Concierge Medicine Practice Considerations
 
A concierge practice can be a lucrative way for a provider to achieve work-life balance by reducing the number of patients, increasing time with patients, and making great profits. But before you transition, speak with an experienced attorney who can help the transition. Here are some possible pitfalls:

Understand how Medicare addresses concierge medicine. As for governmental healthcare programs, Medicare providers may engage in concierge services if the provider complies with Medicare regulations and the terms of assignment agreements, most notably the requirement to not charge Medicare beneficiaries extra for services already covered by Medicare.
 
Medicare’s concerns about concierge medicine and assignment agreements are outlined in a 2004 Office of Inspector General (OIG) advisory opinion alert titled “OIG Alerts Physicians About Added Charges for Covered Services — Extra Contractual Charges Beyond Medicare’s Deductible, Co-insurance: A Potential Assignment Violation.” Medicare providers should also review federal authorities for civil monetary penalties.

I suggest running blood work to identify any other known causes of neuropathy. I had one patient recently that had neuropathy without any known predisposing conditions. When I ran a lab panel for potential systemic etiologies, he tested positive for high levels of mercury. Neither his primary doctor or the physiatrist could identify the source. The physiatrist suggested and referred him for chelation therapy, but the patient declined due to cost. I have no experience with a patient undergoing this treatment so I wonder if it would be effective. I did ask him about tuna consumption and it turns out he does eat an excessive amount; I think it was daily but I don't recall. Obviously he was told to stop.

We use Elavon. They have a reverse fee program. They charge the customer the credit card fee. We inform the patient of the fees and offer other payment options. We get charged a monthly flat fee for their equipment. We have saved thousands of dollars in credit card fees.

In response to a recent letter reflecting how much the Good Feet Store charges for inserts, it is my experience that they now charge about $1,500 for three different sets of pre-fabricated inserts matched to the patient after performing their manner of examination. Each pair is purported to be for a specific reason/activity/purpose.
 
On occasion, I will have a patient who has been in my practice for years show up one day complaining of continued heel/foot pain after having gone there and gotten these inserts with no improvement. I quit asking why they didn't come to me first, because what's done is done. Most of the time, the story goes that they developed the foot pain for which they got the inserts and went there because they thought they would help. And they must help an awful lot of people because there are franchise stores...

As much as we all know that The Good Feet Store (TGFS) is practicing podiatry without a license, it is difficult to do anything about TGFS. Complaints to the podiatry board or medical board often fall on deaf ears. The boards have no influence over TGFS since boards only intervene with licensed professionals. One might accuse TGFS with practicing podiatry without a license but the podiatry board is essentially impotent. 
 
Practicing podiatry or medicine without a license comes under the aegis of the law enforcement branch of the government after a board determines the law was broken. Hence, the police or sheriff would have to arrest the owner of the store or the dispenser of the orthotic for practicing medicine, go through a legal process, and issue a fine or short jail term for a first offense. Actually, I defer to the DPM/JDs in the profession to correct me, but this is what I've been told is the process in most states. Pushing readymade orthotics doesn't really endanger the public like practicing plastic surgery without a license and is not worth the legal effort.

The Good Feet Store discussion is not about competition for the orthotic business. Realistically, our exhibit halls have long been populated by those selling “pre-fabs", as it were. Many podiatrists dispense such non-custom pre-fabricated inserts in their offices. Thus, the concept of using such inserts is not unique to the Good Feet Store chain.
 
My concerns are the following:
 
1. A patient going to the GFS for “orthotics“ more likely than not is suffering from some foot or ankle, or lower extremity pathology, for which they are seeking relief. They are essentially diagnosed and treated by other than a podiatrist. It would be implicit that some of these patients have pathology that requires treatment beyond a simple, pre-fabricated...

It's unlikely any of our organizations will take action to neutralize misleading practices by establishments like the Good Feet Store. It's not sensible for any legitimate podiatrist to support their methods. We all know that many patients with generic foot issues can benefit from over-the-counter inserts costing less than $100. Over 30 years ago, when I was a new delegate to the CPMA, I proposed a resolution to tackle this issue, which received support from the then-presidents of both CPMA and APMA. Both of them visited a local store to investigate and reported that the staff was essentially practicing medicine without a license, in their opinion. 
 
The store’s marketing at that time included claims disparaging traditional orthotics from podiatrists. They may still. At the Western CPMA conference, where I had proposed the resolution, I was astonished to see a Good Feet booth and a sign-up sheet for potential franchisees, attracting interest from many notable figures. The resolution ultimately did not lead to any action. I suspect quite a few “influential” podiatrists might be investors or franchisees in such stores or have some financial relationship. It is doubtful that our Associations would intervene in this matter, so we need to be vigilant and address such deceptive practices and questionable opinions in our professional and patient interactions as well as platforms like this one.

RE: Podiatrists Say the Darndest Things
 
"I smashed my left pinky toe into a door frame, hurt like a mother. Went and got it x-rayed and yep, fractured. A month later, I’m at a routine podiatrist visit, and my toe is swollen, and the toenail is black. I’m explaining to the doc that I fractured it. He looks closely at my mangled little piggy and says seriously, 'Yeah, you’re going to lose that toe'."
 
"What?! In about 3 seconds, I went through the shock of losing a toe, acceptance of losing a toe, and determination to continue living without a toe when the doctor says…,'Sorry, I mean toeNAIL. You’re going to lose that toenail'.”
