APMA STATE COMPONENT NEWS
MPMA Celebrates 100 Years of Serving our Communities

In 1914, eight doctors formed the Michigan Podiatric Medical Association (MPMA). Their founding document stated the purpose of the organization was to “improve the profession, safeguard the public and encourage scientific investigation.” Over the past 100 years, the mission of the MPMA has remained unchanged!

(L-R) Drs. Scott Hughes (MPMA immediate past president) and Ali Safiedine (MPMA president)

On Saturday, February 8, the MPMA hosted a black tie event that highlighted the rich history of podiatric medicine in Michigan, and a keynote speech was delivered by past-president Dr. James Simonds. Representative Peter Lund received an award for his support and contributions to podiatry.  Leaders from the American Podiatric Medical Association, Michigan State Medical Society, and the Michigan Osteopathic Association were also part of the grand celebration held at the Henry Ford Museum in Dearborn, Michigan.

PODIATRISTS AND SPORTS MEDICINE
Weak Links in Alignment Can Lead to Overuse Injuries: IL Podiatrist

A journey of 1,000 miles starts with “that first step.” So it is with sports. "It starts with the feet — running, jumping, starting, stopping, and balancing. Virtually all movement involves your feet and their ability to do some amazing things. Often taken for granted, the foot is a mechanical marvel designed to perform some specific functions during the so-called gait cycle," says podiatrist Dr. Robert Weil .

Dr. Robert Weil

Examination of the individual standing, walking, or running can reveal specifics about these foot positions and mechanics. "Identifying weak links in the alignment of the foot, ankle, knee, and hip structures can be very valuable in preventing overuse injuries. Stability tests like single-leg balance and squat positions can give good information," says Weil .

PODIATRISTS AND THE INTERNET
NJ Podiatrist Added as Expert on Health and Wellness Site

Pazoo.com has announced that it has expanded its number of Health and Wellness Experts who share their knowledge, insight, and expertise with pazoo.com visitors. The latest addition to the pazoo.com expert section is podiatrist Dr. David Pizzano.

Dr. David Pizzano

Dr. Pizzano was born in Italy, where his father was a physician. He moved to the U.S. and graduated from the New York School of Podiatric Medicine in 1993, followed by a two-year podiatric surgical residency in New Jersey at Union Hospital and Saddle Brook Surgicenter.

HEALTHCARE NEWS
Beware of Schemes to Circumvent Stark Law

The Stark Law Statute defines a “circumvention scheme” as an arrangement or scheme (such as a cross-referral arrangement) that the physician or entity knows or should know has a principal purpose of assuring referrals by the physician to a particular entity which, if the physician directly made referrals to such entity, would violate the Stark Law, and is subject to a civil money penalty of not more than $100,000 for each such arrangement or scheme.

It is the fundamental nature of the scheme, not clever semantics or “layering” of an arrangement which counts. In sum, if you are presented with an opportunity to earn passive income through the investment in an ancillary service provider, seek the help of an experienced healthcare lawyer. Circumvention schemes, no matter how cleverly structured, can be very risky, and the consequences devastating.

QUERIES (NON-CLINICAL)
Query: Snow Days Policy

I am interested in how others handle "snow days" in your offices in regard to paying employees? We have now had to close five days over this month.

Tom DeBenedictis, DPM,  Union City, NJ

RESPONSES/COMMENTS (CLINICAL)

This may seem overly obvious, but that is clearly ringworm. I have had numerous cases exactly like this, and this condition was present for a year. It clears with antifungal. I use Tineacide. Due to the long presentation, you may see hemosiderin discoloration for several months, slowly fading, after the condition clears.

RESPONSES/COMMENTS (EMR)
From: Raymond F Posa, MBA

Dr. DeVito brings up a very important issue that many users are facing today. Many EMRs are moving toward a cloud-based model. The cloud model offers many advantages such as lower infrastructure cost (no server to purchase and maintain), the EMR company can handle all of the updates and patches and does your backup for you. So for many, the ease of ownership is appealing.

One very important item that gets overlooked when entering into a cloud EMR is the exit plan. When we buy a new software program we only think about the good it will do for use and we...

RESPONSES/COMMENTS (ERRATUM)
RE : Erratum - Codingline Particulars (February 2014 PM)
From: Harry Goldsmith, DPM

In my article, “ICD-10 Preparation Timeline (January, February, March): Here’s what you should be doing now” (Podiatry Management; February 2014) an error was pointed out to me. On page  51, top of the second column, I was discussing “the 7th character” and provided a sample list of the common 7th characters for the initial encounter, subsequent encounter, and sequela. I did not see that my computer automatically formatted the A, D, and S characters into ascending order of A, B, and C.  I apologize for this error.  The paragraph should read:

“S” and “G” codes will require 7 characters to correctly complete the code.  The “7th “ character) denotes
            A  An initial encounter
            D  A subsequent encounter
S  Sequela (definition: an abnormal condition resulting from an illness or injury)

RESPONSES/COMMENTS (PM JURY VERDICT REPORTER) - PART 1A
From: Brian Kiel, DPM

I disagree with Dr. Katzen that a podiatrist should never testify against another podiatrist. To make a sweeping statement like that is not appropriate. I agree that it is wrong for a podiatrist or any physician to make a living as a plaintiff's expert witness. As we all know, there are people like that and that they will say anything to make a buck. However, there are instances when the acts by someone were so egregious that it would be unethical to refuse to evaluate or testify in a case. In a case where someone has to leave the office to do so and not get compensated for that time is unfair. To never testify against another podiatrist just because he or she is a podiatrist can be harmful to the public and allows those who might perpetrate repetitive malpractice to continue to practice unpunished.

RESPONSES/COMMENTS (PM JURY REPORTER) - PART 1B
From Ira Baum, DPM

I have great respect for Dr. Sherman; he is a true innovator in podiatry. I understand his thought process regarding podiatry testimony and depositions with a peer review process because podiatric testimony and depositions are being scrutinized, but we cannot define ourselves by others' actions. Therefore, if no other professions have peer review of their expert witnesses, then I don’t think podiatry should either. The only caveat to my position would be if podiatry believes that this is an innovation in the protocol for all testimony and deposition for all medical legal cases. If that's true, then we can be considered trend setters.
