ACE USA and RPS Healthcare Expand Podiatrist Professional Liability Coverage

The Patient Protection and Affordable Care Act and Centers for Medicare & Medicaid guidelines and rules resulted in a record number of investigations and enforcement actions in 2011. ACE Medical Risk, a division of ACE USA, has responded through an endorsement that increases limits on Medicare/Medicaid legal expense reimbursements, raising coverage limits from $30,000 to $50,000 per action, with an annual aggregate of $50,000. This product is underwritten by companies within the ACE Group, an A.M. Best “A+” rated carrier, and is offered to podiatrists exclusively by RPS Healthcare, National Program Administrator of the Podiatry PLUS programs and one of the largest wholesalers and the largest Managing General Agent in the country. PODIATRISTS AND SPORTS MEDICINE
Minimalist Shoes Require Break-in: AZ Podiatrist

Runners should take time to break in their new shoes before running in earnest, Dr. David W. Jenkins, professor at the Arizona School of Podiatric Medicine of Midwestern University in Glendale, said. "If one is to begin running in minimalist footwear, one needs to break in the new footwear for many weeks before training in earnest," Jenkins told Reuters Health.

Dr. David Jenkins

"Some sources have suggested at least 6 weeks and what I suggest, break them in for a few weeks just walking around before even attempting to wear (them) running, and then do the slow 6-week build-up in miles," he said.

QUERIES (CLINICAL)
Query; Crossover 1st and 2nd Toes in 14 Month Old

My patient is a 14 month old male, sent by the pediatrician for crossed 1st and 2nd toes. He recently started wearing shoes, and he seems uncomfortable when the shoes are on. The parents moved him into larger shoes, but he slides out of them.

Crossover 1st and 2nd Toes in 14-Month Old

According to the pediatrician, the child is otherwise healthy and has had normal childhood development and reached milestones appropriately. I'm looking for appropriate treatment ideas, or where the child can be referred for appropriate treatment

QUERIES (NON-CLINICAL)
Query: X-Ray Poser Box

Does anyone know of a source for an x-ray poser box. Schein has one, but it is too small.

CODINGLINE CORNER
Query: Billing Toe Filler Insert

I dispensed a pair of diabetic shoes to a patient with a digital amputation on one foot. I billed the following:

L5000-KX, A5513-KX as 3 separate line items.

The A5513 was paid, the L5000 rejected as "inappropriate, invalid or missing modifier." Any suggestions?

Bryant Tarr, DPM, Sudbury, MA

Response: You're actually fortunate to have been paid for the A5513 as that requires an "LT" and "RT" modifier in addition to the "KX" modifier.

As for the L5000 (partial foot, shoe insert with longitudinal arch, toe filler), this must also have the correct anatomical site modifier ("LT", "RT") appended.

RESPONSES/COMMENTS (OBAMACARE)
From: Mark Weaver, DPM

Yes, Ted, all four patients left in a huff. Now look at your Internet ratings;  they probably all called you a "money grubbing whore" as well! It sounds like a joke, but think of the implications. I won't mention paying the bills while not getting paid, but you only get ONE reputation in a lifetime. Guard it with your life.

RESPONSES/COMMENTS (PM NEWS QUICK POLL) PART 1A
From: Billie A. Bondar, DPM

I am writing again...to say that the stress and frustration that one goes through when dealing with network termination is not to be taken lightly. I had voiced my words negatively at APMA when indeed they were on board for me with a letter of support.

Let me note that I was heading for a second appeal to this network with an attorney per PICA to find that the network's medical director had sent a rejection letter to me for the first appeal accidentally, pushing a wrong key on his computer. I won the appeal and did not need to get an attorney. My credentials, my integrity, my clean record, my training, and my board certification choice were of strong standing in...

RESPONSES/COMMENTS (PM QUICKPOLL) - PART 1B)
RE: Have you recently been dropped from an insurance network?
From: Bryan Markinson, DPM

I am confused. Let me start by saying that I have the utmost respect for Drs. Garoufoulis and Guiliana. They are doers and elevate our profession in their daily work. Dr. Garoufalis states that we have been warned that the ACA would result in commercial carriers shrinking their networks, yet APMA went to bat for Dr. Bondar with Multiplan. The results of that meeting was that, "APMA has been warning of this."

I would like to know exactly why the networks are shrinking. Does it cost money to keep a provider electronically in a database? Is it a credentialing issue? Is it a control issue? Do we really want to be included in these plans? What became of...

RESPONSES/COMMENTS (PM QUICK POLL) - PART 1C
From: Joel Lang, DPM

I would like to piggyback on Dr. Shavelson’s recent post about being dropped from insurance plans. I wholeheartedly agree with his approach. For those people who voted a few weeks ago that they would change professions if they could – they should. I don’t necessarily mean to leave podiatry, but change their mode of practice and more important, their mode of thinking.

Do what you do best. Create a niche for yourself within the spectrum of podiatric services at which you excel or that you most enjoy. When you enjoy your work, it will translate to your patients and success will follow.

Dissatisfaction comes from ‘dancing to someone else’s music’. The values of success, satisfaction, self-esteem, happiness are generated ‘internally’. You create them for yourself. You can’t depend on others to grant them to you. Being happy is a decision, not a function of your surroundings. Being successful is a decision, not a false comparison to someone else’s standards. When your children and grandchildren sit on your lap and look into your face, appreciate that you really are the person they think they are seeing.
