8 Tips for Avoiding Employee Handbook Crises
Many medical practices have an employee handbook, or employee policy handout, but fail to update them on a regular basis. There have been a large number of changes to employment law over the past couple of years. Here are some items you should be sure to include:
2. At-Will Employment - If your state has an at-will employment law, you should also have a statement that the handbook cannot be considered a contract and that you have the right to make changes in an employee’s status whenever you feel necessary.
The National Labor Relations Board (NLRB) has been critical of these statements in 2016, stating that at-will statements may limit the employee’s right to engage in activity to challenge their at-will status. In other words, the employee might want to negotiate a contract that gave them better benefits or wages. So your statement should include that only the head of the company or organization can negotiate a change in an employee’s at-will status. The word permanent needs to be removed from your handbook. An example might be a statement that after probation, the employee would become a permanent full time. That can be construed as generating a contract, so don’t use it in your handbook.

Query: The Post-Operative Period
Our office has recently switched from using the -79 modifier on post-operative cast changes (CPT 29405) to a -58 modifier, since the cast change is an expected and staged procedure. Does this then change the post-operative period to 90 days from the casting, instead of 90 days from the original surgery? Or does it not affect the actual post-operative period and it remains 90 days from the surgical procedure?

Response: Cast applications in the post-op period do not require a -79 or a -58 modifier to get paid. The first cast is inclusive to the global surgical CPT code if billed on the same day. The global period will not re-start because splints and cast CPT codes have zero global days; as such, the global days cannot be reset or re-started.
