It is with great sadness that we must report the passing of Bob Levoy. Bob was a giant in the field of practice management. He was the author of 7 books, the newest of which is 222 Secrets of Hiring, Managing and Retaining Great Employees in Healthcare Practices published by Jones & Bartlett. He a regular columnist for Podiatry Management and was inducted into the PM Podiatry Hall of Fame in 2012. PM News extends condolences to his wife Martha. Bob will be sorely missed by the entire podiatric community that he served so well for over four decades.

Because they cannot feel pain, many people do not realize they have Charcot foot until the late stage, when severe complications have occurred. "People think they don't have a problem because they feel no pain, but that isn't the case," says Valerie L. Schade, DPM, FACFAS, FACFAOM, a foot and ankle surgeon in Tacoma, WA. and a Fellow Member of ACFAS.

"Anyone at risk for neuropathy, including diabetics, alcoholics, and some chemotherapy patients, should see a foot and ankle surgeon early and at least once every year, even if they are considered low risk," says Dr. Schade.

VA Podiatrists Team Up with Salvation Army for 34th Annual Shoe Drive
 
The salvation army and local podiatrists are coming together for the annual "Shoes For The Homeless" campaign. The project provides foot protection to local community members by offering free shoes to those in need. The campaign began in 1990, and this year marks the 24th annual Shoes For The Homeless project.

"Unfortunately, we have people who are just making ends meet, people who can't afford to have proper shoes," says local podiatrist Dr. Samuel Schustek. "Being podiatrists, we see terrible things happen due to cold and improper foot gear, whether it be cold injuries, sores, or infections."

EHR Use Does Not Result in Coordinated Care
 
Although more than 70 percent of U.S. doctors use electronic health records, up to half don't routinely receive the data necessary to coordinate patient care effectively. That is the conclusion of a study published in Medical Care. “The study findings highlight the continuing challenges to using health information technology to coordinate care among providers," said lead author Chun-Ju Hsiao, of the U.S. Agency for Healthcare Research and Quality.
 
Doctors using Health Information Technology (HIT) were only slightly more likely to receive the necessary information than those who did not use HIT. For example, 48 percent of physicians who used HIT routinely received information on patients referred from other practices, compared to 40 percent of those who did not use HIT. Using HIT did not significantly affect receipt of hospital discharge information. Even among physicians who routinely received the needed information, many were still getting it by fax or other non-electronic means. This was the case for three-fourths of doctors receiving information from other practices, and about half of those receiving hospital discharge information.

Isolated Rash
 
This is a 21 year old female, with well controlled IDDM. There was acute onset which was pruritic. It is no longer pruritic and is not raised. It is approximately of 7 days duration now, This lesion is not present anywhere else. This patient presently takes Synthroid. Her neurological, orthopedic, and vascular exams was normal. Suggestions?

Query: Communication Between Treating Physicians and Privacy Laws 
 
I had a patient who requires surgery. When he called to schedule, he informed my office that just several weeks prior, he had had either a “small stroke or a seizure,” On that basis, I declined to schedule his surgery until I had more information from the treating physician. He has no family physician and is refusing follow-up. I received a telephone call from this same patient telling me if I did not book his surgery, he was going to go see Doctor X who would. Do I have any obligation to Dr. X, whom I know to be a good and ethical surgeon, who would never book a case with a “possible small stroke or seizure” that has not been followed up? If I call Doctor X, am I violating privacy laws? Is there any safe way to protect this patient from himself, not to mention protecting the other doc?

Editor's comment: PM News does not provide legal advice. Communications between treating physicians are allowed under HIPAA and most state privacy laws. The ethical thing to do is first to call Dr. X and make sure that he or she is actually treating this patient. If this, in fact, is the case, under most state laws, you would be legally obligated to inform Dr. X of the patient's status.

RE: Medicare Reductions

When I signed a contract with Medicare 25 years ago, it said I would get paid from them 80% of what they approve. Any amount deducted from the approved amount like co-insurance and deductable is billable to the patient. It did not say they would pay 80% unless the govt. was low on funds, you didn't use computers, or you didn't use computer prescriptions. I'm not an attorney but a contract is a contract. Why aren't other doctors billing the 2% "sequester", etc. to the patients? Did other contractors with the govt. get cut 2%? Did govt. employees get cut 2%? The answer of course is no. None of these reductions are noted in our Medicare agreement. Why isn't the APMA or other organizations suing on our behalf? Am I missing something here?

The incentive is for using certified technology and meeting meaningful use. It is for the provider who met meaningful use. That being said, the money can be assigned to any entity. In order to attest for you, the group must have access to your PECOS username and password. The only way they have this is if you provided the group with this information.
 
In many cases that I have encountered, there was some sort of agreement between the group and the employed podiatrist. The group has access to all of the documentation necessary to allow you to attest for meaningful use, and you have access to your PECOS credentials. Generally, I would advise against giving out your username and password for any account as important to you as the PECOS, In the situation you present, much depends upon your employment agreement. This situation can get even more complicated when a provider works part time for different groups and the data from each group must be aggregated to allow a provider to attest for meaningful use.   
 
It is possible that some time in the future, you will be audited for that meaningful use attestation. If you do not have all of the necessary documentation to pass the audit, it is YOU who will be responsible for refunding the incentive payment to CMS. It is imperative that you obtain copies of all documents necessary to respond to an audit now, because if you leave that group it can become difficult to get the documentation in the future. You may wish to consult with an attorney to properly protect yourself in case of potential future audits.
