PA Podiatrist Honored for Distinguished Service by ACFAS
D. Scot Malay, DPM, MSCE, editor of the American College of Foot and Ankle Surgeons’ (ACFAS) Journal of Foot & Ankle Surgery (JFAS) was recently honored with the College’s highest award, the Distinguished Service Award. Dr. Malay received his award at ACFAS’ Annual Scientific Conference in Austin, TX.

Dr. Malay is currently the director of podiatric research at Penn Presbyterian Medical Center, and is on staff at Penn Podiatry University City. He is board-certified in foot surgery and reconstructive rearfoot/ankle surgery. Dr. Malay took over as editor of the Journal of Foot & Ankle Surgery in 2006 and announced his retirement this year. Naohiro Shibuya, DPM, MS, deputy editor of JFAS, will replace Dr. Malay as editor in May.

OH Podiatrist Discusses Conservative Vs. Surgical Treatment of Bunions
According to Lance Johnson, DPM, “In evaluating a bunion, your practitioner will likely examine your foot structure, examine your big toe joint, and order x-rays of your foot. Bunions are progressive and can become larger over time. Treatment options include both conservative and surgical options. Conservative treatment options focus on symptom relief. They include footwear modification (wearing shoes with a wider toe box or special padding), activity modification, over the-counter pain medication, topical medications, icing, injections, and orthotics.”

“If conservative therapy fails and the pain caused by the bunion interferes with work or activities of daily living, then surgery may be an option. There are a wide variety of bunion procedures depending on the severity of the bunion, your foot structure, and presence of arthritis in the big toe joint or surrounding joints. Surgery focuses on getting rid of the bump and realigning the bones around the big toe joint, either with bone cuts or joint fusions. Pins, screws, and plates may all be used to help hold the correction in place. Recovery time will vary based on the procedure selected by you and your surgeon. Non-weight-bearing recovery for the affected foot can range from three to eight weeks,” says Dr. Johnson.

Coding Mistakes That Cause Practices to Lose Revenue
These are only five areas of improper coding that lead to lost revenue; however, focusing on this list should make a significant, positive difference for the financial and operational well-being of your medical practice.
5. Inaccurate Utilization of Modifiers
The largest errors are the improper use of modifiers -25 and -59 to expand treatment, which can lead to audits and clawbacks. Modifier -25 should be appended to an E/M code to report a significant but separately identifiable additional service rendered during the encounter, such as an injection. Modifier -59 is used to identify procedures/services other than E/M services that are not normally reported together but were appropriate to render under the circumstances.

Query: Medicare TPE Review
I received notice I am being selected for a TPE (targeted probe & education) review by Novitas Medicare. I practice in New Jersey. I have gone over the LCDs and the “educational” materials they sent. My documentation seems to be aligned with what they want. Any advice for working with them to have this resolved as soon as possible? Any things to avoid? Should I have someone other than myself act as a liaison between Medicare and me?

Response: I am currently handling a large number of TPE audits across the country. Almost all of them relate to CPT codes 11720-21, 11719 and 11055-57. These are typically pre-payment audits, meaning that following receipt of the notice of review, the doctor will get 20-40 separate Additional Development Request (ADR) letters asking for copies of medical records for claims that have been submitted but not yet paid/denied by Medicare. This initial group of ADR letters is considered to be “Round 1” of the TPE audit. If the doctor gets a passing score on Round 1, the audit ends; if the doctor fails Round 1, the Medicare contractor offers an opportunity for an “educational call” with the doctor and allows a period of time for corrective action to be taken. After that, Round 2 begins and the doctor will receive 20-40 more ADR letters and the process repeats itself in Round 2 and potentially Round 3. If a doctor fails all three rounds, there will likely be a more serious and expanded audit by another contractor, such as a Program Integrity contractor. This would potentially be a large extrapolated audit and involve many services and potentially a large overpayment. Obviously, you do not want this to happen.
When I am assisting a doctor in a TPE audit, the goal is to pass in Round 1 and end the audit quickly. I use coding consultants to review the doctor’s records so that we can identify documentation problems and fix them going forward. Note that we cannot change existing chart notes, but we can correct and improve documentation going forward. One problem is that different TPE auditors have different...

RE: Covid Vaccine-Related Injuries

In my practice, I am seeing a few Covid vaccine-related pathologies. These can present in a wide array of symptoms ranging from neurologic to vascular to arthritic pathologies. While listening to a group of Canadian doctors, I learned about using a D Dimer test to help in the diagnosis of these adverse events from the Covid vaccines. The MRNA vaccines inject a spike protein that is a small (and the most disease producing) part of the initial virus that was uploaded from multiple sources from around the world in late 2019. The spike protein is hidden in a nanolipid hydrogel that goes throughout the body and can even pass the blood brain barrier, and start producing these spike proteins different tissues.
Due to this widespread distribution and production of spike proteins, the symptoms can be varied in nature. These spike proteins seem to be designed to aggregate to endothelial cells in tissues, such as the lining of the microvascular tissue. They seem to be attracted to the...
