PODIATRISTS AND SPORTS MEDICINE
Lions Football Player to Seek Opinion of CA Podiatrist for Ankle Injury

Joseph Fauria's season was derailed by a pair of ankle injuries, and his path forward remains unclear. The Detroit Lions tight end has a history of ankle issues dating to his college days, and continues to weigh various treatment options. That includes surgery.

Dr. Quinn Fauria

Fauria already has received a couple of medical opinions about treatment but wants to consult with his uncle, Dr. Quinn Fauria, before making a decision. Quinn is a podiatrist at the Foot and Ankle Institute of the West in Valley Village, CA. "I'm going to ask him as a doctor, and also as my uncle, and also as a former player, what to do -- how to be smart," Joseph Fauria said. "He knows me the best, and we'll see."

IN THE COURTS
Podiatrist Gets Second Chance At Lawsuit Against Wound Care Center

A federal district court didn't use the appropriate standard for determining when the entire controversy doctrine bars a lawsuit, an appeals court said Jan. 7 in vacating a ruling that dismissed a lawsuit between a podiatrist and a wound care center where he treated patients (Ricketti v. Barry, 3d Cir., No. 14-1483, 1/7/15). The U.S. Court of Appeals for the Third Circuit said the U.S. District Court for the District of New Jersey used outdated standards in dismissing Dr. James Ricketti's action against Shaun Barry and RestorixHealth.

In addition to his own practice, Ricketti, a podiatrist, treated patients at a wound care center operated by Barry for RestorixHealth. Dr. Michael Plishchuk, Ricketti's associate, was assigned to treat those patients. Ricketti fired Plishchuk, but Plishchuk continued his work at the center. Later, Barry wouldn't allow Ricketti to practice at the center because all his patients had been healed. Ricketti sued Plishchuk in New Jersey state court, alleging breach of contract, tortious interference with economic advantage and other causes of action. Neither Barry nor RestorixHealth was disclosed as a potentially liable party. Ricketti and Plishchuk settled the action. Ricketti then filed a lawsuit in state court against Barry and RestorixHealth. The complaint alleged the same causes of action and relied mostly on the same facts.

PODIATRISTS AND MARRIAGE
Podiatrists Rank #5 on Likely to Be Married List

BloombergBusinessweek has a fun breakdown of which occupations have had the highest shares of people who are married from 1950 to 2010, based on data from the Census Bureau. While engineers, mathematicians, and scientists today are (unfairly) stereotyped as awkward nerds who don’t know how to interact with the opposite sex, in 1950, they were among the occupations most likely to be married. Today, the most commonly conjugated occupations are instead more often medical professionals with doctorates, starting with dentists (81 percent of whom are hitched):

Occupations in which people are most likely to be married, 2010: 1) Dentist 2) Chief executive 3) Sales engineer 4) Physician 5) Podiatrist 6) Optometrist 7) Farm product buyer 8) Precision grinder 9) Religious worker 10) Tool and die maker.

HEALTHCARE NEWS
Obamacare Squeezing the Middle Class

Here is something few pundits predicted. Poor, long-uninsured patients are getting Medicaid through Obamacare and finally going to the doctor’s office for care. But middle-class patients are increasingly staying away. Nationwide, the size of the average deductible more than doubled in eight years, from $584 to $1,217 for individual coverage according to the Kaiser Foundation.

Deductibles of $1,000 and up are now the workplace norm. In the exchanges, total out-of-pocket costs can reach $6,600 for an individual and $13,200 for a family. Moreover, the bulk of people who get insurance in the exchanges are choosing high-deductible plans. But when those same people have a medical problem, they are often forced to spend money they don’t have, incur significant debts, or forego care.

ICD-10 UPDATE
CMS Extends Deadline  for Volunteer End-to-End Testing to January 21st

During the week of April 26 through May 1, 2015, a second sample group of providers will have the opportunity to participate in ICD-10 end-to-end testing with Medicare Administrative Contractors (MACs) and the Common Electronic Data Interchange (CEDI) contractor. The goal of end-to-end testing is to demonstrate that:
  • Providers and submitters are able to successfully submit claims containing ICD-10 codes to the Medicare Fee-For-Service (FFS) claims systems.
  • Centers for Medicare & Medicaid Services (CMS) software changes made to support ICD-10 result in appropriately adjudicated claims.
  • Accurate remittance advices are produced.

CODINGLINE CORNER
Query: B/P, BMI - How Often Does It Needed to Be Done?

How often do we need to take a blood pressure and BMI to satisfy requirements? Does it have to be at each visit?

Steven Rothstein, DPM, Manchester, NH

Response: Assuming you are referring to the requirements for meaningful use, here is the explanation from CMS regarding this measure (as you can see, you must do it once per reporting period, but after that, it is your determination about updating as it is regarding how the data is obtained). Just remember if you are also doing the PQRS measure on BMI, that measure actually requires that you weigh and measure the patient to determine the BMI: Height, weight, and blood pressure do not have to be updated by the EP at every patient encounter. The EP can make the determination based on the patient’s individual circumstances as to whether height, weight, and blood pressure need to be updated.

Vital sign information can be entered into the patient's medical record in a number of ways including: direct entry by the EP; entry by a designated individual from the EP’s staff; data transfer from another provider electronically, through an HIE or through other methods; or data entered directly by the patient through a portal or other means. Some of these methods are more accurate than others, and it is up to the EP to determine the level of accuracy needed to care for the patient and how best to obtain this information.

RESPONSES/COMMENTS (NON-CLINICAL) - PART 1
From: Robert Lagman , DPM

I have not used any of the companies you listed, but I have had a VoIP phone system for almost a year. I warn you that the Vonage business got pretty bad reviews. I did my research and settled on Nextiva, which had the best history, prices, and customer service. Costs should be very straightforward, including some set-up fees like porting numbers, purchasing appropriate phones, and a price per user or phone station. My phone bill has been cut in half and the system comes with many more options.

Disclosure: I have no personal or financial relationships to disclose with Nextiva.

RESPONSES/COMMENTS (NON-CLINICAL) - PART 2
From: Alan Meyerberg, DPM

I am so tired of hearing one type of podiatrist bash another type. Since I entered podiatry school in 1977, I have heard rumors whispered at first about how "we eat our young." In the 1980's height of the malpractice crisis, the insurance companies covering us told us most lawsuits were instigated by other podiatrists and NOT orthopedists as we all thought.

Minimal incision surgeons sued open surgeons. Boarded surgeons sued to prevent boarding of non-surgical podiatrists. For 30 years, the cry was for us to get MD degrees. Does anybody know...

Editor's note: Dr. Meyerberg's extended-length letter can be read here.
