8 Tips for Avoiding Employee Handbook Crises
 
Many medical practices have an employee handbook, or employee policy handout, but fail to update them on a regular basis. There have been a large number of changes to employment law over the past couple of years. Here are some items you should be sure to include:
 
7. Vacation, sick leave, and personal time off (PTO)
 
Does your handbook explain specifically how these will be calculated? Whether you choose vacation and sick leave in your business or PTO, you need to document how they will be calculated and when the employee will be eligible for these benefits. The handbook should also state whether any benefits can be carried over at the end of the year, or if employees must use or lose benefit time. If your policy allows some leave time to be carried into the next year, then that should be specified in the handbook. It should also address whether leave time survives termination of the employee.
 
The handbook should not spell out the specific insurance coverage for healthcare. It should only specify that you offer health insurance and a 401K plan if you offer that. The handbook should tell the employee when they are eligible for benefits and have a statement that the benefits could change at any time. Each year you should give the employees a separate benefit document that covers the specific information about insurance coverage and scheduled vacation days. That way you can modify as needed without requiring employees to read and sign the entire handbook again.

CODINGLINE CORNER
Query: Replacement Device Needed
 
I recently had a patient who had a brace fabricated by another provider. I do not feel the brace is helping her in the correct manner and I feel she would benefit greatly from a different type of brace. Since this other brace was recently dispensed (and I assumed billed for), insurance will not cover a new brace so soon. What should I do about reimbursement? I know my friend Dr. Poggio is sitting at his desk using his favorite 4-letter word… CASH. However, this patient would not be able to afford new braces. Are there any other options? Would I need to know the exact codes this other provider used? I assume I am out of luck on this one but I am hoping someone has an option for me.

Response: By “brace,” do you mean an ankle foot orthoses (AFO)? If you are dealing with Medicare, then you will expect initially to have the replacement AFO denied. As you are aware, CMS/Medicare has the reasonable useful lifetime (RUL) at 5 years for AFOs. However, you can relate how the prior AFO did not match or functionally correct the deformity, what was significantly different, and that there is a different condition that needs to be addressed that the original did not address. You might win that on appeal through reconsideration.
 
If you continue to appeal to the QIC, they typically rubber stamp the MAC and will also deny. My experience is that typically you have a better chance of winning at the ALJ level. The ALJ will inquire if you executed an ABN? I have had this scenario turn into a favorable experience. The ALJ will identify the previous device as outlined by you, that it was not appropriate for the condition you diagnosed, and that your device was significantly better. Have the patient get on the call when you are in front of the ALJ and say how the previous device did not work and give the reasons why your device worked. In such cases, I have seen the ALJs rule in our and the patient’s favor. They will in turn make the MAC pay for the replacement device. Understand that this can be a long road to win, but you have a good shot!

When Practice Fusion first began, it was free. As soon as they amassed a critical number of clients, they sold out to a much larger company and the new company started charging monthly fees. As the saying goes, "there are no free lunches" out there. Hence, you can use a free program but be prepared for there to be an eventual charge, or worse... with the company going out of business along with your patients' medical records.
