IL Podiatrists Sue Makers of Dr. Scholl's Inserts
 
A group of podiatrists is not "gelling" with advertising claims made by the makers of over-the-counter foot care brand Dr. Scholl’s about just how "custom" is the fit of the brand's retail orthotic inserts. Podiatrist Dr. Lowell Scott Weil and Des Plaines-based Weil Foot and Ankle Institute LLC, which employs 17 podiatrists, filed a class action lawsuit Dec. 22 in Chicago federal court against Dr. Scholl’s parent company, Bayer AG, and its subsidiaries Bayer HealthCare LLC and Bayer Consumer Care LLC, as well as Dr. Scholl’s former parent Merck & Co. Inc. and MSD Consumer Care Inc. The lawsuit charges the companies with false advertising and unfair competition in the marketing of Dr. Scholl’s Custom Fit Orthotic inserts.

The podiatrists argue that the very name of the product is false and misleading. Using definitions from Merriam Webster and from the American Podiatric Medical Association, the lawsuit defines “orthotic” as a medical term and notes that Illinois law requires anyone prescribing orthotic devices be licensed by the state. Prescription orthotic devices are made custom for each individual patient to address that patient’s unique foot, ankle, and leg structure, the lawsuit stated.

Bruce Pinker, DPM, the Founder and CEO of Dr. D-LuCS (Doctor Designed Luxury Custom Shoes) held his 8th Annual Holiday Shoe Drive for the Homeless. Recently, a celebration to thank all the donors was held at BLT Steak in White Plains, NY. Over 1,000 pairs of footwear were donated.

Aussie Podiatrist Wins Sprint Championship
 
Hayley Openshaw bounced back from a disappointing start to her Victorian campaign to claim her second successive Women’s Vase at Cricket Willow on Saturday. Despite being penalized in an earlier heat, she coasted home in easy fashion, and then was equally impressive in the final as she ran 12.89 seconds.

Hayley is preparing to move to England to pursue her career as a podiatrist. Openshaw, who has a background in beach sprinting, will compete in one more event before departing.

Many See IRS Penalties as More Affordable Than Insurance
 
According to the New York Times, the Obama Administration reports that as of this fall, 10.5 million people who are eligible to buy health insurance through the ACA exchanges were still uninsured. While the number appears to be getting smaller, “plenty of healthy holdouts remain, and their resistance helps explain why insurers are worried about the financial viability of the exchanges over time.”
 
Many of these holdouts chose to remain uninsured “after meticulously comparing the cost of insurance premiums and deductibles with paying for doctor appointments, lab tests, and prescriptions themselves.” For some, those costs, “which can exceed $10,000,” make the penalty for not having insurance “seem a better deal.”

QUERIES (EHR)

Query: Kareo vs. Chart Logic

I am changing my office over from in-house billing and collections to outsourcing  and changing my EMR in the process, as I want them all to coordinate. I have narrowed my choices down to Kareo vs. Chart Logic. Chart Logic coordinates with Advanced MD (that does the billing and collection portions for Chart Logic users). Does anyone have any input on either of these companies?

Query: Bilateral Total Contact Casts
 
We have a few patients who require wound debridement and application of total contact casts bilaterally. We have one payer who continues to initially deny the payment for the casts. We appeal and the claims go under review and eventually get paid, but it takes 4-6 months. Here is the coding and sequencing we are using including the modifiers: 
 
CPT 11042  CPT 97597-59  CPT 29445-59-RT  CPT 29445 59-LT  Are we missing something?

Response: If the payer is Medicare, you would code the application of bilateral total contact casts as CPT 29445-50-59 (1 unit). 
 
Some other payers may have similar coding requirements; others may want the cast application billed on two lines. 
 
As far as the debridements, Medicare (and maybe the payer you are referring to) does not pay for debridements performed on the same limb that a cast is applied. And, obviously, if the payer did, the debridement to and including subcutaneous tissue and the selective debridement would need to be on two totally separate locations. You need to make sure that is clearly documented in your chart. Check with the payer for written policies on this.
