFR 4214.540 (a)(1), the NSC is de-activating your Medicare billing privileges. To re-activate your DMEPOS billing privileges, you will be required to...

RE: Shortage of MD/DO Residency Positions

AAMC STAT, a bulletin of the Association of American Medical Colleges, announced February 29, 2016, that without an increase in GME support, there may not be enough residency positions for the additional medical school graduates needed to address the growing physician shortage. AAMC indicated that medical school graduates are having trouble finding residency positions since 412 did not match in 2014. Without congressional action now to lift the cap on Medicare support for residency positions, growth in the physician workforce will not keep pace with increasing demand.

With all due respect to Dr. Kass, I am in the dark. What exactly do you think that you should be able to bill for an office emergency? In order to bill an E/M service, three key components need to be addressed, assuming that this is a new patient. They are history, examination, and medical decision-making. A podiatrist can perform the appropriate levels of history and medical decision-making. Where podiatrists fall short is the examination component.
 
The examination component is NOT based upon what you can examine, but what you are LICENSED to examine and treat. We are limited scope practitioners. We can only evaluate and manage a presenting problem based upon our scope of license. We can’t treat and bill for a cardiac issue. An MD can certainly bill for an office emergency. An MD is not a limited scope practitioner. This is tantamount to a pregnant lady going into childbirth in the waiting room of a podiatrist. If the podiatrist delivers the baby, can the podiatrist bill for that service? I think not.
