Healthcare Additions in Budget Law Pleasantly Surprise Providers
Congress' long-awaited budget deal, passed before dawn last Friday, serves as the most significant piece of healthcare legislation since President Donald Trump took office. The extensive healthcare package, hammered out largely behind closed doors in the Senate, in many ways took Washington by surprise.
Among its provisions were an extra four years of funding for the Children's Health Insurance Program, a repeal of the Affordable Care Act's Independent Payment Advisory Board, and a provision to accelerate the closure of what's known as the Medicare Part D "donut hole" for seniors.

What You Need to Know About Office-Based Surgery Laws - Part 4
4. States also differ with respect to operational and regulatory requirements, such as surgery time limits, procedure-specific limitations (e.g., maximum percentage of body fat removed during liposuction), the level of life support certification required for staff members, additional continuing medical education (CME) requirements (e.g., mandatory CMEs on anesthesia), and credentialing or board certification or eligibility requirements for practitioners.
Some states, such as New York, also require post-procedure incident or adverse event reporting to a state regulatory agency. Although some states oversee OBS compliance internally (e.g., department of health), many states require or encourage OBS practices to achieve compliance by obtaining registration with the Centers for Medicare & Medicaid Services (CMS) or accreditation from an approved agency.

Query: Dorsal Exostectomy
I have a patient with spurring on the dorsal midfoot area. I will not be fusing it. I am first trying to remove the spurring (exostectomy) at the tarsal-metatarsal joint area. What code should I use?

Response: The most appropriate CPT code to use for a procedure that is performed to “remove the spurring (exostectomy) at the tarsal-metatarsal joint area” is: CPT 28122: Partial excision (craterization, saucerization, sequestrectomy or diaphysectomy) bone (eg. osteomyelitis or bossing); tarsal or metatarsal bone, except talus or calcaneus.

RE: The Passing of David Bruce Wright, DPM
David Bruce Wright (1930-2018) graduated from Rosalind Franklin University of Medicine, Dr. William M. Scholl College of Podiatric Medicine and Surgery in Chicago, as the valedictorian of his class. Dr. Wright entered the U.S. Army and was stationed at Walter Reed Medical Center, Orthopedic Services in Washington D.C.

Upon leaving the Army, he returned to Battle Creek with his wife Lou Ann and joined his father in practicing podiatry. David continued to practice podiatry in Battle Creek until his retirement in 1985. Dr. Wright was a lifetime member and past president of the Michigan State Podiatric Medical Association and served as president of the podiatric division of the Michigan Department of Licensing and Regulation.

RE: The Passing of Harry Goldsmith, DPM
In the words of Sir Isaac Newton in 1675, "If I have seen further, it is by standing on the shoulders of giants." Dr. Harry Goldsmith is one of those giants referred to. Every podiatric physician who has practiced in the last 30+ years, and all future practicing podiatrists, will benefit from the life and efforts of Dr. Goldsmith. His contributions to our profession are profound and overwhelming. And yet those who had the pleasure of interacting with him all thought they knew him personally. We all called him "Harry", and his gentle style allowed us that pleasure.
Harry has been the "face" and embodiment of our profession to many powerful agencies (State and Federal government), large insurers, local organizations, professional societies, and individuals for his whole career. We all owe him a huge debt of gratitude. In our sorrow and remembrance, we can take solace in the fact that we, as a profession and individually, had the opportunity and the time to get to know Harry, and come away as better people. He will be sorely missed.

There are two distinct reasons of why a physician may prescribe opioids. One is for acute post-op pain and by in large the government would not seek to penalize a surgeon for this. The other is prescribing opioids for pain caused by a chronic condition. For the latter, it is best to defer such patients to pain management specialists who seem to have greater leeway than the average doctor in prescribing narcotics for pain management.
A close friend of mine who is an outstanding hematologist and oncologist was called into the ER of a major teaching hospital to attend to a patient having a severe bout of pain secondary to sickle cell anemia. He prescribed an opioid and was reported by another staff member to a government agency, and he was soon brought up on charges of inappropriately prescribing the drug in question. He was able to prove in court that he did the right thing, but lamented to me that the cost of his proving that he was right saved his medical license but cost him over 50 thousand dollars in legal fees.

Did anyone else using Practice Fusion receive such a phone call, or other such correspondence? I have been using them for many years and haven't heard anything yet (but keeping fingers crossed). I would think that written (email or regular mail) notification would be the proper way to let us all know. Was the call confirmed to be from Practice Fusion?
I have received multiple deceptive sales calls in the past from one company pretending to be another. It also seems odd for a company to buy Practice Fusion and immediately alienate all the practitioners at once who helped build it to the size it is now, thereby risking a large number of the doctors they paid big money for.

Thank you, Steve Musser, for reiterating four factors that the DME "police" would look for if and when they come to evaluate your office. Please be aware that some of these visits are unannounced.
A number of years ago, one of our colleagues in Cleveland took a day out of his office for a religious holiday. That happened to be the same day that the inspector picked to make an unannounced visit. I may not have the whole story, but I will tell you that this physician lost his DME license allegedly because he did not have a sign that said "closed today."
